COMPLAINANT, ORDER VACATING HEARING v.

Leo Joseph Prague Rafferty DBA: IM Contracting License No. ROC 338587, RESPONDENT.

The hearing of this matter was scheduled to convene on October 29, 2024, at 1:00 p.m. On the date and time set for hearing, Complainant George Quarles appeared on his own behalf with his wife, Christine Quarles. Assistant Attorney General Charles Hover III represented the Arizona Registrar of Contractors (“Registrar”). Douglas Ulmer appeared as a witness for the Registrar. Respondent Leo Joseph Prague Rafferty, doing business as IM Contracting, did not appear. The parties participated in a prehearing discussion outside of the presence of the Administrative Law Judge. As a result of that discussion, the Quarles and the Registrar entered into a settlement agreement. The parties requested that the hearing be vacated and the matter remanded to the Registrar in order for a Quash Order to be issued, quashing the denial of a recovery fund payment to Mr. Quarles, and for the Registrar to issue an Order regarding the agreed upon award amount. Based upon the parties’ settlement agreement, IT IS HEREBY ORDERED that the hearing in this matter is vacated from the calendar of the Office of Administrative Hearings. IT IS FURTHER ORDERED remanding this matter to the Registrar for further action.
