ORDER HOLDING RECORD OPEN

On August 9, 2024, a hearing was held in the above-entitled matter. Respondent did not appear at the hearing. During that hearing, Investigator Philpott testified that the Registrar of Contractors does not evaluate workmanship for items that have been approved by County inspectors. Arizona Revised Statutes (A.R.S.) § 32-1104(A)(5) limits the Registrar’s authority when the Registrar’s standards differ from county, city, and other standards.

Complainant testified that multiple items had been wrongly approved by the Mohave County Development Services Department. Good cause was established, and sufficient information was provided, to keep the record open in this matter to allow Complainant to request the County to re-inspect the complaint items that Investigator Philpott categorized as ITEMS NOT REQUIRING CORRECTION because the Mohave County Development Services Department approved them.

At the hearing, Investigator Philpott offered to communicate with Complainant, but he did not offer to act as an intermediary or otherwise act outside of his role as the designated investigator for the Registrar of Contractors. Investigator Philpott stated that Complainant would be responsible for interacting with the County.

On August 15 and 16, 2024, Complainant requested an order for re-inspection by the County. This Tribunal does not have the authority to order such an inspection. Complainant also expressed concern about communications with the County and the Registrar. This Tribunal does not have authority over such communications.

IT IS ORDERED that by August 30, 2024, Complainant will notify this Tribunal of the status of a County re-inspection.

IT IS ORDERED that if the County will re-inspect, the record will remain open, allowing for such a re-inspection.

IT IS ORDERED that if the County will not re-inspect or this Tribunal does not receive notification from Complainant, the record will be closed at 5:00 PM on August 30, 2024.
