You must attend this hearing. This is an adversarial hearing before an administrative law judge, and is conducted in a similar manner as judicial proceedings. Thus, you must be prepared to present evidence, including witness testimony and documents, in support of your case.

STATEMENT OF LEGAL AUTHORITY AND JURISDICTION The State of Arizona has determined that the licensing and regulation of construction contractors is a proper state function, and has vested authority in the Registrar of Contractors

to administer Title 32, Chapter 10 of the Arizona Revised Statutes. A.R.S. §§ 32-1101 et seq.

All hearings for alleged violations of Title 32, Chapter 10 are conducted under Title 41,

Chapter 6, Article 10. A.R.S. § 32-1156.

PARTICULAR ARIZONA STATUTES AND RULES INVOLVED The statutes and rules the Respondent is alleged to have violated are cited in the complaint and citation, which were served on the Respondent on February 6, 2024.

SHORT AND PLAIN STATEMENT OF THE MATTERS ASSERTED The complaint and citation allege that the Respondent committed the following act(s):

THE PARTIES TO THE ADMINISTRATIVE HEARING

Because Respondent is a licensee and is charged with an act(s) or omission(s) that is cause for the suspension or revocation of a license, Respondent is a party to this case and will be a party to the hearing. Because Complainant alleged Respondent committed an act(s) or omission(s) that is cause for the suspension or revocation of a license, Complainant is a party to this case and will be a party to the hearing.

Respondent and Complainant, as the parties to the hearing, will present evidence and

argument to the administrative law judge.

The Registrar’s assigned investigator will appear as a witness at the hearing.

RIGHT TO BE REPRESENTED The parties to the administrative hearing may choose to be represented by an attorney. A.R.S. § 41-1092.07(B). If one of the parties is a company, the company may be represented by an officer or employee if that person satisfies the conditions set forth in A.R.S. § 32- 1156(B).

CHANGE OF ADDRESS Each party must inform the Registrar and the Office of Administrative Hearings of any change of address within five (5) days of the change. A.R.S. § 41-1092.04.

HEARING PROCEDURES AND RULES The administrative hearing will be conducted in accordance with A.R.S. §§ 41-1092 to -1092.12, and A.A.C. R2-19-101 to -122. REGISTRAR’S APPEARANCE BY VIDEO CONFERENCE OR TELEPHONE The Registrar’s investigators, employees, and attorneys will appear at the hearing via video conference or telephone unless requested by a party to appear in-person. Requests for the Registrar’s investigators, employees, or attorneys to appear in-person must be filed with the Registrar and the Office of Administrative Hearings no later than seven (7) calendar days prior to the hearing date.

HEARING PACKET In the interests of administrative efficiency, the Registrar compiles and discloses

certain documents to the parties and the Office of Administrative Hearings. These documents

are attached to this Notice of Hearing as the “Hearing Packet.” If any party wishes to submit

additional evidence, they must do so during the hearing after completing a disclosure statement. See “Disclosure Statement” section below. SUBPOENAS FOR TESTIMONY FROM A WITNESS OR DOCUMENTS The parties to the hearing must be prepared to present evidence in support of their

case. If a party wants to obtain testimony from a witness or documents not in the party’s

possession, the party must prepare and file a written subpoena for the Administrative Law

Judge to review and sign, if approved. A.R.S. § 41-1092.07(C). Forms for requesting a

subpoena can be found on the Office of Administrative Hearings’ website at www.azoah.com. The party seeking a subpoena must serve notice on all the parties to the hearing, and on the Registrar. A.R.S. § 41-1092.04.

DISCLOSURE STATEMENT

At least seven calendar days before the hearing, each party must prepare and serve a disclosure statement on all other parties, and file it with the Office of Administrative Hearings. A.A.C. R4-9-118; A.A.C. R2-19-108. The disclosure statement must include any exhibit the party will use at the hearing. A party’s failure to timely disclose any witness or exhibit, without good cause, may result in the administrative law judge excluding those witnesses or exhibits from being used at the hearing. CHANGING THE HEARING DATE The date of the hearing may only be advanced or delayed on the agreement of the parties or on a showing of good cause. A.R.S. § 41-1092.05(C). The date of the hearing may be changed by filing a written agreement of the parties to change the date of the hearing. The written agreement must be filed with the Office of Administrative Hearings, directed to the assigned Administrative Law Judge, and transmitted to the Registrar and all other parties. The assigned Administrative Law Judge may be found on the Office of Administrative Hearings’ web portal at www.azoah.com If a party would like to move the date of the hearing without agreement of all parties,

the party must file a written motion with the Office of Administrative Hearings, directed to the

assigned Administrative Law Judge, and transmit a copy to the Registrar and all other parties.

The motion must state in detail good cause for why the date of the hearing should be advanced or delayed, and the position of all other parties regarding the advancement or delay. A party may also file a motion asserting a right to an expedited hearing upon a showing of extraordinary circumstances or the possibility of irreparable harm. A.R.S. § 41-1092.05(E).

RESOLUTION SHORT OF ADJUDICATION In any case which is resolved or settled by the parties, or which is withdrawn by the Complainant without objection from Respondent after the Notice of Hearing is issued, the parties must notify the Office of Administrative Hearings of the resolution or settlement. Jobsite Inspection Notice Re: Complaint Number 2023-09557

Dear Complainant and Respondent:

A formal complaint has been filed with the Arizona Registrar of Contractors.

A jobsite inspection is scheduled for October 3, 2023 at 9:00 AM. The Complainant is required to be present. The Respondent’s attendance is requested and encouraged. The Registrar encourages both parties to make a good faith effort to resolve this complaint prior to the jobsite inspection.

COMPLAINANT: 1. Under A.R.S. § 32-1155(D)(1), the Respondent must be allowed, upon request, the opportunity to inspect the work complained of within fifteen (15) days of receiving this notice. If Respondent is not provided an opportunity to inspect the work within the fifteen (15) day time period, the Registrar may be prohibited from taking further action on this complaint. 2. The Registrar may also be precluded from taking further action on this complaint, if the work that is the subject of the complaint is subject to neglect, modification, or abnormal use. A.R.S. § 32-1155(D)(2) 3. You must provide safe access to any area to be inspected. If access to a roof or other elevated area is required, you must provide a means to safely access the area (ladder or manlift as appropriate). Additionally, please secure any animals.

RESPONDENT: 1. Enclosed is a copy of the complaint. Under A.R.S. § 32-1155(D) you must be allowed, upon request, the opportunity to inspect the work complained of within fifteen days of the date of receipt of this notice. 2. To assist the assigned investigator in evaluating the merits of the complaint, please submit a response to the enclosed complaint to the assigned investigator prior to the scheduled inspection. 3. If you do not attend the jobsite inspection, your absence may negatively impact the investigation, and your interests. 4. 602.542.1525 · Toll Free 877.692.9762 · roc.az.gov C008 05/21 A Guide to Jobsite Inspections Purpose of the Jobsite Inspection When the Registrar receives a complaint against a contractor’s license alleging poor workmanship, the Registrar generally schedules a Jobsite Inspection. The Jobsite Inspection serves two purposes: 1. To give the contractor an opportunity to inspect the complaint items; and 2. To give the Registrar an opportunity to determine if the contractor’s work violates Arizona law.

Jobsite Inspection Rights and Responsibilities Access to inspect: The property owner has complete control over who they allow on the property. However, if the Registrar’s investigator or the contractor cannot inspect the work, the Registrar will not move forward with a citation.

Cooperation: Arizona law enables injured parties to seek relief for damages through several paths. When dealing with a licensed contractor, the Registrar of Contractors’ administrative complaint process may serve as one of those possible paths. However, in order to use that path, the Registrar relies on the cooperation of all parties to a complaint.

Minimum workmanship: The Registrar investigates workmanship complaints for compliance with minimum workmanship and professional industry standards. The Registrar does not issue citations for work that meets these standards.

Scope: The scope of the Jobsite Inspection is limited to items listed in the complaint filed with the Registrar’s office. It is the complainant’s responsibility to point out the complaint item(s) and the Investigators role to review the item(s). If the complainant identifies additional workmanship items not listed in the original complaint, they must file an addendum to the complaint. The Registrar’s Investigator may identify additional administrative violations by the contractor (e.g. work performed out of scope of the license and failure to provide a contract that meets requirements set by Arizona law) at the time of the inspection.

The Role of the Investigator At the Jobsite Inspection, the Registrar’s investigator will: ● Only investigate the items listed on the complaint form filed with the Registrar. ● Will gather evidence to make an informed decision about the complaint items.

What to expect after a Jobsite Inspection After doing a Jobsite Inspection, the Registrar’s Investigator will leave the jobsite and review the evidence provided during the inspection. Generally, the investigator does not make any determination at the time of the jobsite inspection regarding whether the allegations listed in the complaint are supported. ● If the allegations are confirmed, the Registrar’s Investigator may issue a Written Directive telling the contractor to correct the poor or incomplete work. ● If the allegations are not confirmed, the Registrar’s Investigator will close the complaint.

Written Directives Access: In order to use the administrative process offered by the Registrar, a property owner must provide reasonable access to allow the contractor to fix their work as directed by the Registrar in a Written Directive. Complainants may not put any additional, unnecessary restrictions on the Respondent above and beyond the initial contract requirements agreed upon at the beginning of the project. Respondents are required to make repairs on items identified on any Written Directive, not otherwise restricted by local code or HOA limitations. Complainants must make access available to the Respondent to make the required repairs and failure to provide reasonable access may result in the Registrar dismissing the complaint.

Contractor obligations: The Written Directive will set a deadline for compliance. This is the period of time determined by the Investigator as necessary to complete the items listed in the Directive. ● The deadline for compliance assumes the contractor will promptly begin working on the items listed in the Directive. ● Do not wait. Both parties should communicate quickly to schedule the work.

Extensions: If good cause exists to extend this deadline, either party may submit a written request to the Investigator. The Registrar will review requests for extension and determine if the Directive should be extended.

Manner and method of performance: The Registrar does not provide specific instructions for how to correct poor work. A licensed contractor is expected to have the skill and professionalism to complete the work. Moreover, the complainant may not dictate the manner of repair. If the contractor fails to appropriately correct the work according to the contract, the Registrar will issue a citation.

Compliance Inspection: After the Written Directive expires, the Registrar’s Investigator will contact the complainant to determine if the contractor performed any corrective work. ● If the contractor did corrective work, the Investigator may schedule a Compliance Inspection to determine if the poor work is corrected. ● If the contractor did not perform any corrective work, the Registrar’s Investigator will not do a Compliance Inspection and will determine whether to issue a citation based on the administrative record.

The Registrar encourages parties to work cooperatively, but cannot require a homeowner to continue to allow a contractor access to the property after the Directive period ends in order for the administrative process to continue. Denying access after the Directive ends is not grounds to close or dismiss a complaint.

WRITTEN DIRECTIVE FROM THE REGISTRAR

Dear Respondent:

After investigation, the Registrar determined that you failed to meet the requirements of A.R.S. § 32-1154(A), and now issues this Directive requiring you to take appropriate corrective action. Failure to comply with this Directive constitutes a violation of A.R.S. § 32-1154(A)(22) and may result in the issuance of a citation, discipline of your license, and a civil penalty pursuant to A.R.S. § 32-1154(E) of up to $500.00. You must notify the Registrar’s assigned Investigator of your compliance with this Directive prior to 5:00 p.m. on November 20, 2023.

Any request for extension of Directive period must be received prior to the expiration date/time and include sufficient evidence to substantiate request such as inspection or material delays.

RESTRICTIONS • You may not perform or hire other contractors to perform work that is outside the scope of your license. • If your license is currently suspended for administrative reasons 1, or is inactive, expired, or cancelled, you may not perform any corrective work nor contract in any manner, which includes hiring other contractors to perform work, until the suspension of your license(s) has been lifted or your license(s) has been reactivated.

DIRECTIVE REQUIREMENTS You are directed to remedy the following violations by the appropriate means:

Compliance Item 1: Countertop installed has cracked down center of seam. Contractor has attempted to correct it 3 times. 1st: they cut 2" too short and had scrap piece in seam, 2nd: cracked within 24 hours of install down center, 3rd: cracked within hours of install. Cracks are easily wide enough to fit a quarter into. Seam is wider during morning after it has cooled and narrower under heat from sunlight.;

This means the license is suspended for lack of qualifying party, lack of bond, nonrenewal, Recovery Fund payout, or for any reason listed in A.R.S. § 32-1124(F). 1700 W. Washington Street, Suite 105 · Phoenix AZ 85007-2812

Minimum workmanship standards does not allow for a joint width greater than 1’16”. Respondent should correct by appropriate methods. Governing Rule: ARS §32-1154 (A) (3), Violation of any rule adopted by the Registrar; Namely A.A.C. R4-9-108(b): A contractor shall perform all work in accordance with any applicable building codes and professional industry standards. For work to be performed in accordance with professional industry standards, a contractor shall use such skills, prudence, and diligence in performing and completing tasks undertaken that the completed work meets the standards of a similarly licensed contractor possessing ordinary skill and capacity.

Compliance Item 2: Ramada ceiling leaks at SW corner when rain curtain runs. Contractor has stated that there are no leaks but we have provided video evidence of the leak and can easily reproduce it.; Investigator’s Observation: Respondent acknowledge the leak at this location and stated that they intended to fix it. No water test performed. Respondent should identify and correct cause of leak and any damage resulting from the leak. Governing Rule: ARS §32-1154 (A) (3), Violation of any rule adopted by the Registrar; Namely A.A.C. R4-9-108(b): A contractor shall perform all work in accordance with any applicable building codes and professional industry standards. For work to be performed in accordance with professional industry standards, a contractor shall use such skills, prudence, and diligence in performing and completing tasks undertaken that the completed work meets the standards of a similarly licensed contractor possessing ordinary skill and capacity.

Compliance Item 3: Painting is incomplete from repairs and modifications. Bare steel on Ramada, Ramada countertop underneath only primed, Investigator’s Observation: Paint is not complete on all steel including rain curtain. Contractor recently excavated drywell, at our request, to find that 1/2 of the drywell was already filled with dirt and ineffective. Contractor lied about there being fabric liner on sides and only recently corrected after we wanted photos verifying it. Contractor employee Tyler Tew became confrontational once again. Please verify that drywell has been properly installed.; Investigator’s Observation: Inspection of drywell is under the authority of the building official. Contractor has attempted to correct it 3 times. 1st: they cut 2" too short and had scrap piece in seam, 2nd: cracked within 24 hours of install down center, 3rd: cracked within hours of install. Cracks are easily wide enough to fit a quarter into. Seam is wider during morning after it has cooled and narrower under heat from sunlight.; Investigator’s Observation: At this time, the joint width of this stone slab is greater than 3/8”. Contactor said they fixed leaks but it leaked 2 days after when we tested. Contractor employee Tyler Tew became confrontational and verbally abusive when we tried to inform them leak was not fixed.; Investigator’s Observation: Water damage is visible on wall. Respondent should identify the cause of leak and correct condition as well as all damage caused by the leak. Concealed plumbing requires permit/inspection. Respondent should obtain building official reinspection for any corrections made to previously passed, concealed plumbing. Respondent should provide a copy of the closed permit/certificate of occupancy for this project to this Investigator. Compliance Item 6: There was a leak at corrugated deco drain pipe that was leaking so badly water seeped to the surface. Informed contractor. They said there was no leak and back filled. I excavated the area and duplicated the leak and sent video evidence. Contractor employee Tyler Tew became confrontational and argumentative when I sent video evidence and said it was acceptable per ROC. Corrugated pipe has obvious punctures and is not of the leeching type. Leak is near plumbing for the pool and has

Contractor has attempted multiple times to say things are corrected or fixed and "cover things up". Investigator’s Observation: There is a visible hole in the drain pipe. Respondent should correct this condition as well as all damage caused by the leak. Concealed plumbing requires permit/inspection. Respondent should obtain building official reinspection for any corrections made to previously passed, concealed plumbing. Respondent should provide a copy of the closed permit/certificate of occupancy for this project to this Investigator. We had to request multiple times that walls and top be lined with fabric as per verbal discussions with contractor employees. Contractor recently excavated drywell, at our request, to find that 1/2 of the drywell was already filled with dirt and ineffective. Contractor lied about there being fabric liner on sides and only recently corrected after we wanted photos verifying it. Contractor employee Tyler Tew became confrontational once again. Please verify that drywell has been properly installed.; Investigator’s Observation: Inspection of drywell is under the authority of the building official. The Registrar does not inspect/evaluate work that requires permit and

Contractor has attempted to correct it 3 times. 1st: they cut 2" too short and had scrap piece in seam, 2nd: cracked within 24 hours of install down center, 3rd: cracked within 24 hours of install. Seam is wider during morning after it has cooled and narrower under heat from sunlight.; Investigator’s Observation at INITIAL JOBSITE INSPECTION: At this time, the joint width of this stone slab is greater than 3/8”. Certificate of Special Inspection from the City of Scottsdale (dated December 14, 2023) was obtained for this project by the Respondent, project is permitted by the City of Phoenix. Respondent did not comply with the requirements of the building official and address this fail notice. Respondent did not comply with all requirement of the building official (permit/inspection) relative to their scope. Respondent did not obtain closed permit/certificate of occupancy for this project. Contractor has attempted to correct it 3 times. 1st: they cut 2" too short and had scrap piece in seam, 2nd: cracked within 24 hours of install down center, 3rd: cracked within 24 hours of install. Cracks are easily wide enough to fit a quarter into. Seam is wider during morning after it has cooled and narrower under heat from sunlight.; Investigator’s Observation at INITIAL JOBSITE INSPECTION: At this time, the joint width of this stone slab is greater than 3/8”. Minimum workmanship standards does not allow for a joint width greater than 1/16”. Respondent should correct by appropriate methods. Investigator’s Observation at COMPLIANCE JOBSITE INSPECTION: Subsequent to the Compliance Inspection, Respondent provided information from countertop manufacturer stating in part: B. Respondent should complete all paint in their scope, correct all paint that is insufficient to cover, correct all overspray and any damage caused to paint by the work of the Respondent. Compliance Item 11: Drywell was recently "fixed" by contractor. We need to ensure this is to code by ROC inspector as we have had settlement of 6+" in the area over a few short months and it has cracked concrete and pavers in area. We had to request multiple times that walls and top be lined with fabric as per verbal discussions with contractor employees. Contractor recently excavated drywell, at our request, to find that 1/2 of the drywell was already filled with dirt and ineffective. Contractor lied about there being fabric liner on sides and only recently corrected after we wanted photos verifying it. Contractor employee Tyler Tew became confrontational once again. Please verify that drywell has been properly installed.; Investigator’s Observation at INITIAL JOBSITE INSPECTION: Inspection of drywell is under the authority of the building official. The Registrar does not inspect/evaluate work that requires permit and inspection by the building authority. Respondent states that drywell was inspected, however, drywell has been reworked. Respondent should obtain building official reinspection for any corrections made to previously passed, storm water appurtenance. Respondent should provide a copy of the closed permit/certificate of occupancy for this project to this Investigator. Compliance Item 15: On November 17, 2023, Complainant provided a copy of failed inspection from the City of Phoenix, the notice was provided to the parties as additional information. On November 17, 2023, the Respondent replied that they had received the notice and were working on resolution. On November 29, 2023, the Respondent advised that they “should be able to have this completed by the end of next week”. Investigator’s Observation at INITIAL JOBSITE INSPECTION: Directive period has been extended to allow for the Respondent to comply with the requirements of the building official and address this fail notice. Respondent should complete their scope of work and comply with all requirement of the building official (permit/inspection) relative to their scope. Respondent should provide a copy of the closed permit/certificate of occupancy for this project to this Investigator. A FORMAL STATEMENT OF THE CHARGES AGAINST RESPONDENT

The Registrar investigated this matter and finds cause to charge Respondent with

violation(s) of Title 32, Chapter 10 of the Arizona Revised Statutes. Respondent is charged

with violating:

contractor shall perform all work in accordance with any applicable building codes

Charge: 2 A.R.S. § 32-1154(A)(22) Failure to take appropriate corrective action to comply with this chapter or with rules adopted pursuant to this chapter without valid justification within a reasonable period of time after receiving a written directive from the Registrar. The written directive shall set forth the time within which the contractor is to complete the remedial action. The time permitted for compliance shall not be less than fifteen days from the date of issuance of the directive. A license shall not be revoked or suspended nor shall any other penalty be imposed for a violation of this paragraph until after a hearing has been held.

If the matter proceeds to a hearing and the administrative law judge determines that any

of the charges listed above are supported by a preponderance of the evidence, then

Respondent’s license(s) may be subject to suspension or revocation, and Respondent may be

subject to other penalties provided by law, including civil penalties under A.R.S. §§ 32-1154(E)

and (F).

FILING A WRITTEN ANSWER Respondent must appear by filing with the Registrar a written answer to the citation and complaint showing cause, if any, why Respondent’s license(s) should not be suspended or revoked. Bare steel on Ramada, Ramada countertop underneath only primed, streaks on west wall to the south of Ramada and overspray on sheer decent wall.;Leak at sheer decent wall with the east sheer decent. Contactor has said they fixed leaks but it continues to leak . It looks like contractor tried to cover up leak and not fix joint inside block wall. Leak is not leeching through and causing cracks on the wall. There is also a leak at the main T. Contactor said they fixed leaks but it leaked 2 days after when we tested. Contractor employee Tyler Tew became confrontational and verbally abusive when we tried to inform them leak was not fixed.;There was a leak at corrugated deco drain pipe that was leaking so badly water seeped to the surface. Informed contractor. They said there was no leak and back filled. I excavated the area and duplicated the leak and sent video evidence. Contractor employee Tyler Tew became confrontational and argumentative when I sent video evidence and said it was acceptable per ROC. Corrugated pipe has obvious punctures and is not of the leeching type. Leak is near plumbing for the pool and has already caused settlement issues in the area. Informed contractor to leave area excavated so I could verify leak had been repaired but again became confrontational and said if they left it open I, the homeowner, would have to backfill. Contractor has attempted multiple times to say things are corrected or fixed and "cover things up". These are just the only pending items and not historical items.;Multiple plants have died and need to be replaced. Contractor states they want to wait until it cools down. This is acceptable but want to make sure it gets complete.;Contractor continues to send invoices for full amount due on contract even though we had outlined hold backs for incomplete items. Per contract, funds are not due until punch list items/hold backs are completed. Contractor has been very forceful asking us just to pay and they "promise" to take care of things.;Due to all the repairs and excavation, granite cover rock is uneven, showing exposed dirt and is stained in multiple areas from paint and concrete.;Drywell was recently "fixed" by contractor. We need to ensure this is to code by ROC inspector as we have had settlement of 6+" in the area over a few short months and it has cracked concrete and pavers in area. We had to request multiple times that walls and top be lined with fabric as per verbal discussions with contractor employees. Contractor recently excavated drywell, at our request, to find that 1/2 of the drywell was already filled with dirt and ineffective. Contractor lied about there being fabric liner on sides and only recently corrected after we wanted photos verifying it. Contractor employee Tyler Tew became confrontational once again. Please verify that drywell has been properly installed.; connections behind Ramada sink are not glued; There is a plastic bottle behind Ramada in the ground that was to mark something but it is unknown what. I believe there is a valve for the rain curtain that should be accessible in the area.; there are valves behind sheer decent wall that have been buried and are not accessible; West wall by tree still has holes from concrete anchors that were used to put up temporarily pool fence by contractor, needs patch and paint

Changes in the Services - Client may request reasonable changes to the Services in the available services listed above. Any changes to the Services must be in writing; Lavender Landscape will create a Change Order to confirm requested changes to the Services, and Change Order must be signed by both Lavender Landscape and Client. Client agrees that any changes to the Services will result in additional charges and an extension of the total anticipated project timeline. Client agrees to a $250 change order fee that will be applied to each individual change order. Change orders are due 100% in full upon signing. No work can begin on change orders until payment is received. Change orders shall be considered additions to original contract and schedule and cannot withhold final payments on original contracted work.

Delay of Job Fee - Hindering the progress of work on an active construction site will result in a $250 per day job delay fee if the crew has started work for the day and is asked to stop. This fee will only be assessed due to changes to the approved plan documents or inability to access the jobsite, not for reasons outside of the clients control.

Warranty - Lavender Landscape provides a warranty on all work performed during the Services in the Contract. Should any issues or dissatisfaction arise with the finished Services, Client should contact Lavender Landscape to discuss Services and Warranty. Warranty period starts from the date that Services are paid for in full. Lavender Landscape does not warrant items that have been damaged due to neglect, vandalism, or acts of god, such as frost, insects, high winds, etc. Client agrees to use basic standards of care for all living materials and conduct proper pest control and maintenance. Physical damage such as major chips, breaks and cracks will be replaced under warranty. Rejection of standard natural stone variations may be replaced and subject to a Change Order to be paid for by Client.

Contractor/Lavender Landscape Obligations - Lavender Landscape is a duly licensed company in good standing, ROC #326465. Contractor will perform the Services in a workmanlike manner, in compliance with all applicable laws, regulations, codes, restrictive covenants, and homeowners’ association requirements. Lavender Landscape agrees to furnish the labor, materials, and supplies necessary to

perform the Services in accordance with the terms and conditions contained in this Contract. Upon completion of the Services, Contractor will remove all materials, supplies, and other debris. Lavender Landscape and representatives, partners, and crews will exercise reasonable skill and care in the performance of the work. Lavender Landscape reserves the right to photograph or film any parts of the design or construction process related to our work together, for use in marketing and social media.

Client Obligations - Client will provide Lavender Landscape, its employees, agents, partners, crew, and subcontractors, reasonable access to the Property for the purpose of performing the Services, without interference by the Client of by the other contractors of the Client. Client agrees to keep the Property clear of all known and potential hazards. Client further agrees to keep all pets out of the work area of the Property. Job site access for employees and crews may be between 5am and 6pm, unless otherwise directed. Client agrees to the use of existing utilities on site.

Client is the legal owner of the Property, or otherwise has authority to permit construction upon the Property. The requested Services are in accordance with all applicable laws, regulations, codes, restrictive covenants, and homeowners’ association requirements. Client has the financial ability to pay Lavender Landscape for the Services.

The Client will be responsible for obtaining any planning permission required for the Services. Lavender Landscape agrees to be responsible for obtaining permits and licenses needed over the course of the Services - additional costs may apply - and the Client will give reasonable assistance as required by Lavender Landscape. Lavender Landscape will notify the Client of additional costs and provide a Change Order.

Termination - Client possesses the right to relinquish contractual agreement for a legitimate reason. Client must provide written notice to terminate the Contract, for refund prior to commencement or labor at a 5% penalty rate on open invoices only.

Entire Agreement - This document reflects the entire agreement between the Parties and reflects a complete understanding of the Parties with respect to the subject matter. This Contract supersedes all prior written and oral representations. The Contract may not be amended, altered or supplemented except in writing signed by both Lavender Landscape and Client.

Legal and Binding Contract - This Contract is legal and binding between the Parties as stated above. This Contract may be entered into and is legal and binding in the United States. The Parties each represent that they have the authority to enter into this Contract.

Client agrees to pay Lavender Landscape in accordance with the Payment Terms listed above. This pricing is good and valid for 30 days from date listed on this Contract.

Additional Payment Terms - Lavender Landscape will invoice Client using Intuit QuickBooks. Client will receive invoice via email prior to due date and invoice must be paid by Client on or before date is due via bank transfer. Client may pay with credit card and must specify in writing; credit card payment requires adjustment of the QuickBooks invoice to include a 3% credit card processing fee.

Changes in the Services - Client may request reasonable changes to the Services in the available services listed above. Any changes to the Services must be in writing; Lavender Landscape will create a Change Order to confirm requested changes to the Services, and Change Order must be signed by both Lavender Landscape and Client. Client agrees that any changes to the Services will result in additional charges and an extension of the total anticipated project timeline. Client agrees to a $250 change order fee that will be applied to each individual change order. Change orders are due 100% in full upon signing. No work can begin on change orders until payment is received. Change orders shall be considered additions to original contract and schedule and cannot withhold final payments on original contracted work.

Delay of Job Fee - Hindering the progress of work on an active construction site will result in a $250 per day job delay fee if the crew has started work for the day and is asked to stop. This fee will only be assessed due to changes to the approved plan documents or inability to access the jobsite, not for reasons outside of the clients control.

Warranty - Lavender Landscape provides a warranty on all work performed during the Services in the Contract. Should any issues or dissatisfaction arise with the finished Services, Client should contact Lavender Landscape to discuss Services and Warranty. Warranty period starts from the date that Services are paid for in full. Lavender Landscape does not warrant items that have been damaged due to neglect, vandalism, or acts of god, such as frost, insects, high winds, etc. Client agrees to use basic standards of care for all living materials and conduct proper pest control and maintenance. Notes on Plantings: Lavender will not replace plantings until 30 days after the final payment is made. This is to ensure that all plantings settle into their new environments and allows us to replace all necessary plantings that may be affected.

Notes on Natural Stone: Natural stone decking or veneers will have natural variation and imperfections within the stone that are considered standard. Physical damage such as major chips, breaks and cracks will be replaced under warranty. Rejection of standard natural stone variations may be replaced and subject to a Change Order to be paid for by Client.

Contractor/Lavender Landscape Obligations - Lavender Landscape is a duly licensed company in good standing, ROC #326465. Contractor will perform the Services in a workmanlike manner, in compliance with all applicable laws, regulations, codes, restrictive covenants, and homeowners’ association requirements. Lavender Landscape agrees to furnish the labor, materials, and supplies necessary to

perform the Services in accordance with the terms and conditions contained in this Contract. Upon completion of the Services, Contractor will remove all materials, supplies, and other debris. Lavender Landscape and representatives, partners, and crews will exercise reasonable skill and care in the performance of the work. Lavender Landscape reserves the right to photograph or film any parts of the design or construction process related to our work together, for use in marketing and social media.

Client Obligations - Client will provide Lavender Landscape, its employees, agents, partners, crew, and subcontractors, reasonable access to the Property for the purpose of performing the Services, without interference by the Client of by the other contractors of the Client. Client agrees to keep the Property clear of all known and potential hazards. Client further agrees to keep all pets out of the work area of the Property. Job site access for employees and crews may be between 5am and 6pm, unless otherwise directed. Client agrees to the use of existing utilities on site.

Client is the legal owner of the Property, or otherwise has authority to permit construction upon the Property. The requested Services are in accordance with all applicable laws, regulations, codes, restrictive covenants, and homeowners’ association requirements. Client has the financial ability to pay Lavender Landscape for the Services.

The Client will be responsible for obtaining any planning permission required for the Services. Lavender Landscape agrees to be responsible for obtaining permits and licenses needed over the course of the Services - additional costs may apply - and the Client will give reasonable assistance as required by Lavender Landscape. Lavender Landscape will notify the Client of additional costs and provide a Change Order.

Termination - Client possesses the right to relinquish contractual agreement for a legitimate reason. Client must provide written notice to terminate the Contract, for refund prior to commencement or labor at a 5% penalty rate on open invoices only.

Entire Agreement - This document reflects the entire agreement between the Parties and reflects a complete understanding of the Parties with respect to the subject matter. This Contract supersedes all prior written and oral representations. The Contract may not be amended, altered or supplemented except in writing signed by both Lavender Landscape and Client.

Legal and Binding Contract - This Contract is legal and binding between the Parties as stated above. This Contract may be entered into and is legal and binding in the United States. The Parties each represent that they have the authority to enter into this Contract.

Response to Complaint 2023-09557

To whom it may concern;

We are writing in response to the compliance findings for this complaint No. 2023-09557 Don LoGuercio v. Lavender Landscape Design Co LLC.

In response to compliance Item No 1: “Countertop installed has cracked down center of seam..”

Manufacturer seam allowance is incorrectly stated in the “Investigator’s Observation at the COMPLIANCE JOBSITE INSPECTION. In section 4. Installation Guidelines Specific to Caesarstone Outdoor, Diagram B shows that a seam width of 3/16” is recommended between slabs. In the report, it is stated that the manufacturer seam allowance is ⅛” and that this is greater than the workmanship standards of a 1/16”. This countertop is applied in an outdoor application and can not be held to the same standards as an indoor application. The countertop is installed per manufacturer requirements and has been inspected by a representative of Diresco and Caesarstone Solaris on two separate occasions. The seam itself meets the manufacturer’s requirements/recommendations. Proper blocking and adhesive per outdoor application have been used as well as a high-temperature silicone to allow for expansion and contraction due to the temperature swings. In response to Compliance Item #4 “streaks on the west wall to south Ramada and overspray on the sheer decent wall;

Inspector stated that streaking remains and it appears no correction was attempted on this Item during period of Written Dircective.

This statement is not accurate. The first attempt to correct this was done by our painter who repainted this entire section with a new coat of paint. It was then determined that the streaking or swirl marks that were observed at the initial inspection were not corrected by just applying a new coat of paint. The swirling caused by a high-pressure paint sprayer was still visible and had to be remedied by chipping and reapplying stucco to the west wall. Once the patched area was dry, another coat of paint was applied to this entire section of the wall. This did fix the “swirling or streaking” observed on the west wall What was observed on the date of the compliance inspection were a couple of areas where the base coat had bled through, which requires a minor paint touch-up. Stucco can be painted once it has dried, typically recommended to wait at least 7 days. Stucco fully cures after 30 days, so it is not uncommon to see areas where shrinking or cracking may occur and require a second coat of paint.

In response to Compliance item 11, “Drywell was recently “fixed” by contractor. The term “drywell” is used incorrectly in this case. The term “drywell” that the client is referring to, is simply an area where Lavender directed water to run to on the side of his yard. This is area is for a drain line for raingutters and splashpad run-off, similar to a back-wash pit. All previous concerns of settling in this area of question have been addressed and resolved with the homeowner. The ROC as well as the building inspector has no direction or specifications on this backwash pit. No permitting or inspections would be required.

In response to Compliance item #15. “On November 17, 2023, Complainant provided a copy of failed inspection from city of Phoenix…”

Lavender was unable to close the permit due to the length of time necessary to obtain a special inspection certificate. This required coordination from our engineering firm, the city permitting office and subcontractors. The time it took for the engineering firm to produce said certification was out of the control of Lavender and is why we had asked for an extension to the directive in an email sent to the inspector on 12/22/23.

11/13/23 - received notice of a failed inspection.

11/14/23 - a request for a special inspection certificate was sent to AMMTEC engineering to address failed inspection comments. Received 2/21/2024 ROC Legal

11/16/23 - Communication for requirements needed to obtain this certification was sent back to us by AMMTEC.

11/17/23 - Notified Inspector Melton that Lavender is working on obtaining special inspection certificate from engineering firm.

11/21/23 - All necessary documentation was submitted to Ammtec for review. Due to AMMTEC’s backlog, we were not given the certification until Friday, December 15th.

12/15/23 Special inspection certificate received from AMMTEC engineering. A re-inspection with the city permitting office was immediately scheduled for the following Monday 12/18/23, the first available inspection time.

12/18/23 - reinspection with city inspector John Montoya. His notes from the initial inspection notice from 11/13/23 stated the following: 1. A framing inspection had never been completed. 2. Provide a Special Inspection certification (3rd party) 3. Plans missing details for Beam ie: B/S2, A/S2 4. Expose ceiling to verify rafters and beams appears that cross beam members are missing. 5. Provide Engineering for retro fitting from Engineering plans.

At the inspection on the 18th, Inspector Montoya was presented with the special inspection certificate. Included in obtaining this certificate were pictures of the structure. These photos also noted and addressed the inspector's notes regarding the framing, missing beams (B/S2 and A/S2) and referenced the original engineering plans. submitted by our subcontractor Mayan Fencing. of what was believed to be the structure at the LoGuercio residence.

12/18/23. At the time of this inspection the inspector noted that AMMTEC had incorrectly published the certificate on Scottsdale letterhead instead of city of Phoenix letterhead. At this inspection, the inspector also informed us that the homeowner provided pictures of the structure that did not match what our subcontractor had submitted to us. It wasn’t until this point that we understood why the inspector was questioning whether or not beams were missing from his initial inspection when the ceiling of the ramada was already closed. To prevent having to take down the already finished tongue and groove ceiling, we previously discussed with the inspector how to avoid this. Our understanding was that if we were able to provide photos of the framing, welds, and cross beams and verify it to the engineering, exposing the ceiling to verify the rafters and beams, that tearing down the painted and finished tongue and groove ceiling would not be necessary. These pictures are what we had obtained from our subcontractor, and submitted to AMMTEC to obtain the special inspection certificate.

12/18/23 A new certificate had to be requested from the engineer on the proper city of Phoenix letterhead. Received 2/21/2024 ROC Legal

12/21/23 A new certificate on corrected Phoenix letterhead received from AMMTEC engineering. A day before the directive was set to expire.

12/22/23 - We notified the ROC inspector, via email, that we had received the revised certificate but needed more time to work on the corrections from the inspection. of this on 12/22/23 at 4:22pm and requested more time in order to address the inspection comments and close out the permit. We did not receive a response to our request on 12/22 for an extension.

From this point forward, Mr. Loguercio has not allowed us access to the jobsite to complete the necessary steps needed to close out the permit.

To summarize compliance item 15, once we received the directive we immediately began to resolve the issue. Due to circumstances outside our control we requested additional time to complete the inspection and were not given the opportunity.

We would like to request a formal hearing and be granted additional time to close out this project.

1. Introduction Caesarstone introduces the Outdoor Collection. For the first time, Caesarstone has combined the best of all it has to offer by taking the luxury of its much-loved surfaces to the outdoors. Its ground-breaking Outdoor Collection provides the convenience of stain- resistant, easy-to-clean surfaces, while innovating a highly durable material proven to withstand UV rays and the most extreme environmental conditions over the long term. The new Outdoor Collection provides an answer for consumers’ desire to cook, dine and entertain comfortably in an outdoor kitchen, come rain, snow or shine.

Caesarstone Outdoor performs the same as traditional Caesarstone in most aspects relating to fabrication, installation, repairs, and care & maintenance. Therefore, in most cases, the same procedures, tools and equipment can be used for both products.

There are, however, some minor differences, which are specified in this technical guide. Stonemasons and installers should use these guidelines in addition to the Caesarstone Fabrication & Installation Guide for optimum work with Caesarstone Outdoor.

Please note that Caesarstone Outdoor is not suitable for flooring and wall cladding.

3. Fabrication Guidelines Specific to Caesarstone Outdoor Caesarstone Outdoor contains up to 90% crystalline silica. Fabrication of Caesarstone Outdoor generates respirable dust which can be harmful and dangerous to your health when safe and correct fabrication techniques are not adhered to. For more information relating to respirable dust and the health impacts please refer to the Caesarstone Good Practice Guide – Steps to Avoid Health Hazards Related to Crystalline Silica Dust or Caesarstone’s online Master of Stone Training Centre at: mos.caesarstone.com.au.

Caesarstone Outdoor slabs offer stonemasons all the same advantages of easy fabrication as traditional Caesarstone. Due to the different composition, Caesarstone Outdoor slabs emit a smell during fabrication that is different from traditional Caesarstone.

It may be necessary to exert slightly more pressure when working manually.

Set the RPM at 1600.

3.1 Laminated Edges

Due to the high heat transfer around BBQ areas, we recommend that the 20 mm slab is used for edges without reverting to a thicker mitred edge to reduce the risk of delamination.

For thicker edges, a butt edge / laminated edge is the recommended option for an edge more than 20 mm. Glue a strip of 20 mm thickness and at least 70 mm depth underneath the surface as shown below:

4. Slab Cleaning During the Fabrication Process At no time should acetone or thinners be used on Caesarstone quartz surfaces, including this Outdoor Collection, either:

Post install

Along with acetone, the use of products that contain trichloroethane or methylene chloride (such as paint removers or stripper) or cleaning agents which have high alkaline / pH levels is prohibited. If these products are used, the Caesarstone Limited Warranty becomes void.

Our recommended cleaning solutions during the fabrication process and post install are:

Methylated spirits / 100% alcohol / isopropyl alcohol

Always use a clean microfibre cloth that has not been used for other cleaning purposes, as it may transfer oils and other contaminants to the Caesarstone Outdoor surface.

For any stubborn stains that need removal prior to client handover, Caesarstone Crème Cleanser can be used with the addition of two drops of household bleach (e.g., White King Liquid Gel Bleach) directly onto a Scotch BriteTM Non-Scratch Foam Scrubber and used according to the recommended process in the Caesarstone Care & Maintenance Guide.

5. Installation Guidelines Specific to Caesarstone Outdoor

5.1 General Support Caesarstone Outdoor on a full substrate of concrete, brick or cement board. Do not use wood as it can swell in an outdoor environment.

5.2 BBQ Installation Guidelines

The enclosure, supporting structure and clearance requirements for BBQs can vary substantially between different makes and models. Every BBQ make and model has its own set of guidelines for installation. Please refer to the guidelines set out by the manufacturer. Always read and follow the BBQ manufacturer’s instructions for enclosure construction, ventilation and clearances from combustible materials and the surface.

The BBQ should be supported by a brick structure or a dedicated frame, not by the Caesarstone Outdoor surface.

The BBQ should not be completely surrounded by the surface – at least one side must be open.

Ensure that the BBQ pane is located above the level of the Caesarstone Outdoor surface.

Where BBQ clearances are not specified by the manufacturer, consider the clearance distances as described in the relevant standard for the BBQ appliance (such as AS/NZS 5601:1 2013) or as advised by a licensed gasfitter.

In any event, clearance between the BBQ and the edge of the cutout must be no less than 15 mm.

Create 5 mm seams that follow the BBQ edges.

Create seams for all inside corners around the BBQ or on appliance cutouts. A 5 mm seam is recommended for each corner seam (see diagram B).

If there is a wall behind the BBQ, the surface depth between the BBQ and the wall must be at least 200 mm (see diagram B).

Use of ceramic heat-resistant tape and heat-resistant, flexible, neutral cure silicone on the surround of the BBQ / appliance cutout is strongly recommended.

See the diagrams below as an example of specifications to be considered along with manufacturers recommendations.

Please note that non-compliant BBQ installations will void your Caesarstone Outdoor Warranty.

6. Adhesives Please note that Caesarstone Outdoor is an acrylic, polymer-based product. Please use appropriate material that will not damage the product.

To seam Caesarstone Outdoor use flexible, neutral cure silicone suitable for outdoor use or AKEMI® MS Adhesive Sealant, without silicone.

To connect Caesarstone Outdoor to the substrate or to install as a splashback use thin set. Latex-modified thin set such as LATICRETE® 254 Platinum is preferred.

To glue edges, use an adhesive suitable for outdoor use such as AKEMI® Everclear 225 or AKEMI® Hyperclear.

Thoroughly clean areas to be joined with alcohol.

When preparing joins, apply a layer of protection such as beige masking tape. Do not use blue painter’s tape as the adhesive in the tape may react chemically with the silicone and damage the surface. Any tape used should not be left on the surface for longer than the working period.

Alcohol is recommended for cleaning during installation. Use of acetone and thinners is forbidden on Caesarstone Outdoor and will void warranty.

Note: Before using, please read and follow the adhesive manufacturers' instructions. Pay attention to the guidelines regarding weather and temperature conditions at the time of application.

7. BBQ Type & Operation Do not use charcoal BBQs; the heat range cannot be regulated, and embers may damage the surface.

Do not use high-powered BBQs that reach extremely high temperatures as this may damage the surface or splashback.

Do not operate BBQs at temperatures above 370°C. Although this is not a surface temperature limit, operation at extreme temperatures may cause damage to surrounding surfaces.

Do not use self-cleaning options in BBQs; this setting may reach up to 538°C.

8. Care & Maintenance Care & maintenance, and stain removal for Caesarstone Outdoor are the same as for traditional Caesarstone. In addition, we recommend the following to keep your Caesarstone Outdoor looking its best:

Cover the surface when not in use.

Do not leave metal objects on the surface as they may cause rust stains.

Do not use deep fat fryers and turkey fryers on the surface.

Clean any stains or residue as soon as possible to prevent them from drying on the surface.

Do not use acetone or thinners.

It is essential that all Fabricators and Installers attempting to work with Diresco BIO- UV Quartz possess the proper knowledge, tools and safety equipment to produce an excellent final product. All Technicians involved in the handling and working of Diresco BIO-UV Quartz, must have proper training. Adhere to the recommendations laid forth in our ‘Golden Rules Book - Fabrication Manual’ to assure a quality finished product.

Received 2/21/2024 ROC Legal EDGE FINISH Diresco quartz offers a wide range of possibilities in edge finishing that greatly influence the kitchen’s appeal. Here below you find some examples. Always provide adequate support for mitered edges. Always remove the residual water from the surface, and never let it dry up.

Received 2/21/2024 ROC Legal CLEANING After cutting, always clean the finished pieces adequately with a professional composite cleaner after production, to remove the machining dirt/debris.

Always use sufficient water during polishing (edge finishing, wet areas/drainer grooves, recessed drain).

Never allow any water to remain or dry up on the surface, use a separate and clean non- contaminated squeegee to remove the water from the surface. Failure to remove water can result in permanent surface corrosion due to the alkaline dust (present in natural stone).

HANDLING FABRICATED MATERIAL Make all necessary observations before moving the finished pieces. • Always provide adequate support, especially if there are cut outs or any recessed areas • Always transport the material in a vertical upright position. • Make sure all suction cups are clean. • Ensure Diresco BIO-UV slabs and Diresco machined workpieces are always supported before, during and after the fabrication and installation process.

STORING FARICATED MATERIAL Finished pieces are best stored away from direct exposure to UV light/moisture and inside a dry and dust free environment. Material must be stored in a vertical position and on an A-frame. Make sure material is fully supported.

Make sure that the polished face of the finished piece does not come into contact with items (including ‘slab dividers’ or ‘protectors’) that might carry any silicon residue and/or alkaline dust that can permanently mark (contamination) the finished slab face.

In order to avoid potential breakage make sure to have full support under the material. We recommend the use of concrete board. Plywood or marine plywood are subject to increased swelling due to thermal expansion and contraction and must never be used used.

Diresco BIO-UV Quartz must be laid on a flat, level and structurally sound substrate. The substrate must span the entire surface area of the workpiece. Diresco recommends the use of concrete board anchored to the cement block or structure below. Once the substrate has been installed, check to ensure the substrate is perfectly level.

HOW TO BOND DIRESCO BIO-UV QUARTZ TO CONCRETE BOARD

You must use either a polymer based epoxy or thin set to adhere Diresco BIO-UV Quartz to concrete board. Never use Silicone, Caulking, Liquid Nail or similiar glue. The addhesive used must be climate appropriate.

For the purpose of example - Laticrete - 254 Platinum is an appropriate product for adhereing Diresco BIO-UV Quartz to the concrete board substrate.

Received 2/21/2024 ROC Legal HOW TO APPLY THIN SET Clean both, the concrete board substrate and back of the Diresco BIO-UV Quartz countertop. It is important the surfaces in contact with the thin set be free of all dirt and debris in order to increase the bonding force.

Using the double bonding method, apply adhesive to both surfaces, the concrete board substrate and back of the Diresco BIO-UV Quartz using a Notched Trowel 10mm, in perpendicular directions.

Thr process of handling and installing machined workpieces requires tremendous care and awareness. All material must be handled with the utmost control, paying attention to corners and cutouts.

To avoid chipping of the top at the time of installation Diresco recommends the use of adhesive tape, cardboard or shims to protect the joint edges during positioning, and performing final positioning by means of a vacuum clamp seaming tool.

BEST PRACTICES The process of handling and installing machined workpieces requires tremendous care and awareness. All material must be handled with the utmost control, paying attention to corners and cutouts.

For a cooktop, range, or BBQ insert cut out we require 2 layers of the insulation tape as long as minimum thickness of each layer is 0.11”/layer and a minimum weight of 9.5 oz/yd2/layer.

The gaps and tolerances for Diresco installed in an exterior application are:

Any and all cut-outs for the BBQ’s, cooktops, and ranges must be a minimum 3/4” radius.

The inside edge must be smooth around the interior of the cut-out.

Remove cut lines and chipping before applying the heat tape. (Minimum120 grit is recommended)

Ease the top and bottom edges of the cut-out.

Provide a minimum gap of 1/2” between BBQ and the edge of cut-out.

The barbecue must be held up by a suitable substrate rather than rest directly on the finished surface. This solution means the weight of the barbecue is not borne directly by the edges of the top.

Make sure there is adequate support under the substrate. It is imperative the substrate does not bow or fail in the future. Provide sufficient support by installing a full support rail/beam underneath substrate.

Use adhesives that have a very high resistance to shock and impact loads. Check with your supplier for a wide variety of colored adhesives for almost any application.

When using adhesives (always acid free) for a joint, first make sure that the material’s edges on both sides of the joint are taped off with a good quality - solvent free - tape to prevent staining when trying to remove excess epoxy next to the joint.

In particular, the anticato finish of Diresco requires extra attention as the rougher and open surface makes it very difficult to remove residue of glue/silicone afterwards.

When removing any residues of epoxy, do not put contaminated cloths or items on the stone surface. Due to their composition, some products (f.i. acetone, epoxy removers, nail polish remover, etc.) can permanently damage the surface finish of the Diresco BIO-UV surface and should never be used. Even when a product evaporates immediately (f.i. acetone), a damaging invisible layer remains behind.

Always follow the manufacturer’s instructions.

For lamination and joints we recommend an outdoor – epoxy bonder like Integra Bonder Ultra

The following are general requirements and instructions for processing the Special Structural Inspections Program form and general information for persons responsible for the special inspections. GENERAL REQUIREMENTS. Phoenix Building Construction Code (PBCC) Sections 110.3.10 and 1704 require Special Structural Inspections for the types of work specified in Section 1705.1. Special Structural Inspections include, but are not limited to, observation of the work assigned for conformance with the approved design drawings and specifications, and submission of appropriate inspection reports to the City of Phoenix Structural Inspector. See the PBCC and PBCC Regulations/Interpretations for additional information and requirements. The Special Structural Inspector shall be a qualified person who demonstrates competence to the satisfaction of the building official for the type of work requiring Special Inspection. Competence shall be demonstrated by licensure as a Professional Engineer in the State of Arizona or successful application to the city’s certified list. These individual(s) shall be responsible for performing the Special Inspection tasks and reports required by the PBCC and PBCC Regulations. The Special Structural Inspector(s) shall be an independent, third-party individual or testing agency and shall not be the installing contractor or any other person responsible for the work.
