ORDER GRANTING CONTINUANCE
On November 26, 2024, the Arizona Registrar of Contractors issued a Notice of Hearing on Contested Case (“Notice of Hearing”) in the above captioned matter that set an administrative hearing before the Arizona Office of Administrative Hearings (“OAH”), an independent state agency, for an evidentiary hearing on January 31, 2025, at 9:00 a.m. to determine whether grounds exist for the Registrar to take disciplinary action against Respondent’s construction licenses based on alleged violation(s) of Ariz. Rev. Stat. §§ 32-1154(A)(2)(b), 32-1154(A)(3); Ariz. Admin. Code R4-9-108(a), and 32-1154(A)(22).
On January 31, 2025, the hearing was conducted by the undersigned, with representative for both parties present. At the close of the evidentiary record, both parties offered closing arguments whereby each expressed their desire to settle their underlying dispute. After which, Complainant submitted a Motion to Continue in the hopes that the parties would be able to enter into a settlement agreement in lieu of the Tribunal issuing a Recommended Decision to the Registrar for issuance of a Final Order in the matter.
Upon consideration of the foregoing,
IT IS ORDERED that Complainant’s motion is granted. Good cause appearing, the hearing in the above-entitled matter is continued and set for a Status Update on Monday, March 03, 2025. On or before this date Complainant shall submit one of the following motions to OAH:
(1) Provide notice of satisfactory resolution by submitting a Motion to Vacate;
(2) Provide notice that the parties need additional time to resolve the matter by submitting a Motion to Continue and reset for Status by 30-days, 45-days, 60-days, 90-days, or
(3) Provide notice that the parties were unable to resolve their dispute and request that the undersigned issue a Recommended Decision in the matter.
Failure to timely submit a Status Update may result in the matter being vacated from OAH’s calendar and remanded to the referring agency for further action, if any, pursuant to Ariz. Admin. Code R2-19-111(4), or alternatively, issuing a Recommended Decision.
