HEARING

On December 18, 2023, the Arizona Registrar of Contractors (“Registrar”) issued a Notice of Hearing on Contested Case (“Notice”) setting the above-captioned matter for hearing on January 29, 2024, at 1:00 p.m., at the Office of Administrative Hearings (“OAH”) in Phoenix, Arizona. The Notice provided, in pertinent part, as follows:

Google Meet. A link will be provided directly from The Office of Administrative Hearings. Go to www.azoah.com to request to appear in-person.

If you have requested to appear in-person at the hearing, the hearing will be held at 1740 W Adams Street, Phoenix, AZ 85007.

Correspondence was not returned as undeliverable from either party.

On December 31, 2023, OAH issued a Hearing Order to the parties that contained remote participation information. Correspondence was not returned as undeliverable from either party.

On January 29, 2024, although afforded an approximate fifteen (15) minute grace period, Complainant failed to appear for the hearing. No written request to appear via alternative means or continue the matter was received by or on behalf of Complainant. Thus, Complainant is deemed to have defaulted her appearance.

There is no Settlement Order on file for this case at OAH.

Therefore,

IT IS ORDERED, pursuant to Ariz. Admin. Code R2-19-117, the above-captioned matter is hereby vacated from OAH’s calendar, without prejudice, and is remanded to the referring agency for further action, if any.
