Purpose of the Jobsite Inspection When the Registrar receives a complaint against a contractor’s license alleging poor workmanship, the Registrar generally schedules a Jobsite Inspection. The Jobsite Inspection serves two purposes: 1. To give the contractor an opportunity to inspect the complaint items; and 2. To give the Registrar an opportunity to determine if the contractor’s work violates Arizona law.
Jobsite Inspection Rights and Responsibilities Access to inspect: The property owner has complete control over who they allow on the property. However, if the Registrar’s investigator or the contractor cannot inspect the work, the Registrar will not move forward with a citation.
Cooperation: Arizona law enables injured parties to seek relief for damages through several paths. When dealing with a licensed contractor, the Registrar of Contractors’ administrative complaint process may serve as one of those possible paths. However, in order to use that path, the Registrar relies on the cooperation of all parties to a complaint.
Minimum workmanship: The Registrar investigates workmanship complaints for compliance with minimum workmanship and professional industry standards. The Registrar does not issue citations for work that meets these standards.
Scope: The scope of the Jobsite Inspection is limited to items listed in the complaint filed with the Registrar’s office. It is the complainant’s responsibility to point out the complaint item(s) and the Investigators role to review the item(s). If the complainant identifies additional workmanship items not listed in the original complaint, they must file an addendum to the complaint. The Registrar’s Investigator may identify additional administrative violations by the contractor (e.g. work performed out of scope of the license and failure to provide a contract that meets requirements set by Arizona law) at the time of the inspection.
The Role of the Investigator At the Jobsite Inspection, the Registrar’s investigator will: ● Only investigate the items listed on the complaint form filed with the Registrar. ● Will gather evidence to make an informed decision about the complaint items.
What to expect after a Jobsite Inspection 1700 W. Washington Street, Suite 105 · Phoenix AZ 85007-2812 602.542.1525 · Toll Free 877.692.9762 · roc.az.gov C008 12/23 After doing a Jobsite Inspection, the Registrar’s Investigator will leave the jobsite and review the evidence provided during the inspection. Generally, the investigator does not make any determination at the time of the jobsite inspection regarding whether the allegations listed in the complaint are supported. ● If the allegations are confirmed, the Registrar’s Investigator may issue a Written Directive telling the contractor to correct the poor or incomplete work. ● If the allegations are not confirmed, the Registrar’s Investigator will close the complaint.
Questions? If you have already filed a complaint and it was assigned to an investigator, you are encouraged to contact that investigator directly with the information listed in your jobsite inspection letter. If you have not filed a complaint yet or have not been assigned an investigator, you can reach the Registrar’s compliance department at (877) 692-9762.

Written Directives Access: In order to use the administrative process offered by the Registrar, a property owner must provide reasonable access to allow the contractor to fix their work as directed by the Registrar in a Written Directive. Complainants may not put any additional, unnecessary restrictions on the Respondent above and beyond the initial contract requirements agreed upon at the beginning of the project. Respondents are required to make repairs on items identified on any Written Directive, not otherwise restricted by local code or HOA limitations. Complainants must make access available to the Respondent to make the required repairs and failure to provide reasonable access may result in the Registrar dismissing the complaint.
Contractor obligations: The Written Directive will set a deadline for compliance. This is the period of time determined by the Investigator as necessary to complete the items listed in the Directive. ● The deadline for compliance assumes the contractor will promptly begin working on the items listed in the Directive. ● Do not wait. Both parties should communicate quickly to schedule the work.
Extensions: If good cause exists to extend this deadline, either party may submit a written request to the Investigator. The Registrar will review requests for extension and determine if the Directive should be extended.
Manner and method of performance: The Registrar does not provide specific instructions for how to correct poor work. A licensed contractor is expected to have the skill and 1700 W. Moreover, the complainant may not dictate the manner of repair. If the contractor fails to appropriately correct the work according to the contract, the Registrar will issue a citation.
Compliance Inspection: After the Written Directive expires, the Registrar’s Investigator will contact the complainant to determine if the contractor performed any corrective work. ● If the contractor did corrective work, the Investigator may schedule a Compliance Inspection to determine if the poor work is corrected. ● If the contractor did not perform any corrective work, the Registrar’s Investigator will not do a Compliance Inspection and will determine whether to issue a citation based on the administrative record.
Work performed after the directive ends: After the Directive period ends, a property owner may choose to allow the contractor to continue its work. The Registrar encourages parties to work cooperatively, but cannot require a homeowner to continue to allow a contractor access to the property after the Directive period ends in order for the administrative process to continue. Denying access after the Directive ends is not grounds to close or dismiss a complaint.

Mike,
Tucson Window and Door just emailed us at 1122 to schedule the corrections. We haven’t heard anything from them since the inspection.
Today is the last day for them to complete the corrections, correct? Not schedule?

I know they said they used window flashing when you asked them but is there a way we can check? I don’t remember them putting any flashing in unless it was built into the windows somehow? They just sawzall’d the windows out and popped the new ones in. They took out the metal flashing if that was in place with the old ones.

Hi Madison,
My sales manager, Dale, and I tried to call you earlier today to discuss a few things (I apologize if you did not receive a voicemail). If you have a time in the morning that works best for you, Dale and I can call you to review a few details.
I wanted to bring Dale into the mix for a few reasons and we reviewed the photos and timeline of installation of your windows today. He is in complete agreement with the need to determine a permanent solution. Because Bret’s son was still sick today, I did not get to speak with him in person, but he did agree to providing compensation. He wants to understand the full scope of the service needed now before giving me those specifics.
I would still like to have Jim out to you as scheduled this week. I think it would be best to have him do a complete assessment of the work that needs to be done so that we can make sure to order any materials that may be needed. I’m not sure if some of the units may need to be removed and reinstalled or replaced, but Jim can give me that information after reviewing your windows. This way, we would be able to have everything we need, the appropriate amount of time and the right installers scheduled to get everything taken care of in however many consecutive days are needed.
Please let me know if there is a time tomorrow morning that works for me to call you. I will make sure Dale is also on the call.
Thank you

Lauren, Great. Thank you for starting that conversation. Jim finished up the caulking in back (I believe) so the dogs will be in the yard. There are a few areas of split calling in the house that I talked to Mike and Jim about and I told Jim if it comes down to it, we can leave the house unlocked. Not thrilled about that but I can't be home anymore. Thank you for initiating that conversation. We will wait until next week to start the next level discussions.

I have already started the conversation regarding compensation with the owner. He understands the significance of the substandard workmanship and time taken from you to get this right. He feels that we should wait to have a more in-depth discussion until everything is completed so that we will have a full understanding of everything that had to take place to correct the initial installation. I have also been given the green light to contact a contractor should there be additional stucco work necessary. I will need to talk to Jim further about what he thinks the best course of action would be. Please let me know if you have any questions.

No worries. How many gallons of paint will Jim need? We only have about 1/3-1/2 a gallon. The 16th and 17th is fine, but we will both be at work. Is that the time estimate for finishing the caulking or is that the time estimate for painting as well?
Has the conversation been started internally for monetary compensation for the project? The amount of days I or Ryan had to be home, the damages to the house, the time wasted on late appts or showtimes of late afternoon instead of 0900...
This 25K project was far below standards and regardless of the work Jim has done/will do, there are still damages to our home and many lost days with having to be at the house. Initial install was three days. We have had to be home an additional 6+.

May 22nd, 2024 License No. ROC 206959 Case No. 2024-01537
“Written Answer to Citation and Complaint”
Tucson Window and Door, Inc. would like to address the two charges attached to the Citation in Case No. 2024-01537 in the written response below.
Charge: 1 A.R.S. § 32-1154(A)(3) – R4-9-108(c) “Violation of any rule adopted by the Registrar; Namely A.A.C. R4-9-108(c): All work performed by a contractor in a county, city, or town that has not adopted building codes or where any adopted building codes do not contain specific provisions applicable to that aspect of construction work shall be performed in accordance with professional industry standards.”
Charge: 2 A.R.S. § 32-1154 (A)(22) “Failure to take appropriate corrective action to comply with this chapter or with rules adopted pursuant to this chapter without valid justification within a reasonable period of time after receiving a written directive from the Registrar. The written directive shall set forth the time within which the contractor is to complete the remedial action. The time permitted for compliance shall not be less than fifteen days from the date of issuance of the directive. A license shall not be revoked or suspended, nor shall any other penalty be imposed for a violation of this paragraph until after a hearing has been held.”
Tucson Window and Door takes the directive requirements from the Registrar very seriously. Prior to scheduling with the homeowner, Tucson Window and Door wanted to ensure we fully understood the scope of work, which window(s) required corrective actions, and that all materials required were accounted for and in-house. We did not want to inconvenience the homeowner by failing to address all aspects of the written directive detailing necessary corrective action. In this case, Tucson Window and Door was initially unaware of any repairs or services needed, as our records indicated that the project was fully completed in March 2023. Until we were contacted by our window company’s sale representative in January 2024, we were unaware of any issues whatsoever. Tucson Window and Door contacted the homeowner the same day, and between 1/29/24 – 2/1/24, both the Office Manager and Sales Manager at Tucson Window and Door communicated with the homeowner via phone and email to get a full understanding of her concerns, which largely centered around some leaking in her home. Our Received 5/22/2024 ROC Legal
senior service technician was sent to assess these concerns on February 1st, 2024. He confirmed that some caulking was cracking, but the leaking was not caused by the windows.
Following the homeowner’s dissatisfaction, the filed complaint and the inspection, Tucson Window and Door waited for the written directive before moving forward. Because we had several appointments between December 2022 to March of 2023, we first wanted to try and verify which type of caulk was used during each of the appointments to understand the areas requiring the most attention. In the time between the initial installation and the final service, Tucson Window and Door had to temporarily switch to a different caulking brand due to issues in the supply chain. While we believed that the secondary caulking most likely contributed to the unusual cracking, we did not want to assume that was the case. To do so, a significant amount of time was needed to cross reference previous caulking orders, service dates, and units worked on at each date.
In working to address the written directives from the inspection, Tucson Window and Door had some confusion understanding the window units in need of attention, as Compliance Item: 4 referenced ‘windows [at] garage’. Tucson Window and Door did not supply, install, or perform any work on the customer’s garage windows. Our installation manager reached out to the ROC inspector assigned to this case for clarification.
Because Tucson Window and Door was unaware of any issues at the job site for the nine months following the completion of the project, we wanted to confirm that our corrective action plan was acceptable and addressed all the written directives entirely and appropriately. Prior to the deadline, Tucson Window and Door provided a response via email to the investigator in this case requesting confirmation that the above plan of action would satisfy the three compliance items noted in the written directive. We also contacted the homeowner via email to schedule the work, not realizing that providing a detailed plan of action did not satisfy the fifteen-day deadline.
As Tucson Window and Door has almost no experience this far into an ROC complaint, it was our misunderstanding that submitting a written response prior to completing the work did not properly communicate our intent to verify our action plan would satisfy the standards of the written directives. Tucson Window and Door should have submitted a request for an extension to express the level of preliminary work we felt was necessary to confirm prior to returning to Received 5/22/2024 ROC Legal
perform corrective action. It was our intention to have the full scope of information and the correct caulking brand and quantity, along with other materials needed, to best correct the homeowner’s complaints.
If given the opportunity, Tucson Window and Door would like to complete the work as intended per our previously submitted response. We feel that it is our responsibility to correct any work that is lesser than industry standards as well as our own company standards. From the date we were first made aware of new issues following March 2023, Tucson Window and Door was prompt in responding, communicating and assessing the customer’s concerns. We failed to recognize the process and time frame of completing corrective action and take full responsibility for our shortcomings. Upon receiving the Registrar’s citation, Tucson Window and Door contacted both the Registrar of Contractors and the Investigator assigned to this case to understand where we failed to follow the requirements to resolve this complaint. We were instructed to provide all the information in this response and hope we did so in an appropriate and acceptable manner. Throughout the process, Tucson Window and Door worked to resolve the homeowner’s concerns and directives provided by the Registrar in good faith. We appreciate your time and consideration in the next steps towards reaching a final resolution. Mike,
Tucson Window and Door just emailed us at 1122 to schedule the corrections.

On Feb 14, 2023, at 11:59 AM, Lauren Crownover <[email redacted] wrote: Hi Madison, As Jim explained it, he would be working on the caulking on Thursday and then completing the painting on Friday. That way the caulk can dry overnight. I'm thinking that if you have the paint, he can take a sample with him on Thursday and have it color matched so that he can pick up more if needed for Friday.

If it works for you, I can have Jim out to your home to finish up the service on Thursday-Friday of next week, which is the 16thand 17th. In speaking with Jim, he feels that the job would be fully completed if we did some exterior painting. Although painting is not something that we normally do, if you are okay with it, we will do the paint touch-up as needed so that you don't need to worry about having to do so once we are done fixing the caulking. Why did you schedule us for a me when he was not going to be able to make it due to a meeng.

Good morning Jim came in to give me that details of what is going on at your home. I would like to have Mike, our install manager, come out for a quality control check. He is available this Monday the 6th between 9 and 10. Will this time work for you? Also, I’m having a hard time getting the invoice with the details you are asking for. Our pricing is not really broken down that way so, I’m going to contact the sales manager to find out more for you. I appreciate your patience. Thank you, Rachel Morgan

Rachel, Please reply all to these emails. We can’t make it this week due to work. We will be in next week and will send you an email. I would like to set up an appt instead of just walking in to make sure we will be able to talk to whoever we need to. I have been told multiple times that the company would speak to a manager about this situation and get back to me with a plan, I still haven’t heard anything. If the situation has been shared with a manager already, that is the person we would like to meet with for continuity. Please also send over an itemized receipt for our home project. We have a total receipt but need one of the breakdown of window cost vs install costs vs taxes and fees…etc. Thanks, Madison

Here are those indoor caulking pictures. There’s also these black lines everywhere on the frames (pic included). What can I use to get them off?? Don ’t want to put something on that damages them Ignore the holes, those are for the blinds. The caulking is starting to split though which sucks :/

Morning, Probably should have said “Kelly house pictures” I can’t remember what name it was under, still changing over my last name. It’s for the 2488 E Andrada work. This is a picture of the inside caulking. It’s been less than a week and already splitting. A few of the windows are doing this. Thanks! Give me a call if that’s easier. 707-685-4259

Hey,
Not trying to be a pain in the ass, just want to ask about the caulking. The head guy said he had a new guy doing it and it got away from him. Dropped a chunk of money on the windows and painting over this is still going to look funky and it looks rushed. I can send some more pictures if needed. Those are just some of the windows but they are all about the same look. Mediation Notice
