If you have requested to appear in-person at the hearing, the hearing will

be held at 1740 W Adams Street, Phoenix, AZ 85007.

You must attend this hearing. This is an adversarial hearing before an administrative law judge, and is conducted in a similar manner as judicial proceedings. Thus, you must be prepared to present evidence, including witness testimony and documents, in support of your case.

STATEMENT OF LEGAL AUTHORITY AND JURISDICTION The State of Arizona has determined that the licensing and regulation of construction contractors is a proper state function, and has vested authority in the Registrar of Contractors

to administer Title 32, Chapter 10 of the Arizona Revised Statutes. A.R.S. §§ 32-1101 et seq.

All hearings for alleged violations of Title 32, Chapter 10 are conducted under Title 41,

Chapter 6, Article 10. A.R.S. § 32-1156.

The statutes and rules governing the hearing can be found at: Arizona Revised Statutes §§ 41-1092 to -1092.12, and Arizona Administrative Code R2-19-101 to -122. PARTICULAR ARIZONA STATUTES AND RULES INVOLVED The statutes and rules the Respondent is alleged to have violated are cited in the complaint and citation, which were served on the Respondent on December 13, 2023.

SHORT AND PLAIN STATEMENT OF THE MATTERS ASSERTED The complaint and citation allege that the Respondent committed the following act(s):

THE PARTIES TO THE ADMINISTRATIVE HEARING

Because Respondent is a licensee and is charged with an act(s) or omission(s) that is cause for the suspension or revocation of a license, Respondent is a party to this case and will be a party to the hearing. Because Complainant alleged Respondent committed an act(s) or omission(s) that is cause for the suspension or revocation of a license, Complainant is a party to this case and will be a party to the hearing.

Respondent and Complainant, as the parties to the hearing, will present evidence and

argument to the administrative law judge.

The Registrar’s assigned investigator will appear as a witness at the hearing.

RIGHT TO BE REPRESENTED The parties to the administrative hearing may choose to be represented by an attorney. A.R.S. § 41-1092.07(B). If one of the parties is a company, the company may be represented by an officer or employee if that person satisfies the conditions set forth in A.R.S. § 32- 1156(B).

CHANGE OF ADDRESS Each party must inform the Registrar and the Office of Administrative Hearings of any change of address within five (5) days of the change. A.R.S. § 41-1092.04.

HEARING PROCEDURES AND RULES The administrative hearing will be conducted in accordance with A.R.S. §§ 41-1092 to -1092.12, and A.A.C. R2-19-101 to -122. The parties should review the statutes, rules, and processes governing the administrative hearing. REGISTRAR’S APPEARANCE BY VIDEO CONFERENCE OR TELEPHONE The Registrar’s investigators, employees, and attorneys will appear at the hearing via video conference or telephone unless requested by a party to appear in-person. Requests for the Registrar’s investigators, employees, or attorneys to appear in-person must be filed with the Registrar and the Office of Administrative Hearings no later than seven (7) calendar days prior to the hearing date.

HEARING PACKET In the interests of administrative efficiency, the Registrar compiles and discloses

certain documents to the parties and the Office of Administrative Hearings. These documents

are attached to this Notice of Hearing as the “Hearing Packet.” If any party wishes to submit

additional evidence, they must do so during the hearing after completing a disclosure statement. See “Disclosure Statement” section below. SUBPOENAS FOR TESTIMONY FROM A WITNESS OR DOCUMENTS The parties to the hearing must be prepared to present evidence in support of their

case. If a party wants to obtain testimony from a witness or documents not in the party’s

possession, the party must prepare and file a written subpoena for the Administrative Law

Judge to review and sign, if approved. A.R.S. § 41-1092.07(C). Forms for requesting a

subpoena can be found on the Office of Administrative Hearings’ website at www.azoah.com. The party seeking a subpoena must serve notice on all the parties to the hearing, and on the Registrar. A.R.S. § 41-1092.04.

DISCLOSURE STATEMENT

At least seven calendar days before the hearing, each party must prepare and serve a disclosure statement on all other parties, and file it with the Office of Administrative Hearings. A.A.C. R4-9-118; A.A.C. R2-19-108. The disclosure statement must include any exhibit the party will use at the hearing. A party’s failure to timely disclose any witness or exhibit, without good cause, may result in the administrative law judge excluding those witnesses or exhibits from being used at the hearing. CHANGING THE HEARING DATE The date of the hearing may only be advanced or delayed on the agreement of the parties or on a showing of good cause. A.R.S. § 41-1092.05(C). The date of the hearing may be changed by filing a written agreement of the parties to change the date of the hearing. The written agreement must be filed with the Office of Administrative Hearings, directed to the assigned Administrative Law Judge, and transmitted to the Registrar and all other parties. The assigned Administrative Law Judge may be found on the Office of Administrative Hearings’ web portal at www.azoah.com If a party would like to move the date of the hearing without agreement of all parties,

the party must file a written motion with the Office of Administrative Hearings, directed to the

assigned Administrative Law Judge, and transmit a copy to the Registrar and all other parties.

The motion must state in detail good cause for why the date of the hearing should be advanced or delayed, and the position of all other parties regarding the advancement or delay. A party may also file a motion asserting a right to an expedited hearing upon a showing of extraordinary circumstances or the possibility of irreparable harm. A.R.S. § 41-1092.05(E).

RESOLUTION SHORT OF ADJUDICATION In any case which is resolved or settled by the parties, or which is withdrawn by the Complainant without objection from Respondent after the Notice of Hearing is issued, the parties must notify the Office of Administrative Hearings of the resolution or settlement. The Hearing Packet is a packet of certain documents collected or issued by the Registrar over the course of its investigation.

Who gets the Hearing Packet?

The Hearing Packet is assembled and distributed to all parties and to the Office of Administrative Hearings (“OAH”) prior to an administrative hearing.

What types of cases does the Registrar prepare a Hearing Packet for?

The Registrar prepares a Hearing Packet for Complainant-Handled Cases and No-Pay Cases. Note: If the Docket Number on the Notice of Hearing contains a “CHC” or “NPC”, your case is a Complainant-Handled Case or a No-Pay Case.

What is in the Hearing Packet?

If there is additional evidence you submitted to the Registrar during the investigation that you also want to introduce as evidence during your hearing, it is your responsibility to:

Jobsite Inspection Notice Re: Complaint Number 2023-08771

Dear Complainant and Respondent:

A formal complaint has been filed with the Arizona Registrar of Contractors.

A jobsite inspection is scheduled for September 5, 2023 at 9:00 AM. The Complainant is required to be present. The Respondent’s attendance is requested and encouraged. The Registrar encourages both parties to make a good faith effort to resolve this complaint prior to the jobsite inspection.

COMPLAINANT: 1. Under A.R.S. § 32-1155(D)(1), the Respondent must be allowed, upon request, the opportunity to inspect the work complained of within fifteen (15) days of receiving this notice. If Respondent is not provided an opportunity to inspect the work within the fifteen (15) day time period, the Registrar may be prohibited from taking further action on this complaint. 2. The Registrar may also be precluded from taking further action on this complaint, if the work that is the subject of the complaint is subject to neglect, modification, or abnormal use. A.R.S. § 32-1155(D)(2) 3. You must provide safe access to any area to be inspected. If access to a roof or other elevated area is required, you must provide a means to safely access the area (ladder or manlift as appropriate). Additionally, please secure any animals.

RESPONDENT: 1. Enclosed is a copy of the complaint. Under A.R.S. § 32-1155(D) you must be allowed, upon request, the opportunity to inspect the work complained of within fifteen days of the date of receipt of this notice. 2. To assist the assigned investigator in evaluating the merits of the complaint, please submit a response to the enclosed complaint to the assigned investigator prior to the scheduled inspection. 3. If you do not attend the jobsite inspection, your absence may negatively impact the investigation, and your interests. 4. Purpose of the Jobsite Inspection When the Registrar receives a complaint against a contractor’s license alleging poor workmanship, the Registrar generally schedules a Jobsite Inspection. The Jobsite Inspection serves two purposes: 1. To give the contractor an opportunity to inspect the complaint items; and 2. To give the Registrar an opportunity to determine if the contractor’s work violates Arizona law.

Jobsite Inspection Rights and Responsibilities Access to inspect: The property owner has complete control over who they allow on the property. However, if the Registrar’s investigator or the contractor cannot inspect the work, the Registrar will not move forward with a citation.

Cooperation: Arizona law enables injured parties to seek relief for damages through several paths. When dealing with a licensed contractor, the Registrar of Contractors’ administrative complaint process may serve as one of those possible paths. However, in order to use that path, the Registrar relies on the cooperation of all parties to a complaint.

Minimum workmanship: The Registrar investigates workmanship complaints for compliance with minimum workmanship and professional industry standards. The Registrar does not issue citations for work that meets these standards.

Scope: The scope of the Jobsite Inspection is limited to items listed in the complaint filed with the Registrar’s office. It is the complainant’s responsibility to point out the complaint item(s) and the Investigators role to review the item(s). If the complainant identifies additional workmanship items not listed in the original complaint, they must file an addendum to the complaint. The Registrar’s Investigator may identify additional administrative violations by the contractor (e.g. work performed out of scope of the license and failure to provide a contract that meets requirements set by Arizona law) at the time of the inspection.

The Role of the Investigator At the Jobsite Inspection, the Registrar’s investigator will: ● Only investigate the items listed on the complaint form filed with the Registrar. ● Will gather evidence to make an informed decision about the complaint items.

What to expect after a Jobsite Inspection After doing a Jobsite Inspection, the Registrar’s Investigator will leave the jobsite and review the evidence provided during the inspection. Generally, the investigator does not make any determination at the time of the jobsite inspection regarding whether the allegations listed in the complaint are supported. ● If the allegations are confirmed, the Registrar’s Investigator may issue a Written Directive telling the contractor to correct the poor or incomplete work. ● If the allegations are not confirmed, the Registrar’s Investigator will close the complaint.

Written Directives Access: In order to use the administrative process offered by the Registrar, a property owner must provide reasonable access to allow the contractor to fix their work as directed by the Registrar in a Written Directive. Complainants may not put any additional, unnecessary restrictions on the Respondent above and beyond the initial contract requirements agreed upon at the beginning of the project. Respondents are required to make repairs on items identified on any Written Directive, not otherwise restricted by local code or HOA limitations. Complainants must make access available to the Respondent to make the required repairs and failure to provide reasonable access may result in the Registrar dismissing the complaint.

Contractor obligations: The Written Directive will set a deadline for compliance. This is the period of time determined by the Investigator as necessary to complete the items listed in the Directive. ● The deadline for compliance assumes the contractor will promptly begin working on the items listed in the Directive. ● Do not wait. Both parties should communicate quickly to schedule the work.

Extensions: If good cause exists to extend this deadline, either party may submit a written request to the Investigator. The Registrar will review requests for extension and determine if the Directive should be extended.

Manner and method of performance: The Registrar does not provide specific instructions for how to correct poor work. A licensed contractor is expected to have the skill and professionalism to complete the work. Moreover, the complainant may not dictate the manner of repair. If the contractor fails to appropriately correct the work according to the contract, the Registrar will issue a citation.

Compliance Inspection: After the Written Directive expires, the Registrar’s Investigator will contact the complainant to determine if the contractor performed any corrective work. ● If the contractor did corrective work, the Investigator may schedule a Compliance Inspection to determine if the poor work is corrected. ● If the contractor did not perform any corrective work, the Registrar’s Investigator will not do a Compliance Inspection and will determine whether to issue a citation based on the administrative record.

The Registrar encourages parties to work cooperatively, but cannot require a homeowner to continue to allow a contractor access to the property after the Directive period ends in order for the administrative process to continue. Denying access after the Directive ends is not grounds to close or dismiss a complaint.

The Jobsite Inspection serves two purposes: 1. To give the contractor an opportunity to inspect the complaint items; and 2. To give the Registrar an opportunity to determine if the contractor’s work violates Arizona law.

What to expect after a Jobsite Inspection After doing a Jobsite Inspection, the Registrar’s Investigator will determine whether the allegations listed in the complaint are supported. ● If the allegations are confirmed, the Registrar’s Investigator may issue a Written Directive telling the contractor to correct the poor or incomplete work. ● If the allegations are not confirmed, the Registrar’s Investigator will close the complaint.

Written Directives Access: In order to use the administrative process offered by the Registrar, a property owner must provide reasonable access to allow the contractor to fix their work as directed by the Registrar in a Written Directive. Complainants may not put any additional, unnecessary restrictions on the Respondent above and beyond the initial contract requirements agreed upon at the beginning of the project. Respondents are required to make repairs on items identified on any Written Directive, not otherwise restricted by local code or HOA limitations. Complainants must make access available to the Respondent to make the required repairs and failure to provide reasonable access may result in the Registrar dismissing the complaint.

Contractor obligations: The Written Directive will set a deadline for compliance. This is the period of time determined by the Investigator as necessary to complete the items listed in the Directive. ● The deadline for compliance assumes the contractor will promptly begin working on the items listed in the Directive. ● Do not wait. Both parties should communicate quickly to schedule the work.

Extensions: If good cause exists to extend this deadline, either party may submit a written request to the Investigator. The Registrar will review requests for extension and determine if the Directive should be extended.

Manner and method of performance: The Registrar does not provide specific instructions for how to correct poor work. A licensed contractor is expected to have the skill and professionalism to complete the work. Moreover, the complainant may not dictate the manner of repair. If the contractor fails to appropriately correct the work according to the contract, the Registrar will issue a citation.

Compliance Inspection: After the Written Directive expires, the Registrar’s Investigator will contact the complainant to determine if the contractor performed any corrective work. ● If the contractor did corrective work, the Investigator may schedule a Compliance Inspection to determine if the poor work is corrected. ● If the contractor did not perform any corrective work, the Registrar’s Investigator will not do a Compliance Inspection and will determine whether to issue a citation based on the administrative record.

The cabinet contractor is telling me he will complete everything this weekend. Great... except certain tasks (toe kicks and some upper cabinetry should ideally be accomplished after the floor and granite contractors are done with their intermediate steps. This was the original plan.

However he's claiming he can't wait for them now citing the need to finish before the inspection. He's told me if we close the complaint he will wait on them.

The thing is, I've had to reschedule the other folks several times due to the delays with the cabinets so don't feel it's right for him to be unwilling to wait on them.

Another issue - we had asked for months for samples of some stains and pictures of designs. He finally sends some this weekend while my wife was with our newborn twins in the NICU and asking for an answer ASAP regarding which one we want so he can finish before the inspection.

I feel like he's using my complaint as an excuse to rush things when for months I kept asking for updates knowing my wife was due in Aug and that id made clear to him at the time we didn't want to be in this situation.

To summarize: can I sign off on a list of things I want to wait on in order to get them done correctly? That way he won't use the inspection as an excuse? Or should I cancel my complaint? For what it's worth he seems very concerned about the complaint and it appears to be the only reason he's communicating after weeks of not answering my calls/emails.

Hi. I am emailing you as someone who has lived through this cabinet installation on a near daily basis with serious concerns about the integrity of the cabinets and time it is taking to finish the job. I appreciate your time and assistance.

We opened up an AROC complaint in August against CA custom woodworks after months of being ghosted by them. Upon receipt of the complaint the owner, Angel Alvarado promised us if we suspended the complaint he would get our job done efficiently and we would be happy with the product. In fact, he told us installation would take 3 days to a week. From talking to other people who have had cabinets installed, it seems 1-2 weeks is the norm. Trusting his word, we suspended the complaint. When the complaint was open he had two installers at our home and things were moving along. Soon after we closed it, he sent one installer, who showed up at variable times on variable days. I know this because I have newborn twins and have been on maternity leave since the day they started. My twins are now 2 months old, and our project is still not finished.

We have had multiple issues with the project including sloppy, incomplete work by the installer who has also exhibited erratic and dishonest behavior. For example of his dishonesty, he damaged the island upon installation. He told me, as seen on my home security, that he damaged the island. Later, we were told by Angel, the owner, that we were responsible for the damaged island as he blamed us for the damage. I informed him that I had his installer, Ariel, on my home security telling me he was sorry he damaged the island and would get it fixed. However, Angel told us that Ariel told him we damaged it.

After 7 weeks of no resolution and cabinets still not even close to complete, I took to facebook asking on a local community page if this sort of thing was normal with custom cabinets? I had multiple comments telling me we needed to reopen the AROC complaint and no it was not normal. Many commenters asked me for the name of the company, CA Custom Woodworks, so they could avoid them. This got back to Angel and now all of a sudden, he was responsive to us.

I told Angel he could make it right by finishing in the next week or two, taking 20% off the final cost (after all we have had no kitchen for 2 months and have spent a significant amount of money on meals out, staying at alternative locations as my babies have been in and out of the hospital and I cannot bring them home to the random days of loud drilling and dust), and finish our project in the next 1-2 weeks.

Here we are two weeks later and the project is still not complete. I did request a new installer and that the previous installer (Ariel) not return to my home. He left food and drink everywhere, left my front bathroom a mess, and had been given over 7 weeks to complete the job but couldn't complete it and cabinets he did complete often had to be redone. Angel agreed to send a new installer. However, it seems he fired the previous installer (Ariel) and blamed me. I am now being harassed via text by the previous installer threatening to sue me because I caused him to lose his job. It is extremely unprofessional for me to be blamed and now I feel quite vulnerable as a mom of 2 month old twins who have had this man in my home 4-5 days a week doing ????????? (not installing cabinets) now threatening me.

At this point, I ask that AROC facilitate getting this job done. We are over 8 weeks now of cabinet installation and my home is still in boxes.

We signed the contract and made the initial payment end of March, per the contract the cabinets were supposed to start 5 weeks from signing, then we were told June, then July (which is when we demoed the kitchen), then we were ghosted until we got AROC involved in August. From there, the cabinets were suppose to be installed in "3 days." I assumed it may be up to 4 weeks, but never in my wildest dreams did I think it would be October and the project still not finished. Yet the cabinet maker only cares about me posting online as I have learned from others in the community that he has several other jobs here and some of the owners of the other jobs have seen my post and are understandably upset as they do not want their project to take over 8 weeks of installation. Furthermore, now I am being harassed and threatened by his former installer and blamed for him being fired, when all I have done is ask for a new installer after giving this one a chance for 7-8 weeks.

Additionally, I had a friend helping me with the babies one day. She mentioned to me that when Ariel, the former installer, put in the hood he did not put it into a stud. We mentioned this to Angel the owner. Angel checked it out. He did not confirm or deny the allegation but he did reinstall the hood. Which leads me to believe it is true, otherwise why would he have redone the job? He also had to redo several other cabinets that were not done properly by Ariel. This, plus other incidents I am happy to discuss in person, have led me to question the integrity of this job. I have 4 small children and do not need a cabinet falling on one of them.

I am asking AROC to assist in getting this job complete as the timing has been excessive and to verify that the cabinets are done to the standard they are suppose to be done.

It should not take what is now over 8 weeks to install cabinets in a mid sized kitchen. I strongly feel after we agreed to suspend the initial complaint we were then sent one installer to simply placate us and make us believe CA custom woodworks was trying. And now I have serious concerns about the quality of the work, too. I hope that AROC can assist us in getting this job done and alleviating my concerns as a mom about the safety of my kids around these cabinets. In order to do that, I am requesting that we reopen the case.

Anthony Contractors will tell you they can put a lien on your home which they can, however the work has to be completed in order for them to do that. As far as the scheduling that is one of the biggest complaints we receive here in our office and unfortunately there is nothing we can do about good customer service. If you were to reopen the complaint the only thing I would be able to do is give them a deadline as to when to complete the job but not on their day to day scheduling

I have refused - telling him A) not everything has been delivered as we are missing some items B) some of it is damaged/scratched/dented and i want it fixed and am not comfortable with the workmanship and C) given that we are 3 months behind schedule and still not done, I don’t feel comfortable paying and then him not coming back to fix the damaged items in a timely manner. This was made worse when the contractor claimed we caused some of the damage despite his worker telling us it occured during transportation. And frankly I want more time to check up on his work.

The contractor has stated/threatened that he could put a lien on my property? Given the massive delays (deposit in March and expecting a June installation) and my concerns on workmanship what are my rights? I believe that some things were rushed and now done sloppily.

Another issue is the contractor has shown up intermittently and almost never communicates when they are coming (or not coming - ie they leave one day with work to do and we assume they are coming back the next day but don’t).

I’ve taken PTO to be home and then they don’t show up. Can we demand that he inform us the day prior if/when he plans on sending someone? We can’t sit around wondering if/when they might show up? (Everyone else we’ve worked with since -electrician, plumber, flooring has told us ahead of time the day/time they are coming and either stuck to it or contacted us if they were delayed).

My wife and I had preemie newborn twins in Aug and we’ve unfortunately had to make a few trips back to the NICU/ER which has been our priority. My wife is stressed that she never knows when someone is showing up and feels like she has to hide in the house just in case. (This is why we’re so upset about the 3 month delay and had made it clear that we needed the job done in June/July at the latest). Living without a functional kitchen the last 2.5 months as we demod in early July based on him telling us he’d start in mid July has been difficult for us.

To summarize: can I sign off on a list of things I want to wait on in order to get them done correctly? That way he won't use the inspection as an excuse? Or should I cancel my complaint? For what it's worth he seems very concerned about the complaint and it appears to be the only reason he's communicating after weeks of not answering my calls/emails.

Mr. Carter, Thank you for your time and attention to this matter. I regret that we ever closed our AROC complaint as we have dealt with significant delays (with no explanation of why) and issues with Mr. Alvarado and his company CA Custom Woodworks. We will not be suspending this complaint again. As you may recall, we demoed our kitchen July 8 on the word of Mr. Alvarado saying cabinet installation would start July 17 and take 3 days to a week. July 17 came and went with no call, no show, no responding to us at all. We got AROC involved and finally installation, which again was suppose to be 3 days to a week, started Aug 8.

It is now October 13 and we are STILL dealing with significant issues from an installation that should have never taken more than 2-3 weeks TOPS per my discussion with other custom cabinet makers and my discussion with other customers who have used Mr. Alvarado.

We are reopening the complaint now because here we are on week NINE of installation and still we are dealing with significant issues. Additionally, after sending only 1 installer (an installer who Mr. Alvarado admitted to us was very slow and he planned on firing after our job was complete) for 7 weeks, Mr. Alvarado is now trying to complete the project, but becoming frustrated with the amount of work this installer did incompletely or incorrectly and blaming that frustration on us. He is now trying to paint the picture of him as a contractor who has worked hard for 9 weeks, and us as unreasonable clients who just cannot be pleased. I think you will see from the issues we have dealt with over the past 9 weeks, and issues we are still having with the cabinets, that we are not unreasonable and Mr. Alvarado has failed to meet the industry standards for cabinet installation to this date.

The contractor, Mr. Alvarado is now responding but acting as if he has been doing solid work for 9 weeks and we are just not able to be pleased. I think a quick review of the case will show you that is FAR from the case as we can show you the major issues along the way and how they were (or weren't dealt with) as well as our communications with the other contractors who were waiting on Angel, not him on them. The issues now may be "minor" but I think after 9 weeks of a contractor in my home several times a week this job, that should have taken 2 weeks tops, should be flawless.

For 7 weeks he sent us one installer who damaged items and blamed us, left our home and project disgusting (which I will not detail too much here in this email as I am afraid it will get back to angel who will tell the installer. This installer is already angry and threatening me, but filthy is an understatement and I'm happy to elaborate if it can remain confidential), and whose work often was incomplete or had to be redone in the past two weeks. After 7 weeks of this installer coming and going around at my home doing (????!....not installing cabinets or cleaning) I asked for a new installer. Angel honored that. To my shock though, days later this initial installer was texting me (mind you he never could text to tell me when he was coming or going) threatening to sue me for him losing his job. This man, who after 7 weeks in my home, who walked right on top of my baby mats, who left my job incomplete, who parked behind me when I needed to get babies to appointments and would be an hour using my restroom unable to move his vehicle so I could leave for a babies appointment, this man was blaming me for getting fired and threatening to sue me for it. It is almost comical if it wasn't jarring.

I spoke with several custom cabinet makers around the country who told me installation at most should have taken no more than a week or two for our job unless there were material or other delays communicated to us (there were not). Furthermore I was out on a run when I saw a couple whose home I knew Angel recently did sitting on their front porch. I stopped to talk to them. They revealed that their job always had 2-5 installers at a time, and was done in 2-3 weeks! It was not a small job. They gave me the contact info of another person who recently used CA custom woodworks and that person told me the same. He always had 2-3 installers at his home and the job was complete in 2 weeks. Granted they both used some GC who gives angel significant amount of work, so he is motivated to please this guy. But we would have been more than happy to use this GC too had we been told it was in our benefit or even made aware that he existed and it was an option. I can only speculate why Angel treated us and our job differently but this talk with them was insightful. It's difficult not to think he just sent Ariel, who Angel told us he planned on firing after our job was done, to placate us and this abandonment complaint. But learning that it is not usual for his company to send one installer and take 9 weeks (and counting) is maddening. And in my mind, it is a form of job abandonment.

Acting as if there is nothing else he can do to make us happy. To send him a list of our petty complaints and he will fix them and not charge us another dime. And while we were never looking for discount cabinets, at this point, I agree that we do not owe him another dime. We have lived with a completely demoed kitchen since July 8. Only was it until the end of September, beginning of October could we could somewhat use it, but because cabinets are still incomplete or wrong the majority of my kitchen is still in boxes...since July 8. My husband, children and I have lived with cabinet installer disruptions in my home since early august, the entirety of my maternity leave. I've paid babysitters to help me with the twin newborns I had the day before installation started as I needed to manage the project or many times I was told it was done so I'd clean up the significant mess while a sitter watched my babies in my home (I'll attach pictures of the mess) left by the installers only to realize something was wrong and the mess I cleaned was made by them again. My efforts were futile and those moments I missed with my babies gone for nothing. So while I agree at the very least we don't owe another dime, I do not want it to be considered a settlement as I don't want to lose AROC protection. We have very little trust and faith in the integrity of this job.

On Wednesday, October 11, Mr. Alvarado sent his installer Carlos and his painter, to finish what he called "minor details." Promising that after they were done the job would be 100% complete and saying he wanted us to sign a 100% completion form at the end. (This is now another thing he is trying to get us to do, sign a "100% completion form." The two men worked from about 10 am to 6 pm fixing many issues (many of which were not minor). We could not use our kitchen again that day so as a family we left while they were here to go to dinner. At dinner, around 6 pm, we got a phone call from a man named Chris. Chris told us he checked the job and it was 100% complete and he needed us to come home to sign the form. I told Chris it had been 9 weeks since the job started and ask that he please give us a few days to inspect the job as our day to day lives are very busy and we were not going to pack up and leave dinner to immediately sign the form. Apparently, since we did not come home and sign the form, this man Chris, who we never met, took video inside our home without our permission. I realize this is not under the jurisdiction of AROC, but I feel it is important information. We have one employee (or former employee) of CA Custom Woodworks threatening me by text. And another one, who we have never met and were not even home when he was in our home, who has video of the inside of our home. This is illegal to do in Arizona without a homeowners permission. Furthermore, as you will see from our list of issues we still need fixed, I am not convinced this Chris was in my home to inspect the job or check the job as things were still missed. We ask for a copy of that video in our home and that the contractor not take any further video in our home. It is not us who has been dishonest or has lacked integrity in this situation.

We will not be forced to sign a 100% completion form as that is not in our contract and there is no trust in this job. We also ask that Mr. Alvarado meet the industry standard for our cabinets and fix these issues in a timely manner so we can have our home and kitchen back sans he and his people in it day after day for months on end. Also, per Arizona law, Mr. Alvarado and his employees are not to ever, ever, ever film or take pictures in our home without our explicit consent, which we will not give. Thus there should be no further pictures or videos of my home by Mr. Alvarado or any of this employees.

Here is a list of issues we still need fixed:

1. Drill holes for adjustable shelves are not consistent in size and many shelves are therefore not adjustable as the bracket (or pin) cannot go into the hole as it is too shallow or too narrow to fit even with significant force. 2. Stain on our floor that looks like some sort of putty from his installers. 3. Hole in the cabinet where it appears there was a screw. but is now missing needs to be fixed and/or explained. 4.Multiple shelves are too large to move them and therefore are not adjustable. If you try to move them you end up damaging the cabinets. 5. Other shelves are too small and do not sit properly. 6. Trash left behind sits in our courtyard. Disposal of materials is part of the agreement. 7. Cabinet door under sink needs to be adjusted 8. Multiple screws missing the cover plates 9. Bottom of appliance cabinet is dented 10. Multiple pencil marks--at this point can we just have the touch up paint to do ourselves? Are not able to scrub off. 11. Cabinet uppers to the right of the refrigerator appears to not be level.

If you need any pictures or documentation of the filth left behind from the contractors during these 9 weeks or of the issues we have been dealing with (to show you they are not minor issues) or emails/text to other contractors saying we have to delay them because the cabinets are still not ready, please let us know. We have all of this but given that it has been 9 weeks now it is too extensive to just add to the email. However we are happy to supply it to AROC per your request.

And I apologize if this email is wordy and emotional. It has been a long 9 weeks (longer since we demoed July 8) of living through this. Add to that a man who was in my home for 7 weeks doing who knows what now angry and threatening me, and another man I have never met taking video in my home and to say I feel like my home and space have been violated is an understatement. I just want this job finished.

I apologize as I am catching up and the list of possible issues is growing. I would like to add my concern for inspection:

- Potential paint quality with excessive number of scratches, scuff marks, discolorations on side of cabinets. Request contractor provide specifications for paint and finish and if/how it was cured. There is also excessive amounts of debris/sawdust in corners of panels that were not cleaned out and appear to have been spray painted over.

- I have concerns over the structural integrity of an 8' upper cabinet section where the face frame has been dislodged from the side frame and bottom fixed shelf. The gap was caulked over (photo attached). Furthermore the cabinet section appears uneven (using a laser level I measured it at just over 1/2" drop from one side to the other over 8' run).

We have had multiple issues with the project including sloppy, incomplete work by the installer who has also exhibited erratic and dishonest behavior. For example of his dishonesty, he damaged the island upon installation. He told me, as seen on my home security, that he damaged the island. Later, we were told by Angel, the owner, that we were responsible for the damaged island as he blamed us for the damage. I informed him that I had his installer, Ariel, on my home security telling me he was sorry he damaged the island and would get it fixed. However, Angel told us that Ariel told him we damaged it.

After 7 weeks of no resolution and cabinets still not even close to complete, I took to facebook asking on a local community page if this sort of thing was normal with custom cabinets? I had multiple comments telling me we needed to reopen the AROC complaint and no it was not normal. Many commenters asked me for the name of the company, CA Custom Woodworks, so they could avoid them. This got back to Angel and now all of a sudden, he was responsive to us.

I told Angel he could make it right by finishing in the next week or two, taking 20% off the final cost (after all we have had no kitchen for 2 months and have spent a significant amount of money on meals out, staying at alternative locations as my babies have been in and out of the hospital and I cannot bring them home to the random days of loud drilling and dust), and finish our project in the next 1-2 weeks.

Here we are two weeks later and the project is still not complete. I did request a new installer and that the previous installer (Ariel) not return to my home. He left food and drink everywhere, left my front bathroom a mess, and had been given over 7 weeks to complete the job but couldn't complete it and cabinets he did complete often had to be redone. Angel agreed to send a new installer. However, it seems he fired the previous installer (Ariel) and blamed me. I am now being harassed via text by the previous installer threatening to sue me because I caused him to lose his job. It is extremely unprofessional for me to be blamed and now I feel quite vulnerable as a mom of 2 month old twins who have had this man in my home 4-5 days a week doing ????????? (not installing cabinets) now threatening me.

At this point, I ask that AROC facilitate getting this job done. We are over 8 weeks now of cabinet installation and my home is still in boxes.

He also had to redo several other cabinets that were not done properly by Ariel. This, plus other incidents I am happy to discuss in person, have led me to question the integrity of this job. I have 4 small children and do not need a cabinet falling on one of them.

I am asking AROC to assist in getting this job complete as the timing has been excessive and to verify that the cabinets are done to the standard they are suppose to be done.

It should not take what is now over 8 weeks to install cabinets in a mid sized kitchen. I strongly feel after we agreed to suspend the initial complaint we were then sent one installer to simply placate us and make us believe CA custom woodworks was trying. And now I have serious concerns about the quality of the work, too. I hope that AROC can assist us in getting this job done and alleviating my concerns as a mom about the safety of my kids around these cabinets. In order to do that, I am requesting that we reopen the case.

Anthony Contractors will tell you they can put a lien on your home which they can, however the work has to be completed in order for them to do that. I have refused - telling him A) not everything has been delivered as we are missing some items B) some of it is damaged/scratched/dented and i want it fixed and am not comfortable with the workmanship and C) given that we are 3 months behind schedule and still not done, I don’t feel comfortable paying and then him not coming back to fix the damaged items in a timely manner. This was made worse when the contractor claimed we caused some of the damage despite his worker telling us it occured during transportation. And frankly I want more time to check up on his work.

The contractor has stated/threatened that he could put a lien on my property? Given the massive delays (deposit in March and expecting a June installation) and my concerns on workmanship what are my rights? I believe that some things were rushed and now done sloppily.

Another issue is the contractor has shown up intermittently and almost never communicates when they are coming (or not coming - ie they leave one day with work to do and we assume they are coming back the next day but don’t).

I’ve taken PTO to be home and then they don’t show up. Can we demand that he inform us the day prior if/when he plans on sending someone? We can’t sit around wondering if/when they might show up? (Everyone else we’ve worked with since -electrician, plumber, flooring has told us ahead of time the day/time they are coming and either stuck to it or contacted us if they were delayed).

My wife and I had preemie newborn twins in Aug and we’ve unfortunately had to make a few trips back to the NICU/ER which has been our priority. My wife is stressed that she never knows when someone is showing up and feels like she has to hide in the house just in case. (This is why we’re so upset about the 3 month delay and had made it clear that we needed the job done in June/July at the latest). Living without a functional kitchen the last 2.5 months as we demod in early July based on him telling us he’d start in mid July has been difficult for us.

I feel like he's using my complaint as an excuse to rush things when for months I kept asking for updates knowing my wife was due in Aug and that id made clear to him at the time we didn't want to be in this situation.

To summarize: can I sign off on a list of things I want to wait on in order to get them done correctly? That way he won't use the inspection as an excuse? Or should I cancel my complaint? For what it's worth he seems very concerned about the complaint and it appears to be the only reason he's communicating after weeks of not answering my calls/emails.

EXCHANGING DISCLOSURE STATEMENTS AND EXHIBITS Under A.A.C. R4-9-118(B) (effective November 5, 2017), a party to the hearing must serve on every other party and file with the Office of Administrative Hearings a copy of: • The disclosure statement; and, • Any exhibit that the party will use at the hearing. Service: The disclosure statement and exhibits must be served on all parties in accordance with Arizona Administrative Code R2-19-108 Filing Documents. Under A.A.C. CONSEQUENCES FOR FAILING TO DISCLOSE Under A.A.C. R4-9-108(C), if a witness or an exhibit is not timely disclosed as required the rules, and good cause for the failure to disclose is not shown, then the administrative law judge may: • Order that certain witnesses or exhibits not be used at the hearing; • Order that a particular fact is or is not established for the record; or, • Order that a charge, a defense, a claim, or some portion thereof, be dismissed.
