ORDER REGARDING COMPLAINT

On May 3, 2024 at the time of the noticed hearing, the parties came to a verbal agreement to resolve this matter with Respondent agreeing to refund, that day or by Monday, the amount of 70% of the down payment, i.e., the amount of $4,978.41.

On May 16, 2024, the Tribunal receive an exparte letter from Complainant indicating that he had not timely received the refund and, at this time, Respondent was not responding to his communications. Complainant requested that the matter be “closed as unresolved” and forwarded to the Recovery Fund.

The Tribunal does not have authority to “close a complaint.” Based on the foregoing,

IT IS ORDERED the hearing record is open until May 30, 2024 for Respondent to comply with the parties’ verbal agreement and demonstrate to the Tribunal that it has fulfilled the verbal settlement agreement and that Complainant has received the refund.

IT IS FURTHER ORDERED in the event proof of resolution is not provided to the Tribunal, the hearing in the matter will be reset for hearing, at which time the parties shall proceed and, thereafter the Tribunal will issue its recommended decision to the Registrar.
