If you have requested to appear in-person at the hearing, the hearing will be held at 1740 W Adams Street, Phoenix, AZ 85007.
You must attend this hearing. This is an adversarial hearing before an administrative law judge, and is conducted in a similar manner as judicial proceedings. Thus, you must be prepared to present evidence, including witness testimony and documents, in support of your case.
STATEMENT OF LEGAL AUTHORITY AND JURISDICTION The State of Arizona has determined that the licensing and regulation of construction contractors is a proper state function, and has vested authority in the Registrar of Contractors
to administer Title 32, Chapter 10 of the Arizona Revised Statutes. A.R.S. §§ 32-1101 et seq.
All hearings for alleged violations of Title 32, Chapter 10 are conducted under Title 41,
Chapter 6, Article 10. A.R.S. § 32-1156.

PARTICULAR ARIZONA STATUTES AND RULES INVOLVED The statutes and rules the Respondent is alleged to have violated are cited in the complaint and citation, which were served on the Respondent on October 31, 2023.
SHORT AND PLAIN STATEMENT OF THE MATTERS ASSERTED The complaint and citation allege that the Respondent committed the following act(s):

THE PARTIES TO THE ADMINISTRATIVE HEARING Because Respondent is a licensee and is charged with an act(s) or omission(s) that is
cause for the suspension or revocation of a license, Respondent is a party to this case and will
be a party to the hearing.
Because Complainant alleged Respondent committed an act(s) or omission(s) that is cause for the suspension or revocation of a license, Complainant is a party to this case and will be a party to the hearing. Respondent and Complainant, as the parties to the hearing, will present evidence and argument to the administrative law judge. The Registrar’s assigned investigator will appear as a witness at the hearing.
RIGHT TO BE REPRESENTED The parties to the administrative hearing may choose to be represented by an attorney. A.R.S. § 41-1092.07(B). If one of the parties is a company, the company may be represented
by an officer or employee if that person satisfies the conditions set forth in A.R.S. § 32-
1156(B).

REGISTRAR’S APPEARANCE BY VIDEO CONFERENCE OR TELEPHONE
The Registrar’s investigators, employees, and attorneys will appear at the hearing via
video conference or telephone unless requested by a party to appear in-person. Requests for
the Registrar’s investigators, employees, or attorneys to appear in-person must be filed with the Registrar and the Office of Administrative Hearings no later than seven (7) calendar days prior to the hearing date.
HEARING PACKET In the interests of administrative efficiency, the Registrar compiles and discloses certain documents to the parties and the Office of Administrative Hearings. These documents are attached to this Notice of Hearing as the “Hearing Packet.” If any party wishes to submit additional evidence, they must do so during the hearing after completing a disclosure statement. See “Disclosure Statement” section below.
SUBPOENAS FOR TESTIMONY FROM A WITNESS OR DOCUMENTS The parties to the hearing must be prepared to present evidence in support of their case. If a party wants to obtain testimony from a witness or documents not in the party’s possession, the party must prepare and file a written subpoena for the Administrative Law Judge to review and sign, if approved. A.R.S. § 41-1092.07(C). Forms for requesting a subpoena can be found on the Office of Administrative Hearings’ website at www.azoah.com. The party seeking a subpoena must serve notice on all the parties to the hearing, and on the Registrar. A.R.S. § 41-1092.04.
DISCLOSURE STATEMENT At least seven calendar days before the hearing, each party must prepare and serve a
disclosure statement on all other parties, and file it with the Office of Administrative Hearings.
A.A.C. R4-9-118; A.A.C. R2-19-108. The disclosure statement must include any exhibit the
party will use at the hearing. A party’s failure to timely disclose any witness or exhibit, without good cause, may result in the administrative law judge excluding those witnesses or exhibits from being used at the hearing. A.A.C. R4-9-118(C). A sample disclosure form is available on the Registrar’s website at https://roc.az.gov/content/prehearing-disclosure- statement.
CHANGING THE HEARING DATE
The date of the hearing may only be advanced or delayed on the agreement of the parties or on a showing of good cause. A.R.S. § 41-1092.05(C). The date of the hearing may be changed by filing a written agreement of the parties to change the date of the hearing. The written agreement must be filed with the Office of Administrative Hearings, directed to the assigned Administrative Law Judge, and transmitted to the Registrar and all other parties. The assigned Administrative Law Judge may be found on the Office of Administrative Hearings’ web portal at www.azoah.com If a party would like to move the date of the hearing without agreement of all parties, the party must file a written motion with the Office of Administrative Hearings, directed to the
assigned Administrative Law Judge, and transmit a copy to the Registrar and all other parties.
The motion must state in detail good cause for why the date of the hearing should be advanced
or delayed, and the position of all other parties regarding the advancement or delay.
A party may also file a motion asserting a right to an expedited hearing upon a showing of extraordinary circumstances or the possibility of irreparable harm. A.R.S. § 41-1092.05(E).
RESOLUTION SHORT OF ADJUDICATION
In any case which is resolved or settled by the parties, or which is withdrawn by the
Complainant without objection from Respondent after the Notice of Hearing is issued, the parties must notify the Office of Administrative Hearings of the resolution or settlement. Jobsite Inspection Notice Re: Complaint Number 2023-09731
Dear Complainant and Respondent:
A formal complaint has been filed with the Arizona Registrar of Contractors.
A jobsite inspection is scheduled for September 6, 2023 at 11:30 AM. The Complainant is required to be present. The Respondent’s attendance is requested and encouraged. The Registrar encourages both parties to make a good faith effort to resolve this complaint prior to the jobsite inspection.
COMPLAINANT: 1. Under A.R.S. § 32-1155(D)(1), the Respondent must be allowed, upon request, the opportunity to inspect the work complained of within fifteen (15) days of receiving this notice. If Respondent is not provided an opportunity to inspect the work within the fifteen (15) day time period, the Registrar may be prohibited from taking further action on this complaint. 2. The Registrar may also be precluded from taking further action on this complaint, if the work that is the subject of the complaint is subject to neglect, modification, or abnormal use. A.R.S. § 32-1155(D)(2) 3. You must provide safe access to any area to be inspected. If access to a roof or other elevated area is required, you must provide a means to safely access the area (ladder or manlift as appropriate). Additionally, please secure any animals.
RESPONDENT: 1. Enclosed is a copy of the complaint. Under A.R.S. § 32-1155(D) you must be allowed, upon request, the opportunity to inspect the work complained of within fifteen days of the date of receipt of this notice. 2. To assist the assigned investigator in evaluating the merits of the complaint, please submit a response to the enclosed complaint to the assigned investigator prior to the scheduled inspection. 3. If you do not attend the jobsite inspection, your absence may negatively impact the investigation, and your interests. 4. If a building permit(s) was required for this project, please have the building permit information available at the jobsite inspection.

Purpose of the Jobsite Inspection When the Registrar receives a complaint against a contractor’s license alleging poor workmanship, the Registrar generally schedules a Jobsite Inspection. The Jobsite Inspection serves two purposes: 1. To give the contractor an opportunity to inspect the complaint items; and 2. To give the Registrar an opportunity to determine if the contractor’s work violates Arizona law.
Jobsite Inspection Rights and Responsibilities Access to inspect: The property owner has complete control over who they allow on the property. However, if the Registrar’s investigator or the contractor cannot inspect the work, the Registrar will not move forward with a citation.
Cooperation: Arizona law enables injured parties to seek relief for damages through several paths. When dealing with a licensed contractor, the Registrar of Contractors’ administrative complaint process may serve as one of those possible paths. However, in order to use that path, the Registrar relies on the cooperation of all parties to a complaint.
Minimum workmanship: The Registrar investigates workmanship complaints for compliance with minimum workmanship and professional industry standards. The Registrar does not issue citations for work that meets these standards.
Scope: The scope of the Jobsite Inspection is limited to items listed in the complaint filed with the Registrar’s office. It is the complainant’s responsibility to point out the complaint item(s) and the Investigators role to review the item(s). If the complainant identifies additional workmanship items not listed in the original complaint, they must file an addendum to the complaint. The Registrar’s Investigator may identify additional administrative violations by the contractor (e.g. work performed out of scope of the license and failure to provide a contract that meets requirements set by Arizona law) at the time of the inspection.
The Role of the Investigator At the Jobsite Inspection, the Registrar’s investigator will: ● Only investigate the items listed on the complaint form filed with the Registrar. ● Will gather evidence to make an informed decision about the complaint items.
What to expect after a Jobsite Inspection After doing a Jobsite Inspection, the Registrar’s Investigator will leave the jobsite and review the evidence provided during the inspection. Generally, the investigator does not make any determination at the time of the jobsite inspection regarding whether the allegations listed in the complaint are supported. ● If the allegations are confirmed, the Registrar’s Investigator may issue a Written Directive telling the contractor to correct the poor or incomplete work. ● If the allegations are not confirmed, the Registrar’s Investigator will close the complaint.

Written Directives Access: In order to use the administrative process offered by the Registrar, a property owner must provide reasonable access to allow the contractor to fix their work as directed by the Registrar in a Written Directive. Complainants may not put any additional, unnecessary restrictions on the Respondent above and beyond the initial contract requirements agreed upon at the beginning of the project. Respondents are required to make repairs on items identified on any Written Directive, not otherwise restricted by local code or HOA limitations. Complainants must make access available to the Respondent to make the required repairs and failure to provide reasonable access may result in the Registrar dismissing the complaint.
Contractor obligations: The Written Directive will set a deadline for compliance. This is the period of time determined by the Investigator as necessary to complete the items listed in the Directive. ● The deadline for compliance assumes the contractor will promptly begin working on the items listed in the Directive. ● Do not wait. Both parties should communicate quickly to schedule the work.
Extensions: If good cause exists to extend this deadline, either party may submit a written request to the Investigator. The Registrar will review requests for extension and determine if the Directive should be extended.
Manner and method of performance: The Registrar does not provide specific instructions for how to correct poor work. A licensed contractor is expected to have the skill and professionalism to complete the work. Moreover, the complainant may not dictate the manner of repair. If the contractor fails to appropriately correct the work according to the contract, the Registrar will issue a citation.
Compliance Inspection: After the Written Directive expires, the Registrar’s Investigator will contact the complainant to determine if the contractor performed any corrective work. ● If the contractor did corrective work, the Investigator may schedule a Compliance Inspection to determine if the poor work is corrected. ● If the contractor did not perform any corrective work, the Registrar’s Investigator will not do a Compliance Inspection and will determine whether to issue a citation based on the administrative record.

The Registrar encourages parties to work cooperatively, but cannot require a homeowner to continue to allow a contractor access to the property after the Directive period ends in order for the administrative process to continue. Denying access after the Directive ends is not grounds to close or dismiss a complaint.

Pool decking is unsteady as it had wood beam under the skimmer area. The backyard is not leveled when the travertine tile were placed as water drains from house into the pool. The property lot is set where the irrigation should flow to the side of the house and to the front. It is uneven. When confronted the contractor, he said that he will drain the water during rains as original lot irrigation is suppose to. Now we had to place a salem pump to push the ater out. The travertine tile are all uneven and many cracked and chipped tiles. Contractor asked me to place blue tape on the damaged tiles on July fourth, and it is still not fixed. I had told the subcontractor and the contractor during the tile placement that it is uneven leveling underneath and they dismissed it and stilll completed the job with poor outcomes. We have been reaching out to the contractor again and again with no response from him. He originally told us the job will be done by December 2022. Then he promised it will be done by July 4th, then July 29th. We had to finally tell him that landscape job is on hold because he needs to finish his part first, this took him two weeks to show up on one weekend to partially complete the retaining wall stackstone tiles application and stepping tiles from grass to the pool. The tiles are loose with huge gaps inbetween, poorly secured. The retaining wall and the back firepit wall- the stack stone tile is lower than the wall, so with coping tile there will be a huge gap. 'There are many moire issues. We are so frustrated with this contractor. He had made excuse after excuse- family emergency, personal emergency, hospitalization, freind sick, mother with open heart sx, heat stroke for himself (working 1 hour in heat at 8am), lost my phone, vacation, finish other jobs to focus on our job, etc etc. It is to the point that we are stuck as he is not finishing the work, and not canceling the contract for us to get teh job done through someone more efficient and professional. His own employee quit saying that he drinks and does not show up to work the next day. I have confronted him all these issues with no change in his mannerism or commitment to finish. Multiple phone calls and text sent to him with no response.

Complainant has concerns with drainage and ponding in the backyard, opted to perform a flood test at 4-5 different locations. No locations appear outside of allowable tolerances after 30 minutes.
Turf and some other landscaping elements have been installed by other contractors; landscapers have installed turf, catch basins and a sump pump and altered the backyard drainage configuration. Some parts of the backyard have been modified by others.

Present at inspection was Ameeta Chowdhary, complainant. No representatives for respondent appeared during the inspection. Complaint Item: 1 - Pool decking is unsteady as it had wood beam under the skimmer area Investigator’s Observation: Allegation refers to the skimmer housing and skimmer throat constructed at the west side of the pool. Respondent has installed a paver deck and the bottom of the paver coping at the skimmer opening appears reinforced with either plastic or metal. Area was inspected and no significant movement was observed. The pool has passed all required building safety inspections with the city of Peoria and I am unable to conclude the skimmer configuration fails to meet any relevant building codes adopted by the City of Peoria or workmanship standards enforced by the Registrar. Insufficient evidence to substantiate a violation. Governing Rule: N/A

Complaint Item: 2 - The backyard is not leveled when the travertine tile were placed as water drains from house into the pool. The property lot is set where the irrigation should flow to the side of the house and to the front. It is uneven. When confronted the contractor, he said that he will drain the water during rains as original lot irrigation is suppose to. Now we had to place a salem pump to push the ater out Investigator’s Observation: Complainant pointed out concerns with ponding throughout the travertine installation and opted to perform a flood test at multiple areas of the paver deck. Per standards for pavers, "Standing water exceeding 3/32” is unacceptable. Standing water exceeding 3/16” on driveways is unacceptable. Flood, wait 30 minutes and check for ponding." All flooded areas appeared to be within tolerance after waiting 30 minutes and testing the water depth; many areas did not have any water remaining before 30 minutes had passed. Unable to substantiate an issue with ponding.
Regarding drainage, the backyard has been modified by landscapers after respondent's work was performed and the landscapers have installed turf, catch basins and a sump pump to discharge water from the backyard. Unable to order corrective action due to modification of the backyard drainage by others. Governing Rule: N/A
Complaint Item: 3 - The travertine tile are all uneven and many cracked and chipped tiles. Contractor asked me to place blue tape on the damaged tiles on July fourth, and it is still not fixed. I had told the subcontractor and the contractor during the tile placement that it is uneven leveling underneath and they dismissed it and stilll completed the job with poor outcomes. Investigator’s Observation: Uneven Pavers - complainant clarified that this is in reference to lippage between pavers. Most pavers appear to be within tolerance, however, some pavers were observed to be outside the allowable tolerance of 1/8". Respondent shall locate and correct all paver lippage outside of allowable tolerances by appropriate means.

Cracked pavers - multiple examples were observed. Many areas have been marked with blue tape by the complainant. Some cracks were actually observed to be vein trend within the stone, but many pavers are in-fact cracked. Respondent shall replace all cracked pavers by appropriate means.
Chipped pavers - Complainant pointed out that many pavers are chipped at the edges. It is difficult to distinguish whether the pavers are tumbled or if the imperfections at the paver edges are intentionally left unfilled by the manufacturer. There is currently insufficient information to verify this is a workmanship deficiency.
Respondent shall correct the lippage and cracked paver deficiencies noted above by appropriate means. Governing Rule: Violation of any rule adopted by the Registrar; Namely A.A.C. R4-9-108(a): A contractor shall perform all work in a professional and workmanlike manner.
Complaint Item: 4 - We have been reaching out to the contractor again and again with no response from him. He originally told us the job will be done by December 2022. Then he promised it will be done by July 4th, then July 29th. We had to finally tell him that landscape job is on hold because he needs to finish his part first, this took him two weeks to show up on one weekend to partially complete the retaining wall stackstone tiles application and stepping tiles from grass to the pool. The tiles are loose with huge gaps inbetween, poorly secured. Investigator’s Observation: Gap was observed between the stone veneer and cap stones at the east retaining wall and firepit wall, and around the spa (gaps present between both the cap stones and the waterline tile). Complaint Item: 6 - We are so frustrated with this contractor. He had made excuse after excuse- family emergency, personal emergency, hospitalization, freind sick, mother with open heart sx, heat stroke for himself (working 1 hour in heat at 8am), lost my phone, vacation, finish other jobs to focus on our job, etc etc. It is to the point that we are stuck as he is not finishing the work, and not canceling the contract for us to get teh job done through someone more efficient and professional. His own employee quit saying that he drinks and does not show up to work the next day. I have confronted him all these issues with no change in his mannerism or commitment to finish. Multiple phone calls and text sent to him with no response. Investigator’s Observation: Allegation does not reference a workmanship issue within the Registrar's jurisdiction. After investigation, the Registrar determined that you failed to meet the requirements of A.R.S. § 32-1154(A), and now issues this Directive requiring you to take appropriate corrective action. Failure to comply with this Directive constitutes a violation of A.R.S. § 32-1154(A)(22) and may result in the issuance of a citation, discipline of your license, and a civil penalty pursuant to A.R.S. § 32-1154(E) of up to $500.00. You must notify the Registrar’s assigned Investigator of your compliance with this Directive prior to 5:00 p.m. on September 29, 2023.
RESTRICTIONS • You may not perform or hire other contractors to perform work that is outside the scope of your license. • If your license is currently suspended for administrative reasons 1, or is inactive, expired, or cancelled, you may not perform any corrective work nor contract in any manner, which includes hiring other contractors to perform work, until the suspension of your license(s) has been lifted or your license(s) has been reactivated.

Additionally, no work appears to have been performed to address lippage or cracked pavers as ordered and the pavers specific to these issues appear to be in the same condition observed at the initial inspection. reasonable period of time after receiving a written directive from the Registrar.
The written directive shall set forth the time within which the contractor is to complete the remedial action. The time permitted for compliance shall not be less than fifteen days from the date of issuance of the directive. A license shall not be revoked or suspended nor shall any other penalty be imposed for a violation of this paragraph until after a hearing has been held.
If the matter proceeds to a hearing and the administrative law judge determines that any of the charges listed above are supported by a preponderance of the evidence, then Respondent’s license(s) may be subject to suspension or revocation, and Respondent may be subject to other penalties provided by law, including civil penalties under A.R.S. §§ 32-1154(E) and (F). Deadline for Filing a Written Answer: Respondent must file a written answer with the Registrar no later than November 15, 2023. This deadline is calculated under A.R.S. §§ 32-1155(A) and (B), which provides a deadline ten days after service of the Citation. Service of the Citation and Complaint is complete five days after the Registrar mails a copy of the Citation and Complaint to Respondent’s latest address of record in the Registrar’s office. Pool decking is unsteady as it had wood beam under the skimmer area. The backyard is not leveled when the travertine tile were placed as water drains from house into the pool. The property lot is set where the irrigation should flow to the side of the house and to the front. It is uneven. When confronted the contractor, he said that he will drain the water during rains as original lot irrigation is suppose to. Now we had to place a salem pump to push the ater out. The travertine tile are all uneven and many cracked and chipped tiles. Contractor asked me to place blue tape on the damaged tiles on July fourth, and it is still not fixed. I had told the subcontractor and the contractor during the tile placement that it is uneven leveling underneath and they dismissed it and stilll completed the job with poor outcomes. We have been reaching out to the contractor again and again with no response from him. He originally told us the job will be done by December 2022. Then he promised it will be done by July 4th, then July 29th. We had to finally tell him that landscape job is on hold because he needs to finish his part first, this took him two weeks to show up on one weekend to partially complete the retaining wall stackstone tiles application and stepping tiles from grass to the pool. The tiles are loose with huge gaps inbetween, poorly secured. The retaining wall and the back firepit wall- the stack stone tile is lower than the wall, so with coping tile there will be a huge gap. 'There are many moire issues. We are so frustrated with this contractor. He had made excuse after excuse- family emergency, personal emergency, hospitalization, freind sick, mother with open heart sx, heat stroke for himself (working 1 hour in heat at 8am), lost my phone, vacation, finish other jobs to focus on our job, etc etc. It is to the point that we are stuck as he is not finishing the work, and not canceling the contract for us to get teh job done through someone more efficient and professional. His own employee quit saying that he drinks and does not show up to work the next day. I have confronted him all these issues with no change in his mannerism or commitment to finish. Multiple phone calls and text sent to him with no response.

Complainant has concerns with drainage and ponding in the backyard, opted to perform a flood test at 4-5 different locations. No locations appear outside of allowable tolerances after 30 minutes.
Turf and some other landscaping elements have been installed by other contractors; landscapers have installed turf, catch basins and a sump pump and altered the backyard drainage configuration. Some parts of the backyard have been modified by others.

Present at inspection was Ameeta Chowdhary, complainant. No representatives for respondent appeared during the inspection. Photos taken with Canon ELPH digital camera and/or state-issued Google Pixel cell phone camera. Audio recorded with Olympus DM-720 digital voice recorder. Complaint Item: 1 - Pool decking is unsteady as it had wood beam under the skimmer area Investigator’s Observation: Allegation refers to the skimmer housing and skimmer throat constructed at the west side of the pool. Respondent has installed a paver deck and the bottom of the paver coping at the skimmer opening appears reinforced with either plastic or metal. Area was inspected and no significant movement was observed. The pool has passed all required building safety inspections with the city of Peoria and I am unable to conclude the skimmer configuration fails to meet any relevant building codes adopted by the City of Peoria or workmanship standards enforced by the Registrar. Insufficient evidence to substantiate a violation. Governing Rule: N/A

Complaint Item: 2 - The backyard is not leveled when the travertine tile were placed as water drains from house into the pool. The property lot is set where the irrigation should flow to the side of the house and to the front. It is uneven. When confronted the contractor, he said that he will drain the water during rains as original lot irrigation is suppose to. Now we had to place a salem pump to push the ater out Investigator’s Observation: Complainant pointed out concerns with ponding throughout the travertine installation and opted to perform a flood test at multiple areas of the paver deck. Per standards for pavers, "Standing water exceeding 3/32” is unacceptable. Standing water exceeding 3/16” on driveways is unacceptable. Flood, wait 30 minutes and check for ponding." All flooded areas appeared to be within tolerance after waiting 30 minutes and testing the water depth; many areas did not have any water remaining before 30 minutes had passed. Unable to substantiate an issue with ponding.
Regarding drainage, the backyard has been modified by landscapers after respondent's work was performed and the landscapers have installed turf, catch basins and a sump pump to discharge water from the backyard. Unable to order corrective action due to modification of the backyard drainage by others. Governing Rule: N/A

Investigator’s Observation: Uneven Pavers - complainant clarified that this is in reference to lippage between pavers. Most pavers appear to be within tolerance, however, some pavers were observed to be outside the allowable tolerance of 1/8". Respondent shall locate and correct all paver lippage outside of allowable tolerances by appropriate means.

Cracked pavers - multiple examples were observed. Many areas have been marked with blue tape by the complainant. Some cracks were actually observed to be vein trend within the stone, but many pavers are in-fact cracked. Respondent shall replace all cracked pavers by appropriate means.
Chipped pavers - Complainant pointed out that many pavers are chipped at the edges. It is difficult to distinguish whether the pavers are tumbled or if the imperfections at the paver edges are intentionally left unfilled by the manufacturer. There is currently insufficient information to verify this is a workmanship deficiency.
Respondent shall correct the lippage and cracked paver deficiencies noted above by appropriate means. Governing Rule: Violation of any rule adopted by the Registrar; Namely A.A.C. R4-9-108(a): A contractor shall perform all work in a professional and workmanlike manner.

Investigator’s Observation: Gap was observed between the stone veneer and cap stones at the east retaining wall and firepit wall, and around the spa (gaps present between both the cap stones and the waterline tile). Dear Respondent:
After investigation, the Registrar determined that you failed to meet the requirements of A.R.S. § 32-1154(A), and now issues this Directive requiring you to take appropriate corrective action. Failure to comply with this Directive constitutes a violation of A.R.S. § 32-1154(A)(22) and may result in the issuance of a citation, discipline of your license, and a civil penalty pursuant to A.R.S. § 32-1154(E) of up to $500.00. You must notify the Registrar’s assigned Investigator of your compliance with this Directive prior to 5:00 p.m. on September 29, 2023.
RESTRICTIONS • You may not perform or hire other contractors to perform work that is outside the scope of your license. • If your license is currently suspended for administrative reasons 1, or is inactive, expired, or cancelled, you may not perform any corrective work nor contract in any manner, which includes hiring other contractors to perform work, until the suspension of your license(s) has been lifted or your license(s) has been reactivated.
DIRECTIVE REQUIREMENTS You are directed to remedy the following violations by the appropriate means:
Compliance Item: 3 - The travertine tile are all uneven and many cracked and chipped tiles. Contractor asked me to place blue tape on the damaged tiles on July fourth, and it is still not fixed. I had told the subcontractor and the contractor during the tile placement that it is uneven leveling underneath and they dismissed it and stilll completed the job with poor outcomes. Investigator’s Observation: Uneven Pavers - complainant clarified that this is in reference to lippage between pavers. Most pavers appear to be within

Cracked pavers - multiple examples were observed. Many areas have been marked with blue tape by the complainant. Some cracks were actually observed to be vein trend within the stone, but many pavers are in-fact cracked. Respondent shall replace all cracked pavers by appropriate means.
Chipped pavers - Complainant pointed out that many pavers are chipped at the edges. It is difficult to distinguish whether the pavers are tumbled or if the imperfections at the paver edges are intentionally left unfilled by the manufacturer. There is currently insufficient information to verify this is a workmanship deficiency.

Compliance Item: 4 - We have been reaching out to the contractor again and again with no response from him. He originally told us the job will be done by December 2022. Then he promised it will be done by July 4th, then July 29th. We had to finally tell him that landscape job is on hold because he needs to finish his part first, this took him two weeks to show up on one weekend to partially complete the retaining wall stackstone tiles application and stepping tiles from grass to the pool. The tiles are loose with huge gaps inbetween, poorly secured.

Investigator’s Observation: Gap was observed between the stone veneer and cap stones at the east retaining wall and firepit wall, and around the spa (gaps present between both the cap stones and the waterline tile). Respondent has installed a paver deck and the bottom of the paver coping at the skimmer opening appears reinforced with either plastic or metal. Area was inspected and no significant movement was observed. The pool has passed all required building safety inspections with the city of Peoria and I am unable to conclude the skimmer configuration fails to meet any relevant building codes adopted by the City of Peoria or workmanship standards enforced by the Registrar. Insufficient evidence to substantiate a violation. Governing Rule: N/A
Compliance Item: 2 - The backyard is not leveled when the travertine tile were placed as water drains from house into the pool. The property lot is set where the irrigation should flow to the side of the house and to the front. It is uneven. When confronted the contractor, he said that he will drain the water during rains as original lot irrigation is suppose to. Now we had to place a salem pump to push the ater out Investigator’s Observation: Complainant pointed out concerns with ponding throughout the travertine installation and opted to perform a flood test at multiple areas of the paver deck. Per standards for pavers, "Standing water exceeding 3/32” is unacceptable. Standing water exceeding 3/16” on driveways is unacceptable. Flood, wait 30 minutes and check for ponding." All flooded areas appeared to be within tolerance after waiting 30 minutes and testing the water depth; many areas did not have any water remaining before minutes had passed. Unable to substantiate an issue with ponding.
Regarding drainage, the backyard has been modified by landscapers after respondent's work was performed and the landscapers have installed turf, catch basins and a sump pump to discharge water from the backyard. Unable to

Response leter to Ameeta’s complaint to ROC.
Hello Ameeta, I appreciate and welcome your honesty and openness and concerns. Please excuse the lengthy leter as I was trying to answer all your concerns as thoroughly and accurately as possible.
My response to your complaint is per line item as follows:
#1 Complaint- “Pool decking is unsteady as it had a wood beam under the skimmer area”.
Response- There is no wood beam under the skimmer area. The skimmer area is a recessed area below the surface of the deck, and some stacked stone which can resemble wood (real stone panels) are used to line the inside of the hole so that the concrete could be poured behind it and the stacked stone would act as a form, and keep the concrete from flowing out into the hole. In some cases, wood forms might be used and removed a�er the concrete hardens, or a plas�c box is used and le� in place. This was a good use of some stone that was different from the stone on your walls. its a solid, reliable below deck box. The cover which is to be hand-ground and custom fit to level and match the rest of the deck is not yet installed because for months, I have placed more importance on other items on the jobsite. It should be noted that you or Navi have requested many �mes for me to priori�ze certain things before other things, and I have worked to that end. The covers are beside the heater and will be custom fited and adjusted to the holes they cover.
#2 complaint- “The backyard is not levelled when the traver�ne �le were placed as water drains from house into the pool”.
Response- May I please remind you that the traver�ne is not �le. It is pavers. There is a huge difference. The backyard is actually levelled in the following way, and can be verified upon inspec�on. The pool bond beam final eleva�on was set 1.5 inches above the eleva�on of the benchmark point of the exis�ng pa�o deck at the rear of the house. See a copy of the plot plan which was approved by the city of peoria. This means that from the original swail of the backyard which is located just off the edge of the pa�o containing the benchmark, the pool decking raises 1.5 inches as it reaches the edge of the pool. This is in fact true. Water cannot drain into the pool from the house, there is a low point between, which is adequate to handle a expected precipita�on index. At the �me we went over the original pool plans, I told you and Navi that I would place 2 or more inches up, which you asked for as flat as possible was a must. The current deck is not levelled, it goes downhill from the sliding glass door, and then uphill to the pool, enough to make water run to the sides as in the original drainage was designed. Making the deck level would have ruined this and cons�tutes a change of original grading, and risk flooding to the house. The house’s FFE (final floor eleva�on), must remain the highest point.
#3 Complaint- “The property lot is set where the irriga�on should flow to the side of the house and to the front. It is uneven. When confronted the contractor, He said that he will drain the water during rains as original lot irriga�on is supposed to. Now we had to place a salem pump to push the water out”.
Response- I assume that when you wrote “Irriga�on” in this passage, what you mean is “drainage”. Also I assume that “salem pump” means “sump pump”. Please let me assume you meant to say “when talking to the contractor” instead of “when confronted” because there was never any confronta�on, Received 11/15/2023 ROC Legal
only a civilized discussion. Let me also assume you mean “it will drain the water during rains” instead of “he will drain the water during rains” because nobody can possibly believe I would ever say that I will be present and standing vigil whenever it rains in the future, standing by to drain water. Am I right in these correc�ons?
Yes the lot SHOULD be set where drainage runs to the sides and out to the front. Yes, both sides of the lot should be able to let drainage happen. The truth- During the sales and design stages, I saw slight evidence of some very shallow low spot at the south east corner of the yard/house. That evidence is in the form of very small amount of dried mud slurry in an area about 4 feet from the corner of the house, foot in diameter, indica�ng a low spot possibly an inch low. During rain, it is evident that area may have as much as ½ to 1 inch of water. I asked Navi if during rain this area remains wet for any length of �me? The answer was no. So I planned to leave a few yards of spoil from the excava�on to raise this area slightly. It is important to note that a�er the contract was signed and as a separate added job, it was decided to have us install a driveway extension on that side of the house. I discussed at great length that we could only do so much with the eleva�on of the exis�ng driveway. The extension has to meet the same eleva�on with the exis�ng driveway in order to remain a smooth and level transi�on without tripping hazard. So then Navi said he wanted it to slant sideways to the edge allowing water to go around the side. I told him we would do all we could without causing the clearance under the gate to be out of compliance with the final yard safety enclosure inspec�on. (this inspec�on requires that the gap below the gate remain less than 2 inches). A slanted gate would not be acceptable looking, a very no�ceable slanted driveway would not be acceptable- no driveways in the neighborhood are extended in this way, and the homeowner’s associa�on would not approve. During the extending of this driveway, we removed 4 full hydraulic dump trailers of dirt and rock (total of 12 tons) to bring the surface down as far as possible. so I explained that it would be close, and if drainage was going to be needed, we could add it later in whatever form necessary. It was not added to the cost or promised free. It was to be determined later a�er a rainstorm. Currently, the landscapers have made a huge deal of it, and I offered to install the pump with drains, but not free. I have a text message from Navi, saying he would rather pay the chosen landscapers to do it so they could be responsible for the warranty on the grass and be a single source to go to in the event things don’t work. For the opposite side of the lot, drainage has not been changed or any construc�on taken place on that side. It should be able to remove water as originally planned by the builder- unless of course the builder did not grade properly, and the building inspector passed the inspec�on in error. It should also be noted that Navi asked me to have about 2 yards of decora�ve rock piled up near this side so it could be later spread on this side yard. I did not charge anything to do this, and did not promise to spread the rock. Later on, Navi paid Frank Quintero directly to spread the rock for him. Frank did a poor job of spreading it evenly, as he put all of it on half of the area causing the drainpath to go uphill. This is it not part of any contract or agreement made through Pleasant Valley Pools, Period. This side yard can easily be levelled out by redistribu�ng some of the rock where it is thick to areas where it is not covering at all. I can talk to frank and ask him to rework it properly.
This sums up as follows- original grading of the lot was slightly faulty, due to the builder, and the inspector from peoria, failed to force the builder to correct it. I men�oned that I would raise an area slightly by holding back some spoil from the excava�on, I did that. Post contract- you decided to extend the driveway, We agreed to try to see if we could make drainage work before spending more money unnecessarily. of a sump pump at fair price, Navi chose to go with the landscape company for that item. I respect your choice.
#4 Complaint- “The traver�ne �le are uneven and many cracked and chipped �les. Customer asked me to place blue tape on the damaged �les on July 4th and it is s�ll not fixed”.
Response- Again may I remind you that these are pavers, not �les. Pavers are completely different and the expected outcome is a rugged outdoor, rus�c looking materially sound deck built to take weathering, heavy traffic and abuse, all on top of soil, not concrete floor. The pavers have un-refined edges, imperfect surfaces, slight chips and pits or holes, as supplied by the maker. The condi�on of pavers is expected to weather and wear over �me and become more rugged and natural. They last decades. They are not to ever be considered a refined and polished or honed product that has been highly machined or gauged in a factory, and used to create a finely precise kitchen floor. It is an outdoor product. I am afraid your expecta�on may be unrealis�c. On JULY 4th, I asked you to go outside and place blue tape on any pavers you thought were sunk in too far or s�cking up enough to cause any tripping hazard. And you did. Thanks. There were about 20 separate pieces and an area involving about 6 pieces. On that very next day, they were all taken up and replaced or adjusted as necessary. My crew did a fabulous job responding immediately and making everything within an acceptable margin of acceptance. A�er that, about a week later, you went outside and absolutely plastered the yard with blue tape as if anything at all even the slightest nick on the sides of any paver was unacceptable. I don’t wish for you to think an outdoor paver job is like an indoor entrance into a 5 star resort, or a highly precision interior �le job in a ballroom. By those standards, not one of the pavers are good enough even right off the pallet as delivered. They don’t make such a material. Perhaps were you thinking of real traver�ne �le floated with thinset on a concrete slab? The problem with that is they are too slick and dangerous for poolside, and they can break easily in an outdoor se�ng crea�ng constant need for repair. It’s a highly different product and has a very different price and a different use. If you like that, you can have it, but it will be very costly, and I can’t refund any of the paver job.
Anyways, there are many pavers that I agree to be filled if chips on corners or holes in the surface are unreasonably beyond normal or typical pieces. We had a clear understanding that I would address this later a�er the rest of the project was completed. NOT before. I would rather get the rest of the construc�on traffic out of the way first.
#5 complaint- I had told the subcontractor and the contractor during the �le placement that it is uneven levelling underneath and they dismissed it and s�ll completed the job with poor outcomes.
Response- Again, this is pavers, not �le. The underlying surface was carefully and precisely filled with the appropriate fill material and compacted to 95% using the best “plate compactor” for the job. I believe I communicated clearly with you and Navi, that the surface is within a level of closeness to be acceptable, or it would be fixed later. It was never promised the surface would be perfectly flat to the precision of a �le interior floor. Again, I remind that I have my crew available a�er comple�on of the rest of the things, to address any pavers which are considered outside of reasonable tolerance. I stand behind their work and stand behind my method to let as much foot and construc�on traffic take place to the point that all is finished before filling chips, replacing cracked, or re-levelling pavers. It will be done.

Response- My contract clearly states there is no promised or guaranteed comple�on date. I always try to be as posi�ve and op�mis�c as possible. Based on the original scope of work, the contract was es�mated fairly well un�l countless (over 35 add-ons or change orders) were received. These are not a part of the contract, and change the scope and quan�ty of work and dura�on. Some changes can delay by huge amounts. It is easy to forget about delays because of Covid, Concrete shortages, changing the gas lines, changing the fire pits, adding the kitchen connec�ons, adding a driveway extension, trying to find (and almost a miracle) the matching pavers which had been discon�nued, wai�ng for several permi�ng changes to be approved, deciding to stack stone the en�re pool wall, and then later deciding to stack stone the en�re retaining wall, taking weeks to decide �le, then change several �mes, return it in favor of that stone, and going almost 3 months (from December to march) with rain every couple days without a single break in the weather. It should be noted that these are only some of the things that happened. All during this �me, I have to contend with other customers also. Unfortunately, the homeowner’s associa�on supplied Navi with the wrong paver informa�on, and pavers were ordered and delivered, and then had to be returned and an exhaus�ve search to get discon�nued matching pavers took months. All of the changes and add-ons are well documented. And during this, many of my other customers had to suffer from delays because of increased work at your project.
As far as no-response, I can only say that some days are difficult and ac�on packed, and I always try to give my customers a response as soon as I have the �me and answers to their ques�ons. I do not have Custom Pool Pricing whereas a single customer has my sole individual aten�on �ll job comple�on. Imagine if you went intoas restaurant that served only one guest at a �me, how much would dinner cost? Many customers begin to think of me as their personal employee, rather than a company that they purchased a pool from. I very much appreciate the understanding that my job requires flexibility, unforeseen distrac�ons, and opportuni�es to quote or develop future projects has to be dealt with. For several weeks I was on vaca�on in Hawaii, without a phone. These are not meant as excuses, they are just facts. During two weeks following my return from Hawaii, I had a medical problem to deal with which I was told to limit work and �me in the sun. I can’t explain or apologize for personal medical challenges. I did get the project ready for the landscapers while pu�ng the parts that are in the way as priority. Navi told me that the landscapers would be done in two days. I knew that was impossible. I was not told it would be ready for my return �ll last week. I told Navi I could resume Monday. Monday came and I am not done with the job I took during the �me off. They added things too. I cannot again keep answering the ques�on “when, when, when?” I plan to be there tomorrow to start cu�ng all the caps for the retaining wall.

Response- Again, there are no �les, there is stacked stone, and paver coping. The paver coping are typically installed BEFORE the stacked stone, but you requested to get ready for the landscapers, so I jumped ahead and put as much stacked stone in place so the landscapers would not be delayed. A�er the coping goes on, the rest of the stone will be put on. There is some places where the wall will be shaved down a litle, and some places where it might be a litle filled in to make for a straight line, so stacked stone fills the gap at the end of the process, not before.

Response- I’m deeply concerned. For most of the project, you’ve been very understanding and pa�ent with the weather, changes, obstacles, and my personal challenges. I thank you both deeply for this. All along the way, there have been many delays and challenges, most of which could not be avoided. My vaca�on was avoidable but planned to take place well a�er the project would have been completed. I could have avoided losing my phone, it was not on purpose. But in reality, this is all personal stuff that happens. There is no single major excuse or reason for the longevity. It is a collec�on of several events and challenges both with suppliers, workers, changes, and challenges over �me.
I assure you, frank did not quit, he tried to use the fact that I was under pressure to get done before going to Hawaii, and tried to demand more. I told him I no longer needed his help because He was repor�ng unrealized accomplishments, slacking terribly, and telling me lies and telling my customers lies also. I appreciate your honesty in telling me what Frank had said. It’s all untrue and he has caused major damage to me in many instances. He had to go.
CLOSING- My work ends tomorrow with the job I took during the work stoppage for your landscapers. I plan to get over to your backyard and begin the final stages of your project. I will not venture to say when they will be completed, so please do not ask. I can’t say whether we will have weather, or some other thing. My current health is good but I am s�ll ordered to stop work at a point in the day when the temperature exceeds 105, Doctor’s orders. I am s�ll commited to fulfilling my agreements, I am s�ll fully intending to complete sa�sfactorily. I am s�ll fully commited to address deck condi�ons as consistent with industry standards for quality and accepted standards. And I am s�ll fully commited to being easy to work with, polite, and respec�ul, with a smile on my face.
