You must attend this hearing. This is an adversarial hearing before an administrative law judge, and is conducted in a similar manner as judicial proceedings. Thus, you must be prepared to present evidence, including witness testimony and documents, in support of your case.

STATEMENT OF LEGAL AUTHORITY AND JURISDICTION The State of Arizona has determined that the licensing and regulation of construction contractors is a proper state function, and has vested authority in the Registrar of Contractors

to administer Title 32, Chapter 10 of the Arizona Revised Statutes. A.R.S. §§ 32-1101 et seq.

All hearings for alleged violations of Title 32, Chapter 10 are conducted under Title 41,

Chapter 6, Article 10. A.R.S. § 32-1156.

The statutes and rules governing the hearing can be found at: Arizona Revised Statutes §§ 41-1092 to -1092.12, and Arizona Administrative Code R2-19-101 to -122. PARTICULAR ARIZONA STATUTES AND RULES INVOLVED The statutes and rules the Respondent is alleged to have violated are cited in the complaint and citation, which were served on the Respondent on March 21, 2024.

SHORT AND PLAIN STATEMENT OF THE MATTERS ASSERTED The complaint and citation allege that the Respondent committed the following act(s):

Charge: 1 A.R.S. § 32-1154(A)(10)

THE PARTIES TO THE ADMINISTRATIVE HEARING

Because Respondent is a licensee and is charged with an act(s) or omission(s) that is cause for the suspension or revocation of a license, Respondent is a party to this case and will be a party to the hearing. Because Complainant alleged Respondent committed an act(s) or omission(s) that is cause for the suspension or revocation of a license, Complainant is a party to this case and will be a party to the hearing.

Respondent and Complainant, as the parties to the hearing, will present evidence and

argument to the administrative law judge.

RIGHT TO BE REPRESENTED The parties to the administrative hearing may choose to be represented by an attorney.

A.R.S. § 41-1092.07(B). If one of the parties is a company, the company may be represented by an officer or employee if that person satisfies the conditions set forth in A.R.S. § 32- 1156(B). CHANGE OF ADDRESS Each party must inform the Registrar and the Office of Administrative Hearings of any change of address within five (5) days of the change. A.R.S. § 41-1092.04.

HEARING PROCEDURES AND RULES The administrative hearing will be conducted in accordance with A.R.S. §§ 41-1092 to -1092.12, and A.A.C. R2-19-101 to -122. The parties should review the statutes, rules, and processes governing the administrative hearing. REGISTRAR’S APPEARANCE BY VIDEO CONFERENCE OR TELEPHONE The Registrar’s investigators, employees, and attorneys will appear at the hearing via video conference or telephone unless requested by a party to appear in-person. Requests for the Registrar’s investigators, employees, or attorneys to appear in-person must be filed with the Registrar and the Office of Administrative Hearings no later than seven (7) calendar days prior to the hearing date.

HEARING PACKET In the interests of administrative efficiency, the Registrar compiles and discloses

certain documents to the parties and the Office of Administrative Hearings. These documents

are attached to this Notice of Hearing as the “Hearing Packet.” If any party wishes to submit

additional evidence, they must do so during the hearing after completing a disclosure statement. See “Disclosure Statement” section below. SUBPOENAS FOR TESTIMONY FROM A WITNESS OR DOCUMENTS The parties to the hearing must be prepared to present evidence in support of their

case. If a party wants to obtain testimony from a witness or documents not in the party’s

possession, the party must prepare and file a written subpoena for the Administrative Law

Judge to review and sign, if approved. A.R.S. § 41-1092.07(C). Forms for requesting a

subpoena can be found on the Office of Administrative Hearings’ website at www.azoah.com. The party seeking a subpoena must serve notice on all the parties to the hearing, and on the Registrar. A.R.S. § 41-1092.04.

DISCLOSURE STATEMENT

At least seven calendar days before the hearing, each party must prepare and serve a disclosure statement on all other parties, and file it with the Office of Administrative Hearings. A.A.C. R4-9-118; A.A.C. R2-19-108. The disclosure statement must include any exhibit the party will use at the hearing. A party’s failure to timely disclose any witness or exhibit, without good cause, may result in the administrative law judge excluding those witnesses or exhibits from being used at the hearing. CHANGING THE HEARING DATE The date of the hearing may only be advanced or delayed on the agreement of the parties or on a showing of good cause. A.R.S. § 41-1092.05(C). The date of the hearing may be changed by filing a written agreement of the parties to change the date of the hearing. The written agreement must be filed with the Office of Administrative Hearings, directed to the assigned Administrative Law Judge, and transmitted to the Registrar and all other parties. The assigned Administrative Law Judge may be found on the Office of Administrative Hearings’ web portal at www.azoah.com If a party would like to move the date of the hearing without agreement of all parties,

the party must file a written motion with the Office of Administrative Hearings, directed to the

assigned Administrative Law Judge, and transmit a copy to the Registrar and all other parties.

The motion must state in detail good cause for why the date of the hearing should be advanced or delayed, and the position of all other parties regarding the advancement or delay. A party may also file a motion asserting a right to an expedited hearing upon a showing of extraordinary circumstances or the possibility of irreparable harm. A.R.S. § 41-1092.05(E).

RESOLUTION SHORT OF ADJUDICATION In any case which is resolved or settled by the parties, or which is withdrawn by the Complainant without objection from Respondent after the Notice of Hearing is issued, the parties must notify the Office of Administrative Hearings of the resolution or settlement. To that end, please accept this letter as SSE’s Response to Complaint No. 2024-01236. 4RB Services, LLC DBA A-American Septic (“American Septic”) failed to mark other utilities prior to excavation and as a result caused significant damages to the property located at 7014 E. Palo Verde Lane in Paradise Valley, Arizona. Attached, please find the letter from Menotti Construction Group dated February 26, 2024, which further details and attests to the damages caused by American Septic. Photos are also attached. Additionally, please find Menotti Construction Group’s invoice dated February 27, 2024, in the amount of $2,250.00 and Prestige Plumbing Company’s invoice dated November 27, 2023, in the amount of $2,950.00. These expenses were incurred repairing the damage caused by American Septic. Further, SSE had internal costs for addressing the damages caused by American Septic that amounted to $2,600.00. In short, American Septic caused significant damages for which the cost of repair was initially unknown and needed to receive invoices from third parties before issuing any payment. The last invoice was received on February 26, 2024. American Septic claims to be owed $12,512.31. SSE’s total damages amount to $7,800.00. To Whom It May Concern:

We are writing to provide a detailed account and justification for the additional charges that have been applied to your project, specifically related to the property located at 7014 E Palo Verde Ln, Paradise Valley. These charges stem from unforeseen damage caused by the excavation activities conducted by the contracted septic company, which necessitated immediate and extensive repairs to both the gas line infrastructure and pool-related plumbing systems.

During the excavation for a new septic tank installation, significant damage was inflicted upon the existing underground utilities, including polyethylene gas pipes of varying diameters and critical components of the pool’s plumbing system. It was observed that the standard protocol for utility marking, commonly referred to as blue stake markings, was not adequately followed by the septic company prior to the commencement of their excavation work. This oversight led to the accidental severing of these essential services. The damage resulted in the gas line and pool plumbing systems being exposed and subsequently filled with water, mud, and debris due to adverse weather conditions, as the trenches were left open for an extended period. The complexity of the situation was further exacerbated by the need for multiple attempts to clear the lines using pressured air, a process that was both time-consuming and costly.

Prestige Plumbing Company, under the guidance of Mr. Raul Leyva, was commissioned to undertake the necessary repairs. Despite the challenging conditions, they successfully restored both the gas line service and pool plumbing functionality. However, the nature of these repairs led to significant additional costs due to the extensive labor and materials required. The additional charges levied on your project account for the direct costs associated with the emergency repair work. These were essential actions taken to ensure the safety of the property and its future occupants, as well as to mitigate further damage and potential delays to the project timeline.

Menotti Construction Group LLC is committed to the successful and timely completion of your project. We understand the inconvenience and potential financial impact these unforeseen charges may cause. Therefore, we are prepared to assist SSE Development in seeking reimbursement from the septic company responsible for the damages through legal back charge procedures. We appreciate your understanding and cooperation in this matter. Please find attached detailed documentation of the repairs conducted, including itemized costs and photographic evidence of the damage and repair process. Above- Damaged gas line. American Septic tore the connection at the T connection, which allowed dirty water to get into the gas line. The connection had to be replaced and the contractor found dirt in the line, which had to be thoroughly cleaned before making the repair.

DUE UPON COMPLETION $ 10,620.31 We recommend hiring a landscaper to complete restoration of your property. We are not responsible for any damages to your landscaping caused during the repairs or installation of your septic system. We only fill the area of work to surrounding grade, this does not mean we do “finish” grade work. Improved surfaces such as pavers, curbing, concrete & gravel driveways will require restoration by others. • DAMAGED UTILITIES. Any utilites not marked by 811, damaged during work on your septic system will not be the responsibility of A-American Septic. This includes any irrigation lines, sprinkler lines, water lines, gas lines, electrical or communications lines. In the event of damage to any utility our recommendation will be to contact an appropriate licensed third party for repairs. • HARD DIG. Excavation through any cemented soils “Caliche” or rock like soil is billed in addition to the contract total via a change order. • SPECIFIC TIME FRAMES. We do our best to ensure your project is moving forward. Unfortunately, when using thLUG party engineering firms and variable plan review timeframes and weather, it’s not possible for us to accurately predict when permits will be approved, reviewed, revisons completed or permit numbers issued. NOTE: PLAN REVISIONS MAY IMPACT PRICING. • MATERIAL HAUL-AWAY & DISPOSAL. Unless included in the scope of work above, we do not haul away material left over from our work. We will stage soil on-site within 25’ of the area we are working, transporting material away from the area of work will incur an additional labor cost. Hauling material off-site will incur an additional labor and transport cost. Our rate for hauling away clean dirt is $350 per 13 ton load. • PERMITTING / SOILS TESTING. Unless included above, permitting is the responsibility of the property owner. Approved permits may vary from the original scope of work. When necessary a revised estimate will be provided to the customer, prior to starting work or ordering materials. When adequate soils data is not available for a specific property, new soils testing may be required for permitting. In the event that soils testing was not included in the scope of work and is required the standard price for performing those tests is $3,200. 200. RE: Notice and Justification of Charges Due to Damages Caused by Septic Company 7014 E Palo Verde Lane, Scottsdale, AZ 85253

To Whom It May Concern:

We are writing to provide a detailed account and justification for the additional charges that have been applied to your project, specifically related to the property located at 7014 E Palo Verde Ln, Paradise Valley. These charges stem from unforeseen damage caused by the excavation activities conducted by the contracted septic company, which necessitated immediate and extensive repairs to both the gas line infrastructure and pool-related plumbing systems.

During the excavation for a new septic tank installation, significant damage was inflicted upon the existing underground utilities, including polyethylene gas pipes of varying diameters and critical components of the pool’s plumbing system. It was observed that the standard protocol for utility marking, commonly referred to as blue stake markings, was not adequately followed by the septic company prior to the commencement of their excavation work. This oversight led to the accidental severing of these essential services. The damage resulted in the gas line and pool plumbing systems being exposed and subsequently filled with water, mud, and debris due to adverse weather conditions, as the trenches were left open for an extended period. The complexity of the situation was further exacerbated by the need for multiple attempts to clear the lines using pressured air, a process that was both time-consuming and costly.

Prestige Plumbing Company, under the guidance of Mr. Raul Leyva, was commissioned to undertake the necessary repairs. Despite the challenging conditions, they successfully restored both the gas line service and pool plumbing functionality. However, the nature of these repairs led to significant additional costs due to the extensive labor and materials required. The additional charges levied on your project account for the direct costs associated with the emergency repair work. These were essential actions taken to ensure the safety of the property and its future occupants, as well as to mitigate further damage and potential delays to the project timeline.

Menotti Construction Group LLC is committed to the successful and timely completion of your project. We understand the inconvenience and potential financial impact these unforeseen charges may cause. Therefore, we are prepared to assist SSE Development in seeking reimbursement from the septic company responsible for the damages through legal back charge procedures. We appreciate your understanding and cooperation in this matter. Please find attached detailed documentation of the repairs conducted, including itemized costs and photographic evidence of the damage and repair process. Damage to T Connection.

Above- Damaged gas line. American Septic tore the connection at the T connection, which allowed dirty water to get into the gas line. The connection had to be replaced and the contractor found dirt in the line, which had to be thoroughly cleaned before making the repair.
