be held at 1740 W Adams Street, Phoenix, AZ 85007.

You must attend this hearing. This is an adversarial hearing before an administrative law judge, and is conducted in a similar manner as judicial proceedings. Thus, you must be prepared to present evidence, including witness testimony and documents, in support of your case.

STATEMENT OF LEGAL AUTHORITY AND JURISDICTION The State of Arizona has determined that the licensing and regulation of construction contractors is a proper state function, and has vested authority in the Registrar of Contractors

to administer Title 32, Chapter 10 of the Arizona Revised Statutes. A.R.S. §§ 32-1101 et seq.

All hearings for alleged violations of Title 32, Chapter 10 are conducted under Title 41,

Chapter 6, Article 10. A.R.S. § 32-1156.

The statutes and rules governing the hearing can be found at: Arizona Revised Statutes §§ 41-1092 to -1092.12, and Arizona Administrative Code R2-19-101 to -122. PARTICULAR ARIZONA STATUTES AND RULES INVOLVED The statutes and rules the Respondent is alleged to have violated are cited in the complaint and citation, which were served on the Respondent on January 5, 2024.

SHORT AND PLAIN STATEMENT OF THE MATTERS ASSERTED The complaint and citation allege that the Respondent committed the following act(s):

THE PARTIES TO THE ADMINISTRATIVE HEARING Because Respondent is a licensee and is charged with an act(s) or omission(s) that is

cause for the suspension or revocation of a license, Respondent is a party to this case and will

be a party to the hearing.

Because Complainant alleged Respondent committed an act(s) or omission(s) that is cause for the suspension or revocation of a license, Complainant is a party to this case and will be a party to the hearing. Respondent and Complainant, as the parties to the hearing, will present evidence and argument to the administrative law judge. The Registrar’s assigned investigator will appear as a witness at the hearing.

RIGHT TO BE REPRESENTED The parties to the administrative hearing may choose to be represented by an attorney. A.R.S. § 41-1092.07(B). If one of the parties is a company, the company may be represented

by an officer or employee if that person satisfies the conditions set forth in A.R.S. § 32-

1156(B).

CHANGE OF ADDRESS Each party must inform the Registrar and the Office of Administrative Hearings of

any change of address within five (5) days of the change. A.R.S. § 41-1092.04.

HEARING PROCEDURES AND RULES The administrative hearing will be conducted in accordance with A.R.S. §§ 41-1092

to -1092.12, and A.A.C. R2-19-101 to -122. The parties should review the statutes, rules, and processes governing the administrative hearing. Copies of the statutes, rules, and articles

REGISTRAR’S APPEARANCE BY VIDEO CONFERENCE OR TELEPHONE

The Registrar’s investigators, employees, and attorneys will appear at the hearing via

video conference or telephone unless requested by a party to appear in-person. Requests for

the Registrar’s investigators, employees, or attorneys to appear in-person must be filed with the Registrar and the Office of Administrative Hearings no later than seven (7) calendar days prior to the hearing date.

HEARING PACKET In the interests of administrative efficiency, the Registrar compiles and discloses certain documents to the parties and the Office of Administrative Hearings. These documents are attached to this Notice of Hearing as the “Hearing Packet.” If any party wishes to submit additional evidence, they must do so during the hearing after completing a disclosure statement. See “Disclosure Statement” section below.

SUBPOENAS FOR TESTIMONY FROM A WITNESS OR DOCUMENTS The parties to the hearing must be prepared to present evidence in support of their case. If a party wants to obtain testimony from a witness or documents not in the party’s possession, the party must prepare and file a written subpoena for the Administrative Law Judge to review and sign, if approved. A.R.S. § 41-1092.07(C). Forms for requesting a subpoena can be found on the Office of Administrative Hearings’ website at www.azoah.com. The party seeking a subpoena must serve notice on all the parties to the hearing, and on the Registrar. A.R.S. § 41-1092.04.

DISCLOSURE STATEMENT At least seven calendar days before the hearing, each party must prepare and serve a

disclosure statement on all other parties, and file it with the Office of Administrative Hearings.

A.A.C. R4-9-118; A.A.C. R2-19-108. The disclosure statement must include any exhibit the

party will use at the hearing. A party’s failure to timely disclose any witness or exhibit, without good cause, may result in the administrative law judge excluding those witnesses or exhibits from being used at the hearing. CHANGING THE HEARING DATE The date of the hearing may only be advanced or delayed on the agreement of the

parties or on a showing of good cause. A.R.S. § 41-1092.05(C). The date of the hearing may

be changed by filing a written agreement of the parties to change the date of the hearing. The

written agreement must be filed with the Office of Administrative Hearings, directed to the

assigned Administrative Law Judge, and transmitted to the Registrar and all other parties. The

assigned Administrative Law Judge may be found on the Office of Administrative Hearings’ web portal at www.azoah.com If a party would like to move the date of the hearing without agreement of all parties, the party must file a written motion with the Office of Administrative Hearings, directed to the assigned Administrative Law Judge, and transmit a copy to the Registrar and all other parties.

The motion must state in detail good cause for why the date of the hearing should be advanced or delayed, and the position of all other parties regarding the advancement or delay. A party may also file a motion asserting a right to an expedited hearing upon a showing of extraordinary circumstances or the possibility of irreparable harm. A.R.S. § 41-1092.05(E).

RESOLUTION SHORT OF ADJUDICATION In any case which is resolved or settled by the parties, or which is withdrawn by the Complainant without objection from Respondent after the Notice of Hearing is issued, the parties must notify the Office of Administrative Hearings of the resolution or settlement. Jobsite Inspection Notice Re: Complaint Number 2023-10371

Dear Complainant and Respondent:

A formal complaint has been filed with the Arizona Registrar of Contractors.

A jobsite inspection is scheduled for October 24, 2023 at 11:30 AM. The Complainant is required to be present. The Respondent’s attendance is requested and encouraged. The Registrar encourages both parties to make a good faith effort to resolve this complaint prior to the jobsite inspection.

COMPLAINANT: 1. Under A.R.S. § 32-1155(D)(1), the Respondent must be allowed, upon request, the opportunity to inspect the work complained of within fifteen (15) days of receiving this notice. If Respondent is not provided an opportunity to inspect the work within the fifteen (15) day time period, the Registrar may be prohibited from taking further action on this complaint. 2. The Registrar may also be precluded from taking further action on this complaint, if the work that is the subject of the complaint is subject to neglect, modification, or abnormal use. A.R.S. § 32-1155(D)(2) 3. You must provide safe access to any area to be inspected. If access to a roof or other elevated area is required, you must provide a means to safely access the area (ladder or manlift as appropriate). Additionally, please secure any animals.

RESPONDENT: 1. Enclosed is a copy of the complaint. Under A.R.S. § 32-1155(D) you must be allowed, upon request, the opportunity to inspect the work complained of within fifteen days of the date of receipt of this notice. 2. To assist the assigned investigator in evaluating the merits of the complaint, please submit a response to the enclosed complaint to the assigned investigator prior to the scheduled inspection. 3. If you do not attend the jobsite inspection, your absence may negatively impact the investigation, and your interests. 4. If a building permit(s) was required for this project, please have the building permit information available at the jobsite inspection.

Purpose of the Jobsite Inspection When the Registrar receives a complaint against a contractor’s license alleging poor workmanship, the Registrar generally schedules a Jobsite Inspection. The Jobsite Inspection serves two purposes: 1. To give the contractor an opportunity to inspect the complaint items; and 2. To give the Registrar an opportunity to determine if the contractor’s work violates Arizona law.

Jobsite Inspection Rights and Responsibilities Access to inspect: The property owner has complete control over who they allow on the property. However, if the Registrar’s investigator or the contractor cannot inspect the work, the Registrar will not move forward with a citation.

Cooperation: Arizona law enables injured parties to seek relief for damages through several paths. When dealing with a licensed contractor, the Registrar of Contractors’ administrative complaint process may serve as one of those possible paths. However, in order to use that path, the Registrar relies on the cooperation of all parties to a complaint.

Minimum workmanship: The Registrar investigates workmanship complaints for compliance with minimum workmanship and professional industry standards. The Registrar does not issue citations for work that meets these standards.

Scope: The scope of the Jobsite Inspection is limited to items listed in the complaint filed with the Registrar’s office. It is the complainant’s responsibility to point out the complaint item(s) and the Investigators role to review the item(s). If the complainant identifies additional workmanship items not listed in the original complaint, they must file an addendum to the complaint. The Registrar’s Investigator may identify additional administrative violations by the contractor (e.g. work performed out of scope of the license and failure to provide a contract that meets requirements set by Arizona law) at the time of the inspection.

The Role of the Investigator At the Jobsite Inspection, the Registrar’s investigator will: ● Only investigate the items listed on the complaint form filed with the Registrar. ● Will gather evidence to make an informed decision about the complaint items.

What to expect after a Jobsite Inspection After doing a Jobsite Inspection, the Registrar’s Investigator will leave the jobsite and review the evidence provided during the inspection. Generally, the investigator does not make any determination at the time of the jobsite inspection regarding whether the allegations listed in the complaint are supported. ● If the allegations are confirmed, the Registrar’s Investigator may issue a Written Directive telling the contractor to correct the poor or incomplete work. ● If the allegations are not confirmed, the Registrar’s Investigator will close the complaint.

Written Directives Access: In order to use the administrative process offered by the Registrar, a property owner must provide reasonable access to allow the contractor to fix their work as directed by the Registrar in a Written Directive. Complainants may not put any additional, unnecessary restrictions on the Respondent above and beyond the initial contract requirements agreed upon at the beginning of the project. Respondents are required to make repairs on items identified on any Written Directive, not otherwise restricted by local code or HOA limitations. Complainants must make access available to the Respondent to make the required repairs and failure to provide reasonable access may result in the Registrar dismissing the complaint.

Contractor obligations: The Written Directive will set a deadline for compliance. This is the period of time determined by the Investigator as necessary to complete the items listed in the Directive. ● The deadline for compliance assumes the contractor will promptly begin working on the items listed in the Directive. ● Do not wait. Both parties should communicate quickly to schedule the work.

Extensions: If good cause exists to extend this deadline, either party may submit a written request to the Investigator. The Registrar will review requests for extension and determine if the Directive should be extended.

Manner and method of performance: The Registrar does not provide specific instructions for how to correct poor work. A licensed contractor is expected to have the skill and professionalism to complete the work. Moreover, the complainant may not dictate the manner of repair. If the contractor fails to appropriately correct the work according to the contract, the Registrar will issue a citation.

Compliance Inspection: After the Written Directive expires, the Registrar’s Investigator will contact the complainant to determine if the contractor performed any corrective work. ● If the contractor did corrective work, the Investigator may schedule a Compliance Inspection to determine if the poor work is corrected. ● If the contractor did not perform any corrective work, the Registrar’s Investigator will not do a Compliance Inspection and will determine whether to issue a citation based on the administrative record.

The Registrar encourages parties to work cooperatively, but cannot require a homeowner to continue to allow a contractor access to the property after the Directive period ends in order for the administrative process to continue. Denying access after the Directive ends is not grounds to close or dismiss a complaint.

During this jobsite investigation I observed wood floor planks throughout with what appears to be repairs filled with an unknown material and a glossy sealant. Compliant Item 2: upon initial walk through a glue/sticky substance was observed - I was told that they would have it cleaned. McDade has made 4 attempts to remove this material. and some planks seem to not only have a sticky residue, but a stain from long exposure of the unidentified material on the planks (11 planks in the master bedroom, 4 in the master hallway, 35 throughout kitchen, 11 living room/dining room, 7 at entry way/bathroom, and 6 along Landry room hallway= 74 planks total); Investigator’s Observation: Verified. At this jobsite investigation I observed glued down engineered hardwood floor planks with a matte finish installed throughout the living area of the home. See P (4) thru P (33). During this jobsite investigation the respondent acknowledged making multiple attempts to clean the adhesive/sticky substance and stated that if the adhesive is not completely removed it will continue to attract dirt. Both parties agree the move in date as being October 2021. The respondent also stated that because the engineered hardwood floor planks are of a matte finish stains will likely be more prevalent. I am unable to verify if the stains observed are the result of prolonged exposure of the unidentified material on the wood floor planks. I am able to verify that the glue/sticky substance rubs off the wood floor surface using my fingernail. The respondent shall correct the glue/sticky substance observed on the wood floor surface by appropriate means. Compliant Item 3: at sliding door planks do not meet the edge/door and have/are missing a filler to accommodate for the gap ; Investigator’s Observation: Verified. At this jobsite investigation I observed glued down engineered hardwood floor planks with a matte finish installed throughout the living area of the home. See P (4) thru P (33). At the sliding glass door I observed a gap between the wood flooring and the sliding glass door frame. The respondent acknowledged that portions of the gap are filled with caulking while other areas along the door frame have no caulking to seal the gap. The sealant applied at the gap is not uniform. See P (25) thru P (27). It is this investigators opinion that gaps at exterior doors should be sealed to prevent moisture from penetrating under the wood floor planks. The respondent shall correct the missing filler to accommodate the gap at the sliding glass door by appropriate means. Investigator’s Observation: Verified. At this jobsite investigation the complainant showed me wood floor planks that were previously replaced that have lippage that exceeds 1/32”. See P (21, P (22), P (28). There were also areas where the lippage does not exceed 1/32”. See P (31) and P (32). During this jobsite investigation in the primary bedroom/bathroom I observed wood floor planks adjacent to the tiled area with lippage that exceeds 1/32”. See P (8) and P (9). The respondent shall correct the wood floor planks with lippage that exceeds 1/32” at the kitchen, entry, and hallway as well as at the primary bedroom/bathroom wood plank to floor tile transition by appropriate means. Investigator Notes: 1: There are approximately 8 wood floor planks in the common living area and primary bedroom to bathroom tile transition with lippage that exceeds 1/32”. 2: There are approximately 12 wood floor planks with chips and dents. Some of the wood floor planks replaced by the respondent created gaps with crooked end joints to adjacent planks that are not uniform and the gaps are excessive.

Compliance Findings:

Compliant Item 1: Trade damage throughout home (chips, broken boards) were attempted to be fixed but failed to provide adequate solution. They were filled with a maternal and then covered with glossy sealant - a juxtaposition to the matte texture of the wood planks (5 planks in mater bedroom, 1 in master hallway, 6 at kitchen, 2 in the living room/dining room, 7 in the entry/hallway, and 4 in the hallway to the laundry room = Investigator’s Observation: The respondent made an attempt to comply with the directive by replacing some of the wood floor planks with chips. By doing so caused additional damage including dents and chips and excessive wide gaps to adjacent planks. The filler used to repair minor damages is a close color match. Some of the glossy sealant remains present. Governing Rule: The respondent is not in compliance with the directive.

The written directive shall set forth the time within which the contractor is to complete the remedial action. The time permitted for compliance shall not be less than fifteen days from the date of issuance of the directive. A license shall not be revoked or suspended nor shall any other penalty be imposed for a violation of this paragraph until after a hearing has been held. A building permit was obtained by N/A List and briefly describe each complaint item (Please do not write "see attached" or use additional pages unless necessary to further describe issues or list more complaint items) (limited to 100 characters per line)

Trade damage throughout home (chips, broken boards) were attempted to be fixed but failed to provide adequate solution. They were filled with a maternal and then covered with glossy sealant - a juxtaposition to the matte texture of the wood planks (5 planks in mater bedroom, 1 in master hallway, 6 at kitchen, 2 in the living room/dining room, 7 in the entry/hallway, and 4 in the hallway to the laundry room = 25 planks total). I was told it could be removed and that has since been proven false. ; upon initial walk through a glue/sticky substance was observed - I was told that they would have it cleaned. McDade has made 4 attempts to remove this material. and some planks seem to not only have a sticky residue, but a stain from long exposure of the unidentified material on the planks (11 planks in the master bedroom, 4 in the master hallway, 35 throughout kitchen, 11 living room/dining room, 7 at entry way/bathroom, and 6 along Landry room hallway = 74 planks total) ; at sliding door planks do not meet the edge/door and have/are missing a filler to accommodate for the gap ; another attempted solution to trade damage was removing planks. there are 3 that are significantly lifting as a result of the work done and negligence in providing post care instructions. Mcdade has has been at my house 18 times over the last 2 years regarding the complaint items and has failed to provide adequate solutions.

CONSUMER AWARENESS FOR CERAMICDLE Ceramic tile is available in various sizes, textures and colors and due to irregularities in size, grout joints may vary in size. Any unevenness in a subfloor may cause a less than perfect ceramic tile installation and the larger the tile, the more difficult a perfect installation becomes. Any tile larger than 1.3" x1.3" tends to be uneven and therefore an edge may be visible or may befelt some while walking on thefloor. The edges on a "Red Bisque" tile may be visible as they are not glazed. This especially can occur in tiles larger than 13" x 13".

PLANKED TILE When selecting a planked tile, we must deal with the visual aspect. The smaller width of the plank, the more visual the grout joints will be. Depending upon the time of day, you could see "shadowing" across the grout joints. Some people find this unacceptable. This is a result of several variables - tile selection, lighting, and layout. We are not prepared to assure you this will not happen in your home; this is a choice you must make. Plank Tiles are meant to replicate a wood floor look, therefore will have degrees of roughness and sheen. Sometimes the finish is uneven, meaning you will see areas with little or no sheen, and other areas with a higher sheen level. This is not a manufacturing defect, but a characteristic of the tile. Also, the heavier the surface texture, or more "matte" the finish, the more cleaning may be necessary. Both items cause dirt and fur to adhere more than a high sheen finish. It's the difference between cleaning a stucco finish and a glass window.

IHAVE INSPECTED THE FLOOR INSTALLATION IN THE J.R.McDADE SHOWROOM AND ACCEPT THE POSSIBLE UNEVENESS OF THE TILE INSTALLATION

Trim pieces for ceramic and porcelain tiles used in countertop and wall applications will vary from the field texture. shape and pattern. since they are produced at different times. Ceramic tile can scratch and chip. Chipping can occur when sharp or heavy objects are dropped on ceramic tile. All handmade tile will have variations in color and molding body including uneven edges, slight variations in size, and some warping in the moldings. Some Handcrafted tiles will have black dots that are produced in the glazing process. These are inherent in the tile and not considered a defect. Crazing is also inherent and does not affect the tile performance in any way.

GROUT J. R. McDADE CO. LLC does seal grout as an option and is not included in the price. Grout may not be sealed for 10-21 days per the manufacturer's instructions. Grout sealed prior to drying completely may discolor or "powder". We recommend use of our professional sealing company. The use of a dark grout with a light tile may result in the grout adhering to imperfections in the tile. This situation is not evident when you inspect the tile sample in showroom. Due to the manufacturing process, the tile which is installed in your home may contain imperfections than the sample you are shown, and the grout may affect the appearance of the tile. We recommend you utilize a grout which will blend with the tile.

Grout colors will vary from the samples due to variations in temperature and humidity at the time of grouting. Grout is subject to some shading or variation in color throughout the installation because it is a cement-based product and must go through a curing process. Small hairline cracks may develop in your grout due to seasonal changes, normal settling of your house. There is no way to eliminate hairline cracks and, since it is not structurally significant, are not considered an installation defect. Grout cracking is a maintenance issue and can be repaired with extra grout or sanded caulking that matches the grout. Due to shifting and settling of new homes, the grout between the backsplash and the countertop deck is susceptible to cracking. Installers will caulk the joint at the initial installation. Exact layouts are determined by the tile setter at the time of installation and are governed by the actual size and shape of the tile, the exact dimensions of the areas to be covered, and guidelines established by the builder. Locations of grout joints may vary from job to job based on individual layouts, and the size and shape of the tile. The installer will try to minimize cuts by adjusting the joint size, if possible. We CANNOT lay tile without grout. _

GROUT JOINTS All tile grout joints can vary. We set as standard 3/16" joints but due to tile sizes and layouts, jobsite concrete subfloors, grout joints can and will vary. Below are examples of what we will need to do to meet our allowances of install.

CONTROL JOINTS There are control joints in concrete floors which may cause ceramic tile & grout to crack. Non-standard areas usually contain these control joints and if you choose to put ceramic tile flooring products over a control joint, you may experience cracking which is not warranted by the Builder or J.R. McDade Co. LLC.

DISPLAY SAMPLES Samples are a representation of color, texture, shading, graining, and finish of the tile to be delivered, but do not imply or guarantee an exact match. Samples you have ordered (when selecting fabrics, paint, etc...) should not be used as an exact representation of the material that will later be installed. Hand sorting and selecting of material is not allowed.

DYE LOTS Ceramic Tile and grout colors may vary slightly from dye lot to dye lot and the actual flooring when Installed may, therefore, vary from the sample.

TILE SHADE VARIATION Tile comes in countless colors, textures shades and variations. With any fired product you will get different variations in the finished product and variations within every production run as well. The variation rating system indicates the level at which a tile's color, tone and texture will vary from one piece to the next.

Vl = Uniform Appearance: Differences among the pieces from the same production run are minimal.

V2 = Clearly distinguishable texture and/or pattern with similar colors.

V3 = While colors present on a single piece of the tile will be indicative of the colors to be expected on the other tiles, the amount of colors on each piece may vary significantly.

V4 = Random color differences from tile to tile, so that one tile may have totally different colors from that of the other tiles. Thus, final installation will be unique.

lffMGDADE TILE CARE

Routine care Contaminants and spills on a glazed ceramic tile are, generally, easier to clean then other, more impervious surfaces. Glazed tile products should be cleaned routinely with an all-purpose, non-oil-based household or commercial cleaner. The product should also be grout joint cleaning compatible. The type of production may vary depending on the tile application and use. A multipurpose, spray cleaner, which removes soap scum, hard water deposits and mildew designed for everyday use, can be used on wall tile areas in residential baths and showers.

The entire area should be cleaned and scrubbed with cleaner solution using a cotton mop, cloth, sponge or non-metallic brush. The entire area should be rinsed with clean water to remove any cleaning solution residue. Remember that you should sweep or vacuum floor areas prior to cleaning to remove any dust or debris. Routine cleaners should never contain acids or ammonia. Acids can damage the grout and the glazed surface of the tile and ammonia can discolor the grout.

Glass Tile For routine cleaning, use any non-abrasive cleaning compound recommended for either glass or tile.

Metal Tile Use a non-abrasive household cleaner. Do not use scouring pads, steel wool, sandpaper or other abrasive products. Avoid cleaners containing ammonia or bleach.

Always test in a small, inconspicuous area while using a new cleaner to ensure compatibility.

Grout care Grout is the material used to fill the spaces between the individual tiles. Most tile installations use cementitious grouts. This type of grout could be sealed after installation to prevent the color from staining. Only the grout should be sealed, not the tile itself. Sealing the grout will not prevent surface build-up or discoloration of the grout. Grout needs to be cleaned on a periodic basis to remove any surface build-up. Routine grout cleaning can be done with a daily concentrated household cleaner depending on the application. When heavy duty grout cleaning is required, you will need to use a professional strength Tile and Grout Cleaner that can remove grease, soap scum, body oil, mildew stains, algae and synthetic or acrylic waxes from the grout joints. This type of product can be purchased from most Home Centers.

When grout has been stained to the point that it cannot be maintained or returned to its natural color, you can return the grout back to its original color or any other color through the use of #grout stain". These stains are epoxy-based products that are specifically designed to penetrate the grout and seal the surface with a permanent color. Once the grout has been stained there is no need to seal it any further with any penetrating/impregnating sealers. Prior to staining, the grout joint should be cleaned thoroughly to remove any dirt, oils, grease or sealers with a professional strength Tile and Grout Cleaner.

CARPET Seams and foot printing show in almost all carpets. Seams are most likely to be visible in new carpet installed in homes without window coverings or furnishings, especially in areas with the greatest amount of light. Seam visibility usually decreases with time and with the reduction of light exposure once window coverings are installed and furniture is placed. Seams are especially visible in Berber and loop type carpets due to the nature and texture of the carpeting itself. We cannot guarantee invisible seams, we guarantee high quality workmanship. Crushing and matting are prevalent to some extent in all carpeting and is usually caused by heaVY, concentrated foot traffic. This is not considered a manufacturing defect and can be generally eliminated by keeping your carpet free of dirt and grit and by vacuuming with proper equipment at least 4 to 5 times weekly in most heaVY traffic areas. Berber or loop type carpets have a continuous yarn type construction. If something hooks on a loop and pulls it loose, the carpet will unravel easily if the loose loop is not clipped or secured immediately.

12FT & 15 FT BERBER AND/OR CUT PILE CARPETS Some Berber and/or Cut Pile carpeting is available in both 12 ft and 15 ft widths. We will install 15 ft width Berber and/or cut pile carpeting if the carpeting is available in 15 ft width AND can be delivered to meet the installation date, otherwise 12 ft Berber and/or cut pile carpeting will be ordered and installed.

STAINS No flooring is totally staining proof. Stain products are warranted by the fiber producers, not the builder, J. R. McDade Co. LLC or the carpet manufacturer. Hardwood flooring is a natural product and is subject to several concerns. There may be color variations in the wood product. Due to climate conditions in the area, the flooring product may "dry out" causing squeaks, cracks, and shrinkage. Wood flooring is susceptible to discoloration and warping caused from liquid settlement or spillage. Moisture may also hydrate through a concrete floor causing discoloration or warping. Scratches and dents can occur. Special attention should be given to the care and maintenance of a hardwood floor. We recommend that you follow the manufacturer's specifications. "Whitewash" floors require critical attention to maintenance because wear patterns become obvious. With exposure to light and oxygen, wood colors can and will change over time. This is considered normal and not a defect. Selecting window coverings immediately can help to prevent this. Areas of wood that are covered with area rugs and/or furniture will age differently than those areas which are exposed.

ACCLIMATION TIME Acclimation is required for hardwoods. This means the wood will be delivered to the jobsite to allow acclimation per the manufacturer's requirements. At that time, the wood becomes the property of the contracted party and they are liable for any damage or loss. HVAC must be on the entire time the wood is acclimating and kept to a temperature range specified by manufacturer.

STANDARD INSTALLATION The standard installation has quarter-round trim abutting existing baseboard and cabinets. If the surface condition of the concrete has minor irregularities, these may affect the levelness of the wood surface. There are industry tolerances regarding the acceptability of these irregularities.

DYELQJS Hardwood flooring colors may vary slightly from dye lot to dye lot. Because each piece is different in terms of grain, it is impossible to achieve a completely flat surface. Despite the term 'hardwood', this flooring will indent. The finish that is applied will not prevent the dents. Medium to high gloss finishes will accentuate the appearance of dents, scratches, swirl marks from buffing, and everyday wear and tear. General maintenance for your hardwood floors includes regular vacuuming, sweeping, and buffing as needed. Hardwood floors should be cleaned using recommendations and products specified by the manufacturer. Dry and/or wet mopping is not recommended. Dirt

These countertops are extremely hard and durable, virtually non-porous and stain and crack RESISTANT. You do not have to seal, cleans relatively easily (depends on product purchased) and comes in a wide range of colors and patterns. There are also some factors which you need to be aware of when purchasing this product.

Honed/Suede Rnishes: These surfaces usually require more daily care to maintain their appearance. So please be aware marks may be left from items on the countertop and elbow grease with a soft scrub cleanser may be required to remove those marks. Not Immune to Damage: Quartz is a hard material but is not immune to chipping. They'll take the everyday normal use but they're not indestructible and can chip and crack if hit hard enough.

Not Heat Tolerant: Do not put hot pots or pans down on your countertop. Heat will change the chemically composition of the surface and product white spots or #waves". You'll need to use trivets or hot pads to protect the surface.

Not Seamless: the size of the slabs determines the layout for each area, so you may see a seam in a location where the countertop turns or if the length is longer than the slab.

Sensitive to some Household products: they can be damaged from exposure to chemicals that have a high or low pH, like heavy duty cleaners, bleach and others. The manufacturer's care and maintenance instructions should spell out what to watch out for. Not Scratch Proof: Aside from diamonds, quartz is the hardest material around. But that doesn't mean your countertop will NEVER scratch under any circumstances. Remember, it's made up of a small percentage of resin material that binds the quartz crystals together. tt·s a good habit to keep a cutting board handy to cut on.

Change in Color: The resins that are included in the slab may break down in UV light over time, so your quartz may change color. On average it takes less than a year of daily sunlight for the quartz countertop to change color. Window coverings on glass that will expose the countertop to UV light will provide some protection in keeping the color true.

Streaking on Surface: Streaks are normally caused from soap residue or other cleaning products. If you use just water and a soft cloth, they should disappear. If they persist, please reference your #care and maintenance" instructions or contact the manufacturer for further instructions.

its Answer to the Citation dated January 5, 2024, and Written Complaint as follows:

Answering Charge 1, JR McDade denies Charge 1, and asserts that it performed all

work in the Claimant’s home in a professional and workmanlike manner pursuant to ARS

§32-1154(A)(3) and R4-9-108(a).

Answering Charge 2, JR McDade denies Charge 2, and assert that it took the

appropriate corrective action to comply with the rules within a reasonable time after

receiving a written directive from the Registrar pursuant to ARS §32-1154(A)(22).

JR McDade further denies the allegations in the Written Complaint.

JR McDade’s Answer to the citation and Written Complaint is supported by the

following timeline and facts::

JR McDade provided the wood flooring installed in Complaint’s home. JR McDade

contracted with Micmar to install the wood flooring.

On September 8, 2021, KHOV, the general contractor for Complainant’s home, signed an “Acclimation Waiver” releasing Micmar from any liability as the result of KHOV’s request to have the flooring in Complainant’s home installed without proper acclimation. On November 11, 2021, JR McDade first received a Work Order from KHOV, requesting an inspection of Complainant’s home for the following items: • Kitchen – floor has thick residue; • Living Room – not level flooring by island; and • Master BR & Bathroom- floor has thick residue. On November 29, 2011, Tony Wilk of JR McDade, completed the inspection and noted: • h/o concerned floor by island out of level – only 1/8”out – no action • h/o concerned there is gapping in wood and wants all joints filled- wood was installed with no acclimation per KHOV request – no action • h/o concerned about gaps under base – all areas within 1/8” – no action • h/o could not find any residue to show Tony – no action • several divots in floor – h/o request fill • one board in entry has lippage – h/o request fix – level fix if possible. o No wood on site On January 27, 2022, JR McDade received a Work order to complete the work evaluated. On February 7, 2022, the scope of work was confirmed with Micmar, the flooring installer, and a purchase order was sent to KHOV. On February 17, 2022, Micmar did not appear as scheduled. On March 21, 2022, KHOV requested a third-party inspection in lieu of proceeding with the repairs. On April 18, 2022, the third-party inspector, Priority One, inspected the Complainant’s floors and concluded: • The dark spots of sticky material is cleanable if done with care. • The small hollow spots, without any vertical movement, are not considered a defect, but are a normal condition resulting from the adhesive shrinkage as it sets and hydrates.

• The large hollow spots, with vertical movement, are an installation related issue needing correction. The industry practice to correct this issue is by injecting adhesive into the area, re-attaching the planks to the substrate. • Chips and lifted splinters can also be corrected by the proper injection of adhesive and/or the proper application of an acrylic filler to replace the filler used to fill the splits, knots and other voids at the point of manufacture in this rustic style plank. • The joint gaps at this time are within the tolerance for “seasonal gapping.” The accepted correction is to wait for the completion of a full 1-year seasonal cycle and them fill the remaining small gaps with a matching colored filler to replicate natural grain streaks. • Cutting the planks in doorways to create a straight, even transition line is an installation related issue; easily correctable with careful hand trimming, which may also require resetting the tack strip and re-stretching the carpet to achieve a smooth transition. • There were no visible moisture issues at the time of the inspection, but the higher readings toward the uphill side of the lot are worth noting for possible future reference.

On May 17, 2022, JR McDade received a work order from KHOV for 6/2/22

requesting the following repairs: • Wood floors need to be cleaned of all residue and trade damage as well as have materials injected under the planks to stop the hollow effect at pantry and great room. Micmar was unable to complete the repairs on 6/2/22 because the product used to inject under the glue down wood planks was no longer available and it would have to find another product. On June 23, 2022, Micmar informed JR McDade that it had the product needed to make the injections and could schedule the repairs in July. On June 24, 2022, JR McDade received a work order from KHOV for 7/14/22 for the following scope: • Wood floors need to be cleaned of all residue and trade damage as well as have materials injected under the planks to stop the hollow effect at pantry and great room. Wood planks are on site if one or two need replaced. On July 13, 2022, Micmar informed JR McDade that the wrong product was shipped and could not complete the scope requested for 7/14/22.

On July 26, 2022 KHOV request that the work be rescheduled for 7/26/22. Micmar requested 8/13/22 as the next available date. KHOV requested an earlier date of 8/5/22 stating: • “She wants the dented and dinged planks to be removed and replaced and all ugly orange filler that was used by Micmar tech to be removed.” This new request was beyond the previous scope of work known by JR McDade. Up to that point, JR McDade was only aware of the following scope: • Make injections in the large hollow spots at the archway in the middle of the hall at one corner of the kitchen island. • Use of filler/adhesive to correct splits, chips, and other voids. • Trim/even transitions to carpet. May require second trip to adjust tack strip and stretch carpet back in. KHOV did not respond to JR McDade’s request to clarify the scope of work. On September 30, 2022, JR McDade received a work order for 10/12/22 requesting the following repairs. • Wood floors need to be cleaned of all residue and trade damage as well as have materials injected under the planks to stop the hollow effect at pantry and great room. Micmar did not appear for work on 10/12/22. On December 6, 2022, JR McDade received a work order for 12/13/22 for the following repairs: • Large hollow spots located at the archway in the middle of the hall and at one corner of the kitchen island need to be injected with adhesive.

• correct cuts at doorways to create a straight even transition line. • KHOV last minute add on: 1. 12 planks total: either still have residue on them that was not cleaned back in June or have some filler that is coming out. 2. Work was not finished by JRM subcontractor, Micmar The work was rescheduled and completed on 1/20/23 with additions requested by KHOV: • The sticky residue can be cleaned off as PO work as this is not wood glue and was tracked onto the floor after installation.

• No action required on the smaller hollow spots, as they are not considered to be defects in a glue down installation. • The large hollow spots referred to in the above report are located at the archway in the middle of the hall and at one corner of the kitchen island. • These hollow spots span several planks and can be corrected through injecting adhesive into these areas. This would be covered under KHOV’s warranty with JR McDade. • No action is required on filling the chips and splinters since this is a rustic style wood plank, but KHOV has the option of completing this as PO work. • While there is some gapping in between planks, it is “seasonal” and within tolerance. Gapping can be revaluated after a year if it is still a concern. • Cuts will need to be corrected- this would be covered under KHOV’s warranty with JRM. On February 9, 2023, JR McDade received a work order from KHOV requesting an inspection for 2/22/23. • Wood floors damage to 12 planks inspection to replace. • There is lifting and chipping in multiple locations repairs that were previously done, or bad repairs, wood filler does not match the same color as floors.

On February 10, 2023, KHOV requested that the work be rescheduled. On March 24, 2023, JR McDade received a work order from KHOV requesting the following repairs: • R&R 26 wood plank throughout that have been inspected and marked for replacement. Fill areas in wood floor that was marked. Need to bring the correct color for wood filler. On March 30, 2023, JR McDade and KHOV inspected the Complainant’s home.

The Complainant was requesting additional work. Twenty – nine planks in total were

marked for replacement. Of the 29, four were due to trade abuse and 25 were due to installation issues.

On March 31, 2023, JR McDade received a work order from KHOV that was different from the discussions on March 30, 2023: • R&F 26 wood planks throughout that have been inspected and marked for replacement. Fill areas in wood floor that was marked. Need to bring correct color for wood filler.

On April 3, 2023, the repairs were completed by Micmar. KHOV stated there were outstanding items. On April 11, 2023, JR McDade received a work order from KHOV for 4/18/23 for repairs of outstanding items: • Wood floors- replacement R&R 8 planks, 2 under warranty 6 for PO. Please schedule Eli to meet with homeowner service manager when techs arrive to complete final replacement. On April 18, 2023, the repairs were completed by Pima. On April 24, 2023, JR McDade received a work order for 5/24/23 for repairs: • Wood plank that was just replaced is lifting in the corner by pantry. Shiny residue that was used for repairs needs to be cleaned off. On April 25, 2023, JR McDade sent a bill to KHOV for payment for completed

repairs. Payment discussions ensued.

On June 1, 2023, a payout of $1,125.00 was offered to Complainant. JR McDade

closed the job while waiting for a response.

On July 31, 2023, KHOV notified JR McDade that the Complainant was requesting a

new inspection for 8/14/23. Discussions ensued and KHOV and JR McDade agreed that

JR McDade would request a BCP ROC inspection.

On August 21, 2023, the ROC BCP inspection occurred. JR. McDade offered to

complete all recommended repairs and withdrew the payout offer. KHOV did not respond

to JR McDade’s offer.

On September 13, 2023, JR McDade receives notice that Complainant filed a formal

Complaint with the ROC and a second inspection would occur on 10/26/23.

On October 26, 2023, the ROC inspection occurred.

On November 7, 2023, JR McDade received a directive from the ROC.

On November 15, 2023, KHOV informs JR McDade that the Complainant was only

available on 11/21/23 for an inspection due to the Thanksgiving holiday.

On November 17, 2023, JR McDade informs KHOV that 3 days are necessary for the repairs, and JR McDade requests an extension of the deadline to 12/11/23. The wood ordered for the repairs is received at JR McDade’s warehouse. On November 27, 2023, JR McDade had not received a work order from KHOV, but proceeds to schedule the repairs to begin on November 28, 2023 through November 20, 2023. The repairs occurred as scheduled. On the first day of repairs, the installers removed glue and residue, touched epoxy marks, and replaced 2-3 pieces of wood in the kitchen. All the wood planks that the Complainant considered defective were to be replaced, however, the Complainant would not approve the shade match and sizing for other planks. The Complainant stated that she was happy with the cleaning and with the 2 or 3 pieces replaced in the kitchen. On the second day of repairs, 8 boxes of wood planks were on site. The Complainant wanted to pick out the planks and only approved 15 boards. Matt Duncan, JR McDade’s representative, was on site for 4 hours during this process of picking the wood planks approved by the Complainant. The Complainant would not move the bedroom set and decided that no wood planks would be replaced in the master bedroom. Every piece of wood was laid out so that the Complainant could make sure the shades and sizes would match the existing wood. The wood was cleaned up and put back in the master bedroom. No additional pieces of wood were pointed out by the Complainant. Matt Duncan noticed some epoxy on some of the wood pieces and asked the Complainant if she wanted them replaced, and she said no. Matt cleaned the wood and left the home around 2:00 p.m. The Complainant sated she was satisfied with the cleaning. On the third day of repairs, 15 pieces of wood planks were installed in the entryway- kitchen-dining room-entry to bathroom. Additionally 4-5 more pieces of wood planks that broke during the demolition and re-installation process were also replaced. On November 30, 2023, JR McDade received a work order from KHOV for 12/18/23 repairs:

• ROC Wood flooring replacement and repair throughout home. Per the ROC corrective action. Need to finish remaining plank replacement and cleaning up floor. On December 4, 2023, JR McDade notified the ROC inspector that most of the repairs were complete, but the Complainant was leaving town and would not return until after the 12/11/23 deadline. JR McDade also informed the ROC inspector that follow up repairs were scheduled for 12/18/23. The ROC inspector confirmed that JR McDade had until 12/27/23 to complete any necessary repairs.
