The undersigned Administrative Law Judge, having reviewed the document Moition to Dismiss Complaint and Stay of Proceedings [sic] filed by Respondent April 14, 2025, as well as Complainant’s reply and the Registrar’s reply received April 15, 2025, and April 16, 2025, respectively, makes the following minute entry:

Respondent’s motion to dismiss is denied. Respondent’s motion to stay proceedings is also denied.

The Recommended ALJ Decision for related matter 2023A-13342-CHC-ROC was issued to the Registrar on July 12, 2024. The Registrar’s Final Administrative Decision and Order affirming the Recommended ALJ Decision was consequently issued on August 07, 2024, and became effective September 16, 2024.

The terms of Respondent’s underlying construction contract with Complainant, particularly regarding Alternative Dispute Resolution, are unrelated to regulatory authority and jurisdiction the Registrar has over its licensees, including Respondent.

As such, the above-captioned matter remains within the Registrar’s jurisdiction and is properly set for adjudication before the Office of Administrative Hearings.

Notably, the Attorney General serves as counsel on behalf of the Registrar in this matter, and does not serve to assist either party.
