ORDER GRANTING CONTINUANCE

AND SETTING STATUS DATE

The continued hearing of this matter was scheduled to convene on October 3, 2024, at 9:00 a.m. On the date and at the time set for hearing, Complainant Thomas Hendrickson appeared on his own behalf with his wife, Muffie Scanlon. Brandon Burton appeared on behalf of Respondent OTH Remodeling, LLC. Registrar of Contractors Investigator Mark Nipp was also present.

The parties participated in a prehearing discussion outside of the presence of the Administrative Law Judge. Following that discussion, the parties advised the Tribunal that they had reached a resolution of the matter, however, needed additional time in which to fulfill the terms of the resolution. Respondent obtained the permitting for the project and was in the process of procuring funds to pay another contractor to perform the work on the project. Complainant was amenable to providing Respondent an additional sixty (60) days in which to have the work completed.

Therefore, good cause appearing, the hearing in the above-entitled matter is continued and set for a written Status Update on December 3, 2024. On or before this date, Complainant is advised to do one of the following:

Inform the Tribunal that the matter has been satisfactorily resolved by submitting a Motion to Vacate the hearing;

Inform the Tribunal that the parties need additional time to resolve the matter by submitting a Motion to Continue and reset for Status by 30-days, 45-days, or 60-days; or

Inform the Tribunal that the parties are unable to resolve their dispute and request that the matter be set for hearing.
