If you have requested to appear in-person at the hearing, the hearing will be held at 1740 W Adams Street, Phoenix, AZ 85007.
You must attend this hearing. This is an adversarial hearing before an administrative law judge, and is conducted in a similar manner as judicial proceedings. Thus, you must be prepared to present evidence, including witness testimony and documents, in support of your case.
STATEMENT OF LEGAL AUTHORITY AND JURISDICTION The State of Arizona has determined that the licensing and regulation of construction contractors is a proper state function, and has vested authority in the Registrar of Contractors
to administer Title 32, Chapter 10 of the Arizona Revised Statutes. A.R.S. §§ 32-1101 et seq.
All hearings for alleged violations of Title 32, Chapter 10 are conducted under Title 41,
Chapter 6, Article 10. A.R.S. § 32-1156.
The statutes and rules governing the hearing can be found at: Arizona Revised Statutes §§ 41-1092 to -1092.12, and Arizona Administrative Code R2-19-101 to -122. PARTICULAR ARIZONA STATUTES AND RULES INVOLVED The statutes and rules the Respondent is alleged to have violated are cited in the complaint and citation, which were served on the Respondent on February 20, 2024.
SHORT AND PLAIN STATEMENT OF THE MATTERS ASSERTED The complaint and citation allege that the Respondent committed the following act(s):
Charge: 1 A.R.S. § 32-1154(A)(10)
THE PARTIES TO THE ADMINISTRATIVE HEARING
Because Respondent is a licensee and is charged with an act(s) or omission(s) that is cause for the suspension or revocation of a license, Respondent is a party to this case and will be a party to the hearing. Because Complainant alleged Respondent committed an act(s) or omission(s) that is cause for the suspension or revocation of a license, Complainant is a party to this case and will be a party to the hearing.
Respondent and Complainant, as the parties to the hearing, will present evidence and
argument to the administrative law judge.
RIGHT TO BE REPRESENTED The parties to the administrative hearing may choose to be represented by an attorney.
A.R.S. § 41-1092.07(B). If one of the parties is a company, the company may be represented by an officer or employee if that person satisfies the conditions set forth in A.R.S. § 32- 1156(B). CHANGE OF ADDRESS Each party must inform the Registrar and the Office of Administrative Hearings of any change of address within five (5) days of the change. A.R.S. § 41-1092.04.
HEARING PROCEDURES AND RULES The administrative hearing will be conducted in accordance with A.R.S. §§ 41-1092 to -1092.12, and A.A.C. R2-19-101 to -122. The parties should review the statutes, rules, and processes governing the administrative hearing. REGISTRAR’S APPEARANCE BY VIDEO CONFERENCE OR TELEPHONE The Registrar’s investigators, employees, and attorneys will appear at the hearing via video conference or telephone unless requested by a party to appear in-person. Requests for the Registrar’s investigators, employees, or attorneys to appear in-person must be filed with the Registrar and the Office of Administrative Hearings no later than seven (7) calendar days prior to the hearing date.
HEARING PACKET In the interests of administrative efficiency, the Registrar compiles and discloses
certain documents to the parties and the Office of Administrative Hearings. These documents
are attached to this Notice of Hearing as the “Hearing Packet.” If any party wishes to submit
additional evidence, they must do so during the hearing after completing a disclosure statement. See “Disclosure Statement” section below. SUBPOENAS FOR TESTIMONY FROM A WITNESS OR DOCUMENTS The parties to the hearing must be prepared to present evidence in support of their
case. If a party wants to obtain testimony from a witness or documents not in the party’s
possession, the party must prepare and file a written subpoena for the Administrative Law
Judge to review and sign, if approved. A.R.S. § 41-1092.07(C). Forms for requesting a
subpoena can be found on the Office of Administrative Hearings’ website at www.azoah.com. The party seeking a subpoena must serve notice on all the parties to the hearing, and on the Registrar. A.R.S. § 41-1092.04.
DISCLOSURE STATEMENT At least seven calendar days before the hearing, each party must prepare and serve a
disclosure statement on all other parties, and file it with the Office of Administrative Hearings.
A.A.C. R4-9-118; A.A.C. R2-19-108. The disclosure statement must include any exhibit the
party will use at the hearing. A party’s failure to timely disclose any witness or exhibit, without good cause, may result in the administrative law judge excluding those witnesses or exhibits from being used at the hearing. CHANGING THE HEARING DATE The date of the hearing may only be advanced or delayed on the agreement of the
parties or on a showing of good cause. A.R.S. § 41-1092.05(C). The date of the hearing may
be changed by filing a written agreement of the parties to change the date of the hearing. The
written agreement must be filed with the Office of Administrative Hearings, directed to the
assigned Administrative Law Judge, and transmitted to the Registrar and all other parties. The
assigned Administrative Law Judge may be found on the Office of Administrative Hearings’ web portal at www.azoah.com If a party would like to move the date of the hearing without agreement of all parties, the party must file a written motion with the Office of Administrative Hearings, directed to the assigned Administrative Law Judge, and transmit a copy to the Registrar and all other parties.
The motion must state in detail good cause for why the date of the hearing should be advanced or delayed, and the position of all other parties regarding the advancement or delay. A party may also file a motion asserting a right to an expedited hearing upon a showing of extraordinary circumstances or the possibility of irreparable harm. A.R.S. § 41-1092.05(E).
RESOLUTION SHORT OF ADJUDICATION In any case which is resolved or settled by the parties, or which is withdrawn by the Complainant without objection from Respondent after the Notice of Hearing is issued, the parties must notify the Office of Administrative Hearings of the resolution or settlement. This is a written statement explaining how we were not paid for the job we completed for Healthy Home Flooring LLC .
On November tith,2024, we began a big project for Healthy Home, that was supposed to be completed within about one week or two. As for the job we tore up and disposed of 1,536 saft of tile. Since there was so much tile to be demoed, we had a big amount of floor prep to do, which consisted of about 12 hours of grinding, and we used 60 bags of flour leveling.
After that we installed 2,600 softs of LVP. For all of this work we performed, we have not received a single dollar from Healthy Home.
We have work orders for proof of job and completion. The work was completed about a week and a half from the day the job began.
Enrique's Carpet LLC was to received payment complete.

To whom it may concern,
This is a written statement explaining a job that went unpaid by Healthy Home Flooring
LLC. The parties to contract are: Healthy Home Flooring LLC and Enrique’s Carpet LLC.
Enrique’s carpet LLC was subcontracted by Healthy Home Flooring LLC to complete a job for
their client, Matt Cormier on November 16,2022.
The scope of work provided was removing 1,536 square feet of tile. The job entailed 12
hours of grinding the floors to remove remaining thin set mortar, then 60 bags of floor leveling
were used. Once the floor was prepped, we began installing 2,052 sq ft of luxury vinyl plank
flooring. Lastly, 708 linear feet of baseboards were reinstalled. The job site was Matt Cormier’s
home located at, 2841 E Estrella Court Gilbert, Arizona 85296.

This is a written statement explaining a job that went unpaid by Healthy Home Flooring
LLC. The parties to contract are: Healthy Home Flooring LLC and Enrique’s Carpet LLC.
Enrique’s carpet LLC was subcontracted by Healthy Home Flooring LLC to complete a job for
their client, Matt Cormier on November 16,2022.
The scope of work provided was removing 1,536 square feet of tile. The job entailed 12
hours of grinding the floors to remove remaining thin set mortar, then 60 bags of floor leveling
were used. Once the floor was prepped, we began installing 2,052 sq ft of luxury vinyl plank
flooring. Lastly, 708 linear feet of baseboards were reinstalled. The job site was Matt Cormier’s
home located at, 2841 E Estrella Court Gilbert, Arizona 85296.
As a result, Healthy Home Flooring LLC agreed to the amount of $8,180 once the job
was completed. Enrique’s Carpet LLC is yet to receive any payment for completing this job. We
have provided the following work orders to show the scope of work provided for Matt Cormier’s
home.

This is a written statement explaining how we were not paid for the job we completed for Healthy Home Flooring LLC .
On November tith,2024, we began a big project for Healthy Home, that was supposed to be completed within about one week or two. As for the job we tore up and disposed of 1,536 saft of tile. Since there was so much tile to be demoed, we had a big amount of floor prep to do, which consisted of about 12 hours of grinding, and we used 60 bags of flour leveling.
After that we installed 2,600 softs of LVP. For all of this work we performed, we have not received a single dollar from Healthy Home.
We have work orders for proof of job and completion. The work was completed about a week and a half from the day the job began.

I hope this email finds you well. I am writing to provide a comprehensive response to the no-pay complaint (2024-00739) filed against Healthy Home Flooring by Enrique's Carpet, LLC.
The circumstances surrounding this dispute are regrettable, and we understand the importance of resolving such matters promptly. After a thorough investigation into the concerns raised by our customer, Mr. Matt Cormier who resides at 2841 E. Estrella Court, Gilbert, AZ 85296, we have compiled the following information for your review:
1. **Stove Installation:** The stove was re-installed incorrectly by the crew of Enrique's Carpet, LLC, causing damage to the back part which became unattached. Our records indicate that the crew from Enrique's Carpet, LLC did not bring this issue to the customer's attention and simply placed the broken piece on top of the stove.
2. **Baseboards Installation:** The customer's baseboards were installed improperly, resulting in damage to approximately 400 linear feet. This is a clear violation of the quality standards we uphold in our projects.
3. **Icemaker and RO Lines:** The installers removed the icemaker, rendering it inoperative due to missing pieces. Additionally, the RO lines were not reattached, causing further inconvenience to the customer.
4. **Dryer Hose:** The dryer hose was crushed during the reinstallation process, posing an additional issue for Mr. Cormier, and further expenses that Healthy Home Flooring had to incur to repair the damage caused by installers.
5. **Furniture Placement:** The installation crew moved back the customer's furniture before placing the proper padding underneath, resulting in scratches on the newly installed flooring.
In light of these issues, Mr. Cormier has rightfully disputed the charges with his bank, therefore, Healthy Home Flooring was never paid for the job. As a consequence, Healthy Home Flooring has no choice but to back-charge Enrique's Carpet, LLC for the damages incurred during the project.
It's essential to note that when subcontractors are hired by Healthy Home Flooring, they are required to sign a Contractor Agreement form, explicitly outlining the terms and conditions. Point 25 of this contract clearly states, "Must turn in a signed work order the same day the job is done, or you cannot take out more work, and you will not get paid until it is signed." Healthy Home Flooring never received a work order from Enrique’s Carpet signed by our customer, Mr. Cormier. This is a written statement explaining a job that went unpaid by Healthy Home Flooring
LLC. The parties to contract are: Healthy Home Flooring LLC and Enrique’s Carpet LLC.
Enrique’s carpet LLC was subcontracted by Healthy Home Flooring LLC to complete a job for
their client, Matt Cormier on November 16,2022.
The scope of work provided was removing 1,536 square feet of tile. The job entailed 12
hours of grinding the floors to remove remaining thin set mortar, then 60 bags of floor leveling
were used. Once the floor was prepped, we began installing 2,052 sq ft of luxury vinyl plank
flooring. Lastly, 708 linear feet of baseboards were reinstalled. The job site was Matt Cormier’s
home located at, 2841 E Estrella Court Gilbert, Arizona 85296.
As a result, Healthy Home Flooring LLC agreed to the amount of $8,180 once the job
was completed. Enrique’s Carpet LLC is yet to receive any payment for completing this job. We
have provided the following work orders to show the scope of work provided for Matt Cormier’s
home.

This is a written statement explaining how we were not paid for the job we completed for Healthy Home Flooring LLC .
On November tith,2024, we began a big project for Healthy Home, that was supposed to be completed within about one week or two. As for the job we tore up and disposed of 1,536 saft of tile. Since there was so much tile to be demoed, we had a big amount of floor prep to do, which consisted of about 12 hours of grinding, and we used 60 bags of flour leveling.
After that we installed 2,600 softs of LVP. For all of this work we performed, we have not received a single dollar from Healthy Home.
We have work orders for proof of job and completion. The work was completed about a week and a half from the day the job began.
Enrique's Carpet LLC was to received payment complete.

Dear Arizona Registrar of Contractors,
I hope this email finds you well. I am writing on behalf of Healthy Home Flooring about citation and complaint 2024-00739, which was received by us regarding the no-pay complaint filed by Enrique's Carpet LLC.
As of our last communication on February 8th, we provided the Arizona Registrar of Contractors with a written response to their request. However, we would like to confirm if our response was received and acknowledged by the Registrar. Additionally, we are seeking clarification on why a citation was issued in this matter despite our timely response.
Healthy Home Flooring values and respects the Arizona Registrar of Contractors and is committed to full compliance with any necessary actions to resolve this issue. We are willing to provide any further information or documentation required to facilitate the closure of this citation.
In our previous correspondence, we explained the reason behind the missed payment to Enrique's Carpet. Our company incurred significant expenses due to damages caused by Enrique's Carpet at several customer homes. Unfortunately, we had to bear the financial burden of rectifying these issues.
To elaborate further, here are the specific damages incurred during the project at Mr. Cormier's home:
1. **Stove Installation:** The stove was incorrectly re-installed, causing damage to the back part. The crew did not communicate this issue to the customer and left the broken piece on top of the stove.
2. **Baseboards Installation:** The baseboards were improperly installed, resulting in damage to approximately 400 linear feet, violating our quality standards.
3. **Icemaker and RO Lines:** The icemaker was rendered inoperative due to missing pieces, and the RO lines were not reattached, causing inconvenience to the customer.
4. **Dryer Hose:** The dryer hose was crushed during reinstallation, incurring additional expenses for repairs.
5. **Furniture Placement:** The installation crew moved furniture without proper padding, resulting in scratches on the newly installed flooring.
Furthermore, Mr. Cormier has filed an active dispute with Wells Fargo, the financing company, and as a result, Healthy Home Flooring has not received payment for the work completed at Mr. Cormier's home.
