The assigned Administrative Law Judge, having reviewed the document Request for Reconsideration as filed on November 03, 2023, by Respondent hereby, makes the following minute entry:
On September 18, 2023, the Arizona Registrar of Contractors (“Registrar”) issued a Notice of Hearing for the above-captioned matter which set a hearing for November 03, 2023, at 9:00 a.m.
On October 13, 2023, Respondent submitted a Motion to Continue on the grounds that its attorney was unavailable for the scheduled hearing due to service “as an arbitrator in an out of state arbitration.”
On October 18, 2023, Complainant submitted its objection to Respondent’s motion.
On October 19, 2023, over Complainant’s objection, the matter was rescheduled for hearing to November 01, 2023, at 9:00 a.m. A Minute Entry – Granting Continuance was issued to the parties, which included remote participation information. Correspondence was not returned as undeliverable to either party.
On November 01, 2023, although afforded an approximately 15 minute grace period, there was no appearance by or on behalf of Respondent. No request was received on behalf of Respondent to continue or appear via alternative means. The matter was heard in Respondent’s absence.
On November 03, 2023, the undersigned issued a Recommended Decision to the Registrar’s Director. Shortly thereafter, the Office of Administrative Hearings (“OAH”) received Respondent’s Request for Reconsideration.
Because OAH no longer has jurisdiction over this matter,
IT IS ORDERED that the document, consisting of 11 pages, will not be considered as it was either inappropriately sent to OAH or no further action can be taken on the matter. Although the document will be retained in the file, it should not be responded to by any party.
