MINUTE ENTRY - GRANTING CONTINUANCE
Complainant Banker Insulation Inc has filed a motion to vacate the hearing because the parties have agreed to resolve the matter through a payment plan. According to Complainant, the final payment will be due on April 1, 2024. Complainant has also requested permission to refile in the event of default. The Office of Administrative Hearings does not have jurisdiction over the payment plan between the parties, nor the filing of the complaint. Therefore, Complainant’s request is considered a request to continue the hearing date, but to set the matter for a status update only. Accordingly,
IT IS ORDERED that the hearing in the above entitled matter is continued, but no hearing date is set;
IT IS FURTHER ORDERED that on or before April 15, 2024, the parties are advised to do one of the following:
(1) Notify the tribunal that the matter has been satisfactorily resolved by submitting a Motion to Vacate the hearing;
(2) Notify the tribunal that the parties need additional time to resolve the matter by submitting a Motion to Continue and reset for Status by 30-days, 45-days, or 60-days; or
(3) Notify the tribunal that the parties are unable to resolve their dispute and request that the matter be set for hearing.
