The continued hearing in this matter was scheduled to convene on March 19, 2024, at 1:00 p.m. On the date and time set for hearing, Edward Marko, Esq. represented Complainant Sunstate Equipment Company, LLC. Respondent KYBA Building Group, LLC did not appear notwithstanding proper notice. After the grace period for appearance expired, Mr. Marko informed the Tribunal that he was withdrawing the Complaint filed in this matter.

Based on the withdrawal of the Complaint,

IT IS HEREBY ORDERED that the hearing in this matter is vacated from the calendar of the Office of Administrative Hearings.

IT IS FURTHER ORDERED remanding this matter to the Arizona Registrar of Contractors for further action.
