MINUTE ENTRY - GRANTING CONTINUANCE

AND SETTING STATUS DATE

The hearing of this matter was scheduled to convene on February 12, 2024, at 9:00 a.m. On the date and time set for hearing, Complainant Scott Sears appeared with his wife, Diana Sears. Frank Diaz appeared on behalf of Respondent Formula Concrete Coating, LLC. Registrar of Contractors Investigator Gregory Johndrow appeared as a witness. Prior to the commencement of the hearing, the parties informed the Tribunal that they had resolved the matter in dispute with a financial settlement, however, Complainant was still awaiting payment from Respondent’s insurer. Therefore, the parties requested that this matter be set for a Status Update.

Good cause appearing, the hearing in the above-entitled matter is continued and set for a Status Update on February 26, 2024. On or before this date, Complainant is advised to do one of the following:

Inform the Tribunal that the matter has been satisfactorily resolved by submitting a Motion to Vacate the hearing;

Inform the Tribunal that the parties need additional time to resolve the matter by submitting a Motion to Continue and reset for Status by 30-days, 45-days, or 60-days; or

Inform the Tribunal that the parties are unable to resolve their dispute and request that the matter be set for hearing.
