ORDER GRANTING CONTINUANCE
AND SETTING HEARING VIA GOOGLE MEET
The hearing of this matter was initially scheduled to convene on October 1, 2024, at 9:00 a.m. On the date and time set for hearing, Complainant Leonard Buckmaster appeared on his own behalf. Elicio Aguilar appeared on behalf of Respondent A & G Builders, LLC, with his son, Elicio Aguilar. Registrar of Contractors Investigator Ruben Perez appeared as a witness.
The parties participated in a prehearing discussion outside of the presence of the Administrative Law Judge. The parties were unable to resolve their differences. However, it was apparent that Mr. Aguilar required the assistance of a Spanish interpreter. A request for such service was not made prior to the hearing. In order to provide translation services for Mr. Aguilar, the hearing was continued.
On October 1, 2024, an Order Granting Continuance was issued to the parties setting the matter for continued hearing on October 21, 2024, at 9:00 a.m. However, after receiving the Order, Investigator Perez informed the Tribunal and the parties that he was unavailable to attend the hearing on October 21, 2024. Consequently, on October 2, 2024, the Tribunal issued to the parties an Order Accelerating Hearing Date and Providing New Google Meet Link, advising the parties that the hearing would convene on October 18, 2024, at 9:00 a.m., and providing a new Google Meet link for the hearing.
On October 18, 2024, at the time set for hearing, both Mr. Aguilars appeared for hearing, as well as Investigator Perez. However, they appeared using the Google Meet link for the originally scheduled hearing date. Mr. Buckmaster and the assigned interpreter did not appear for hearing with the Google Meet link to be used for the October 18, 2024 hearing date or for the initial hearing date. The Tribunal and Investigator Perez attempted to contact Mr. Buckmaster by phone, however, he did not answer any of those calls.
Given the above-delineated circumstances, the Tribunal deemed it appropriate to continue the hearing and issued an Order continuing the hearing to November 5, 2024, at 9:00 a.m.
On November 5, 2024, at the time set for hearing, Mr. Buckmaster, Investigator Perez, and Elicio Aquilar, Mr. Aguilar’s son, appeared for hearing. However, he informed the Tribunal that Mr. Aguilar, was ill and could not participate in the hearing and he was not comfortable proceeding in his father’s absence. The Tribunal found good cause to continue the hearing and confirmed the parties’ availability for the continued hearing date and time.
Therefore, the hearing in the above-entitled matter is continued to November 14, 2024, at 1:00 p.m.
