ORDER VACATING

HEARING

On January 16, 2024, Big Kahuna Construction Corp (“Respondent”) filed a Motion to Vacate with the Office of Administrative Hearings in which Respondent advised that the parties have reached a settlement of all outstanding issues in this matter and the hearing currently scheduled for February 13, 2024, is not necessary. Respondent attached to its Motion an endorsed check that was written to Sevilla Electric, LLC (“Complainant”), and a signed settlement agreement.

On January 16, 2024, the Office of Administrative Hearings emailed Complainant to request a response to Respondent’s Motion. A response was not received.

On January 18, 2024, the Office of Administrative Hearings emailed Complainant to advise that Complainant had a deadline of 5:00 p.m. on January 22, 2024, to file a response to Respondent’s Motion, and was informed that if it failed to do so, the hearing would be vacated. Notwithstanding those requests to Complainant for a written response to Respondent’s Motion to Vacate, Complainant has failed to file a response.

Sufficient cause appearing,

IT IS HEREBY ORDERED that the hearing in this matter is vacated from the calendar of the Office of Administrative Hearings.

IT IS FURTHER ORDERED remanding this matter to the Arizona Registrar of Contractors for further action.
