602.542.1525 · Toll Free 877.692.9762 · roc.az.gov C008 05/21 A Guide to Jobsite Inspections

Purpose of the Jobsite Inspection When the Registrar receives a complaint against a contractor’s license alleging poor workmanship, the Registrar generally schedules a Jobsite Inspection. The Jobsite Inspection serves two purposes: 1. To give the contractor an opportunity to inspect the complaint items; and 2. To give the Registrar an opportunity to determine if the contractor’s work violates Arizona law.

Jobsite Inspection Rights and Responsibilities Access to inspect: The property owner has complete control over who they allow on the property. However, if the Registrar’s investigator or the contractor cannot inspect the work, the Registrar will not move forward with a citation.

Cooperation: Arizona law enables injured parties to seek relief for damages through several paths. When dealing with a licensed contractor, the Registrar of Contractors’ administrative complaint process may serve as one of those possible paths. However, in order to use that path, the Registrar relies on the cooperation of all parties to a complaint.

Minimum workmanship: The Registrar investigates workmanship complaints for compliance with minimum workmanship and professional industry standards. The Registrar does not issue citations for work that meets these standards.

Scope: The scope of the Jobsite Inspection is limited to items listed in the complaint filed with the Registrar’s office. It is the complainant’s responsibility to point out the complaint item(s) and the Investigators role to review the item(s). If the complainant identifies additional workmanship items not listed in the original complaint, they must file an addendum to the complaint. The Registrar’s Investigator may identify additional administrative violations by the contractor (e.g. work performed out of scope of the license and failure to provide a contract that meets requirements set by Arizona law) at the time of the inspection.

The Role of the Investigator At the Jobsite Inspection, the Registrar’s investigator will: ● Only investigate the items listed on the complaint form filed with the Registrar. ● Will gather evidence to make an informed decision about the complaint items.

What to expect after a Jobsite Inspection After doing a Jobsite Inspection, the Registrar’s Investigator will leave the jobsite and review the evidence provided during the inspection. Generally, the investigator does not make any determination at the time of the jobsite inspection regarding whether the allegations listed in the complaint are supported. ● If the allegations are confirmed, the Registrar’s Investigator may issue a Written Directive telling the contractor to correct the poor or incomplete work. ● If the allegations are not confirmed, the Registrar’s Investigator will close the complaint.

Questions? If you have already filed a complaint and it was assigned to an investigator, you are encouraged to contact that investigator directly with the information listed in your jobsite inspection letter. If you have not filed a complaint yet or have not been assigned an investigator, you can reach the Registrar’s compliance department at (877) 692-9762.

The Jobsite Inspection serves two purposes: 1. To give the contractor an opportunity to inspect the complaint items; and 2. To give the Registrar an opportunity to determine if the contractor’s work violates Arizona law.

Written Directives Access: In order to use the administrative process offered by the Registrar, a property owner must provide reasonable access to allow the contractor to fix their work as directed by the Registrar in a Written Directive. Complainants may not put any additional, unnecessary restrictions on the Respondent above and beyond the initial contract requirements agreed upon at the beginning of the project. Respondents are required to make repairs on items identified on any Written Directive, not otherwise restricted by local code or HOA limitations. Complainants must make access available to the Respondent to make the required repairs and failure to provide reasonable access may result in the Registrar dismissing the complaint.

Contractor obligations: The Written Directive will set a deadline for compliance. This is the period of time determined by the Investigator as necessary to complete the items listed in the Directive. ● The deadline for compliance assumes the contractor will promptly begin working on the items listed in the Directive. ● Do not wait. Both parties should communicate quickly to schedule the work.

Extensions: If good cause exists to extend this deadline, either party may submit a written request to the Investigator. The Registrar will review requests for extension and determine if the Directive should be extended.

Manner and method of performance: The Registrar does not provide specific instructions for how to correct poor work. A licensed contractor is expected to have the skill and professionalism to complete the work. Moreover, the complainant may not dictate the manner of repair. If the contractor fails to appropriately correct the work according to the contract, the Registrar will issue a citation.

Compliance Inspection: After the Written Directive expires, the Registrar’s Investigator will contact the complainant to determine if the contractor performed any corrective work. ● If the contractor did corrective work, the Investigator may schedule a Compliance Inspection to determine if the poor work is corrected. ● If the contractor did not perform any corrective work, the Registrar’s Investigator will not do a Compliance Inspection and will determine whether to issue a citation based on the administrative record.

602.542.1525 · Toll Free 877.692.9762 · roc.az.gov C008 05/21 Work performed after the directive ends: After the Directive period ends, a property owner may choose to allow the contractor to continue its work. The Registrar encourages parties to work cooperatively, but cannot require a homeowner to continue to allow a contractor access to the property after the Directive period ends in order for the administrative process to continue. Denying access after the Directive ends is not grounds to close or dismiss a complaint.

Classic Coatings System Etch,Stain & Sealer $8.00 760 $6,080.00 *Metallic Pearl Tone

Prep Surface mechanically as per ICRI-CSP2 profile by diamond grinding to ensure removal of laitance,

curing agents and sealers, existing epoxy coating, contaminants, help with floor unevenness and better adhesion

- Chase concrete cracks and vacuum to fill with 2 part MPC* crack filler

- Moisture Barrier

a biodegradable, non-flammable, and environmentally friendly coating remover that is VOC compliant in all 50 states. Classic Stripper does not contain any methylene chloride, caustics, or toxic chemicals. It does not contain any carcinogens or deplete the ozone like some competitive products on the market. It is highly effective when removing even the most durable industrial coatings. It can be used to remove tough acrylics, paints, lacquer sealers, latex paints, water-based alkyd paints, and oil-based enamels on all types of substrates including concrete, masonry, brick, wood, steel, aluminum, and metal alloys. Classic Stripper is not sticky or messy like soy-based strippers and saves on the cost for labor-intensive mechanical stripping methods. After stripping, clean the surface with (CW305) Classic Eco-Etch Cleaner.

Classic Super Eco-Etch is an Organic Acid replacement technology with Zero VOC, a low ph salt that is used to replace traditional acid. There is no need for neutralizing. 4 to 10 times more effective than citric and glycolic acid and 4 to 5 more effective than phosphoric acid when dissolving calcium carbonate. Classified as a mild skin irritant but non-corrosive to skin,

mild steel & no fumes. Approved by the US EPA as a non-food inert ingredient in bio-degradable applications. For use on pool decks, concrete slabs, stone, brick, and grout joints. It may be used for interior or exterior applications in high-traffic areas in a wide range of climates. Removes oil spots and grease. Excellent cleaner and etcher. Environmentally safe and cleans up with water.

FX2 Stain color

is a single component acrylic polymer blend penetrating water based stain. It provides excellent penetration, UV stability and it won't crack, peel or yellow. It can be applied over cementitious toppings, concrete, masonry, pavers, driveways, and polished concrete surfaces up to 400. FX2 is environmentally safe with no need to neutralize and no fumes or cleanup of hazardous chemicals with VOC and is semi-transparent. FX2 colors reach their full potential within minutes of application and can be built up without the worry of damaging the concrete like an acid stain does. Note that a Classic Sealer must be applied and will make the color more vibrant. For both indoor and outdoor use. We HIGHLY recommend testing a sample area first since results can vary for different surfaces.

Classic High Gloss Armor 2K

Aliphatic-Polyurethane Sealer is a clear, 2 component, VOC < 1g/l 63% solids, waterborne, special blend sealer that is designed to be used over all of our stains, as well as polymer-modified cementitious toppings, masonry, concrete and waterborne colorants. It may be used for exterior & interior. High Gloss Armor 2k provides UV stability and will not yellow. CRU repels water, oil, chemicals, and acid. It is formulated primarily as a clear sealer for durable protection over concrete restoration projects and is low maintenance. It is typically applied with a 9”x1/2” nap roller with 1-hour pot life, provided that the surface is properly prepared. High Gloss Armor 2K is environmentally safe and cleans up with water. Also available in matte or in a satin finish. Color additives are also available in solid colors and metallic colors. Caution: Sealers may be slippery when wet. If desired, add Classic Gator Grip slip resistance during the second application only. New concrete must cure for 28 days before sealer is applied. FOR PROFESSIONAL USE ONLY.

Written Answer to Citation and Complaint Case # 2023-10334

Floor was observed within industry standards. I would like to know what standards you were being based on? I have no Issue with the rest of the list other than the floor. Corrective action has already been taken here and there is no further action to follow there. Clients still have a balance of $4,256 They gave a down payment of $1,824 client states he has paid $3,120.31 which is incorrect The floor was properly prepped and installed. Corrective work was performed on the epoxy floor. The rest of the work was detained by the client initially then we proceeded to a hearing due to a lack of trust from both parties and unable to settle on our own. When I noticed the manner of each of us speaking at the meeting with the ROC investigator I felt this route would definitely be the best scenario for all us.

Here I attached some notes from when we were on site with a dated punch list with the date of 8/28/23 for those items we all talked about.

Other than that, here are some of the standards that also state this type of floors have normal variances. I have done over 200 floors and every single one of them have these characteristics.

1. ASTM Standards: The American Society for Testing and Materials (ASTM) has developed numerous standards for epoxy materials and applications. These standards cover areas such as epoxy resin properties, curing agents, adhesion, and the testing of epoxy materials for specific properties.

2. Surface Preparation: Epoxy coatings, in particular, often require specific surface preparation standards to ensure proper adhesion. Common methods include abrasive blasting, acid etching, and mechanical abrasion to achieve the desired surface profile.

3. Mixing and Application: Standards exist for the proper mixing and application of epoxy products. These standards may specify mixing ratios, application temperatures, and environmental conditions to ensure the epoxy cures correctly.

4. Curing Time and Conditions: Epoxy products need a specified curing time and environmental conditions (temperature, humidity) to achieve their designed properties. Industry standards outline these conditions for various epoxy formulations.

5. Performance Standards: Epoxy coatings and adhesives must meet specific performance standards, such as chemical resistance, impact resistance, abrasion resistance, and adhesion strength. Industry organizations may set these standards to ensure consistent quality.

6. Health and Safety: Standards address health and safety concerns related to epoxy materials, including proper handling, ventilation, and personal protective equipment.

Quality Control and Testing: Quality control and testing standards are used to assess the quality and consistency of epoxy materials. This includes methods for assessing the viscosity, adhesion, and other properties of epoxy products.

Normal Variances: Normal variances in epoxy products refer to slight deviations from ideal or expected characteristics that can o,ccur due to the nature of the materials and the application process. These variances can include:

Color Texture and Surface Adhesion Strength: While Variations: Slight color Finish: The texture Imperfections: Minor epoxy products are variations can occur in or finish of an epoxy surface imperfections designed to provide strong epoxy coatings due to surface can vary such as pinholes, adhesion, slight variations differences in batches slightly depending bubbles, or small in adhesion strength can of raw materials, on application inclusions may be occur due to surface environmental methods and considered normal preparation, curing conditions during environmental variances, especially in conditions, or application curing, or the age of the conditions during large epoxy techniques. epoxy. curing. applications.
