ORDER VACATING

HEARING

The hearing of this matter initially convened on August 22, 2024, at 9:00 a.m. Brittney K. Walsh, Esq. represented Complainant Jackie Schwane, who was present with her husband, Leland Schwane. Taschia Salas and Victor Salas appeared on behalf of Tavas, LLC (“Respondent”). Arizona Registrar of Contractors Investigator Cliff Corlett appeared as a witness.

Prior to the commencement of the hearing, and then again after opening statements, the parties participated in settlement discussions outside of the presence of the Administrative Law Judge. As a result of those discussions, the parties entered into a settlement agreement, however, needed additional time in which to execute the terms of their agreement. As a result, the matter was set for a written Status Update on October 31, 2024.

On November 4, 2024, Ms. Walsh, on behalf of Complainant, requested that the matter be set for an additional Status Update in order to provide time for an inspection. The matter was thereafter set for a second Status Update on November 29, 2024.

On November 29, 2024, Ms. Walsh submitted a Status Update indicating that outstanding issues remained. Consequently, a continued hearing date was scheduled for December 20, 2024, at 9:00 a.m.

On December 20, 2024, at the time set for hearing, Ms. Walsh appeared on behalf of Complainant who was not present. Taschia Salas and Victor Salas appeared on behalf of Respondent. Investigator Corlett was present.

Prior to the commencement of the hearing, it was ascertained that the items for which Complainant had requested the continued hearing be set to address, were outside the scope of the hearing. Ms. Walsh confirmed that the items ordered to be corrected, have been corrected.

Ms. Walsh was provided the option of continuing the hearing in order to have Complainant present, or to have the hearing vacated. Ms. Walsh opted to have the hearing vacated given that the corrective work within the scope of the hearing has been performed.

Sufficient cause appearing,

IT IS HEREBY ORDERED that the hearing in this matter is vacated from the calendar of the Office of Administrative Hearings.

IT IS FURTHER ORDERED remanding this matter to the Arizona Registrar of Contractors for further action.
