Purpose of the Jobsite Inspection When the Registrar receives a complaint against a contractor’s license alleging poor workmanship, the Registrar generally schedules a Jobsite Inspection. The Jobsite Inspection serves two purposes: 1. To give the contractor an opportunity to inspect the complaint items; and 2. To give the Registrar an opportunity to determine if the contractor’s work violates Arizona law.
Jobsite Inspection Rights and Responsibilities Access to inspect: The property owner has complete control over who they allow on the property. However, if the Registrar’s investigator or the contractor cannot inspect the work, the Registrar will not move forward with a citation.
Cooperation: Arizona law enables injured parties to seek relief for damages through several paths. When dealing with a licensed contractor, the Registrar of Contractors’ administrative complaint process may serve as one of those possible paths. However, in order to use that path, the Registrar relies on the cooperation of all parties to a complaint.
Minimum workmanship: The Registrar investigates workmanship complaints for compliance with minimum workmanship and professional industry standards. The Registrar does not issue citations for work that meets these standards.
Scope: The scope of the Jobsite Inspection is limited to items listed in the complaint filed with the Registrar’s office. It is the complainant’s responsibility to point out the complaint item(s) and the Investigators role to review the item(s). If the complainant identifies additional workmanship items not listed in the original complaint, they must file an addendum to the complaint. The Registrar’s Investigator may identify additional administrative violations by the contractor (e.g. work performed out of scope of the license and failure to provide a contract that meets requirements set by Arizona law) at the time of the inspection.
The Role of the Investigator At the Jobsite Inspection, the Registrar’s investigator will: ● Only investigate the items listed on the complaint form filed with the Registrar. ● Will gather evidence to make an informed decision about the complaint items.
What to expect after a Jobsite Inspection After doing a Jobsite Inspection, the Registrar’s Investigator will leave the jobsite and review the evidence provided during the inspection. Generally, the investigator does not make any determination at the time of the jobsite inspection regarding whether the allegations listed in the complaint are supported. ● If the allegations are confirmed, the Registrar’s Investigator may issue a Written Directive telling the contractor to correct the poor or incomplete work. ● If the allegations are not confirmed, the Registrar’s Investigator will close the complaint.
Questions? If you have already filed a complaint and it was assigned to an investigator, you are encouraged to contact that investigator directly with the information listed in your jobsite inspection letter.

The Jobsite Inspection serves two purposes: 1. To give the contractor an opportunity to inspect the complaint items; and 2. To give the Registrar an opportunity to determine if the contractor’s work violates Arizona law.

Written Directives Access: In order to use the administrative process offered by the Registrar, a property owner must provide reasonable access to allow the contractor to fix their work as directed by the Registrar in a Written Directive. Complainants may not put any additional, unnecessary restrictions on the Respondent above and beyond the initial contract requirements agreed upon at the beginning of the project. Respondents are required to make repairs on items identified on any Written Directive, not otherwise restricted by local code or HOA limitations. Complainants must make access available to the Respondent to make the required repairs and failure to provide reasonable access may result in the Registrar dismissing the complaint.
Contractor obligations: The Written Directive will set a deadline for compliance. This is the period of time determined by the Investigator as necessary to complete the items listed in the Directive. ● The deadline for compliance assumes the contractor will promptly begin working on the items listed in the Directive. ● Do not wait. Both parties should communicate quickly to schedule the work.
Extensions: If good cause exists to extend this deadline, either party may submit a written request to the Investigator. The Registrar will review requests for extension and determine if the Directive should be extended.
Manner and method of performance: The Registrar does not provide specific instructions for how to correct poor work. A licensed contractor is expected to have the skill and professionalism to complete the work. Moreover, the complainant may not dictate the manner of repair. If the contractor fails to appropriately correct the work according to the contract, the Registrar will issue a citation.
Compliance Inspection: After the Written Directive expires, the Registrar’s Investigator will contact the complainant to determine if the contractor performed any corrective work. ● If the contractor did corrective work, the Investigator may schedule a Compliance Inspection to determine if the poor work is corrected. ● If the contractor did not perform any corrective work, the Registrar’s Investigator will not do a Compliance Inspection and will determine whether to issue a citation based on the administrative record.

602.542.1525 · Toll Free 877.692.9762 · roc.az.gov C008 05/21 Work performed after the directive ends: After the Directive period ends, a property owner may choose to allow the contractor to continue its work. The Registrar encourages parties to work cooperatively, but cannot require a homeowner to continue to allow a contractor access to the property after the Directive period ends in order for the administrative process to continue. Denying access after the Directive ends is not grounds to close or dismiss a complaint.

Roof replacement on Dec 21, 2022. I have found damage in this new roof. There are things that have been left out. I will attempt to send other roof inspection documents. I have leaks/water spots that are new in the storage room/carport area. I found plywood that is broken/cracked/split, extensive split, water marked badly. A beam that is split. Pro-Tec said that I only get 13 "free" pieces of plywood. I would have to pay for any additional needed plywood. They would let me know as they go. They never informed homeowner if other damaged plywood needed to be replaced. Not good If I were to pick were my new plywood is applied, around the AC Unit would be my first spot. Common sense. *Plywood around AC Unit is bad from attic side. I was told as long as it can hold a nail and support shingles that it didn't have to be changed. The roof was wind and water damaged, to leave plywood like that can't be right. They put a rig vent on top of the roof. A long crack about half inch from opening on top of roof. Two spin vents were also on top of this roof Strange to have both. House is small. The quality of the shingles that were removed were 5 times the quality of what they laid down. ; The flat part of the roof, which is in the back room of the house, which is where the actual damage accrued , the replacement roof is wavey and mushy. It should be flat, firm, and strong.; The area where the shingles meet the flat roof, something is not correct about it. ; More storms came and water came in the hallway through the AC filter vent. Pro-Tec hired Powerful AC to deal with the AC Unit. They are called and they come out. First thing they said was that it is the roofers fault. The roofers failed to use enough tar around the Unit to keep it from leaking. They proceed to inform me that my Unit has been reinstalled by them with a stand that is not stable. That the vent is the wrong size and they can fix it for $1,900.00. Of course the Unit would have to be removed again. I got very upset because if stand, vent, floor jack needed to be replaced this surely should have been brought to the homeowners attention. I should have been given the opportunity to have it fixed when the roof work was being done. Is Powerful AC responsible for the Unit after admitting they reinstalled my Unit on a stand that is not stable? Why would they even do this? I have a air conditioning man that comes every 6 months to clean my coils on my AC unit. I called him to come out and take a look and he told me that my stand is fine. He told me that they forgot to put the flashing around unit and the way they sealed it was not correct. He Found The Panels of the Unit Laying on the Roof Floor, Evan the Electric ⚡ panel. The screws has been stripped. He put the panels back on the unit with bigger screws. Two storms came through as these jokers left my AC Unit open to the Elements of the storms. Who knows what damage that can be in the long run?? I was extremely mad now. I complained about the missing flashing. Jessy the owner stated to me that he knew that needed to be done and he wanted to fix it. Jessy and Two men from Pro-Tec came over. The two men were JC and Brenden. They went on the roof and came down and asked me, "what do you want us to do?" I said fix it right. That is all I am asking. Jessy lost the vote and the men told me, "No, they won't fix it." They tried saying stupid things like the Unit was installed incorrectly by the last guy. I have never had a problem with the fairly new unit before.

Pro-Tec sent photos of a Unit to my insurance company. This unit has major corrosion around the bottom of it. They were saying it was my unit . Just so happens that I took photos of my Unit when it was sitting on the driveway. It looks beautiful. I sent the pictures of my beautiful unit which showed them to be liar's. Fraud is the word that comes to mind. This kept the case open . I can't tell you how stressful this has been. I want the proper flashing around my unit. I want it properly sealed. It should not be an eye sore. I want the plywood replaced around the unit. I want it all done right, please. ; Now we have the back room. The entire lid was supposed to be replaced. He only did 1/4 of the lid. I asked him to please do it right. He said they get it written for a bit bigger job but only had to do what he thinks should be done to restore to about the same condition it was in. I told him where I come from that is called fraud. So that means he did not replace insulation that had gotten wet and other drywall from the ceiling that had also gotten wet. But got paid to do the entire ceiling, lid. That's not right.; Then we come to the South wall which he strips the drywall off and has me look at the insulation with him. He didn't replace the all the insulation that should have been replaced. There was Termite damage which lead to more out of pocket money. I want to cut into the wall and check for new insulation when you come for your visit. Please ; The wall facing West, with the sliding glass window was left out of the bid. You can plainly see the damage at the base boards I would like that fixed too. ; I had to pay for a new window. The window he put in is cracked. It is a small crack. I didn't make a big deal out of it because I am covering it up with foam anyway. ; Then we have the floor, I didn't think the title that was on my floor was still being made. I also didn't know that he was paid to pull up all the old floor and replace it with a new one. He and my friend said the old title can be restored and refinished. So I said we can try and see how it turns out. Anthony went to cleaning it up with a machine. It didn't look good I rented a machine and it came out a bit better. Anthony was not interested in fixing the title that had gashes, cracks or scratches on them. To match the grout was another big problem he was having. He wanted to come seal it but I was not happy with it. He surely didn't want to do the tear out and replacement of the tile. This is still left undone My baseboards got left outside and ruined. ; No one informed me that my stuff/property could be taken to a storage unit. So when Anthony would come over he would move all my stuff outside do his work and then leave. I was left with the problem of getting my stuff back inside because it had been raining around this time. After about the fifth time I couldn't do it anymore. I was out of money to hire people to help me do it anymore. I understand that they got paid to do this service for me. My stuff got ruined. ; I am hoping I didn't leave anything out. I hope you can understand what I am saying. I am the Trustee of this house. I can get into trouble for damage done to this dwelling. So far I'm not doing a very good job. I thought using the preferred contractor of the insurance company that I would be skipping all this kind of crap. But it certainly has not been the case. If you have any questions please feel free to call me at 480-679-9442 Sherry Peabody. I think you ahead of time for your time and attention regarding this matter. Sincerely, Sherry Peabody; The flashing around the AC Unit was left out. The contractors are Pro-Tec and Powerful AC. Now check this bunch of crap these guys pulled. Powerful AC was in charge of re-installing the AC Unit. I took a pic of my unit on the ground. After the roof job, it rains. Water comes in my hallway by way of my AC Unit. I call Pro-Tec and Anthony, Pro-Tec employee also called on my behalf. Powerful AC comes out and goes on the roof then proceeded to tell me that my AC stand is not is not strong enough to hold my AC Unit. They said that the bent vent was the wrong size for the floor jack. They can fix it for the right price of $1,900.00. I said that means you reinstalled my expensive AC Unit incorrectly and with liability. You should have said something to the home owner so I had the option of fixing this. Jessy of Powerful AC admits they screwed up by failing to do this. They forgot or incorrectly removed the flashing around the AC Unit.

R.O.C Complaint for Sherry Peabody
Hello, I am writing this letter to give an overview of the ROC Complaint for Sherry Peabody, at address; 8451 W Mackenzie Dr Phoenix, Arizona 85037. An ROC complaint was filed against Pro-Tec Contracting with some discrepancies from the work done on the home. We met Todd Anderon, an ROC Inspector, out on the property to thoroughly assess the claims made on the report. Todd himself got in the attic, as well as on top of the roof, inspecting numerous spots to distinguish whether or not Pro-Tec’s work met ROC guidelines. When we received the directives on what needed to be done, the instructions were to replace one sheet of plywood below the HVAC Unit, in addition to fixing the flat roof (Modified Bitumen), as there were two spots that did not seem to adhere correctly over time.
As we received this directive, It seemed pretty simple as what needed to be done. First thing, we got a hold of Sherry to set up a date and time for the team to meet our HVAC Crew with a crane on site, as the sheet of plywood needing to be replaced sits directly under the HVAC Unit. We did tear up about one square of shingles to properly replace the plywood, we proceeded to replace the shingles while our licensed HVAC Team re-installed the HVAC System. Second and last thing on the directive was the Flat Roof. Our team was on site to take care of the flat roof, we distinguished the problem areas. We peeled back a little section where it was lifting, we torched the underside of the Mod Bit and layed the flat portion back and at the time, it did adhere wonderfully.
Todd scheduled a time to meet with the Project Manager and Sherry to inspect the home one last time to make sure everything was done correctly. We met Todd out on the property, he inspected the piece of sheathing in the attic that was replaced and found that we did replace that correctly as it looked good. We proceeded to inspect the Flat Roof and once again found that over time it was lifting. We told Todd we will be out here to replace it, our project coordinator then scheduled a time with Sherry for our team with the project manager to replace the flat portion. We arrived on site and started to tear off, we ran into the issue that the sheathing underneath needed to be replaced because the underlayment would not tear off the plywood without damaging the wood. We replaced 12 sheets of plywood free of charge and re installed new modified bitumen. When we were finished, it looked great. Every avenue that was taken on Pro-Tec’s end, was taken to insure good standing work for the homeowner. There was constant communication between Sherry, Myself, and Todd Anderson. We would reach out to Todd the moment that we spoke to Sherry, to guarantee that nothing was missed.
