SECOND ORDER DENYING MOTION TO

CONSOLIDATE

On April 5, 2024, the Tribunal received a second joint motion to consolidate (Motion) this case with another case, stated to be Oxley v. Masonry and More stated to be set for May 31, 2024.

The joint Motion was filed by counsel in the Oxley v. Masonry and More case. Counsel indicate that both cases arise out of the same claims concerning the same work on the same property. On consideration of the Motion,

IT IS ORDERED the Motion is DENIED. Counsel’s stipulation does not include a stipulation by Complainant William Cook for a consolidation of the two separate matters. Complainant is entitled to an administrative hearing against Oxley Construction LLC dba G Oxley Construction based on the Complainant he filed, and the evidence to be presented therein, in the above-captioned matter. Should the parties herein wish to mediate this matter, they may request a mediation which the Tribunal is able to schedule.
