REPRESENTATION
It has long been held that representing another person before an administrative agency is the practice of law. In Arizona, the practice of law is a matter exclusively within the authority of the judiciary, the head of which is the Arizona Supreme Court (“Court”). The Court has set forth limited exceptions to the general rule prohibiting non-attorneys from practicing law in Arizona. Rule 31.3(c)(), Legal Entities, permits a person to represent a legal entity in a proceeding at this Tribunal if: the person is an officer, partner, member, manager, or employee of the entity; the entity has specifically authorized the person to represent the entity in that proceeding; the representation is not the person’s primary duty but is secondary to the person’s duties for the entity; and, the person is not receiving separate or additional compensation for representing the entity (other than reimbursement for costs).
The Tribunal notes that out-of-state legal counsel filed documents on behalf of Respondent. Respondent and out-of-state counsel are directed to Arizona Supreme Court Rule 39 with regard to legal representation in this matter; a link to the State Bar of Arizona website is on the Tribunal’s website. In the event that additional time is needed to comply with Rule 39, Respondent should request a continuance.
