IN THE OFFICE OF ADMINISTRATIVE HEARINGS

Bonnie Lynn Spark,

COMPLAINANT,

v.

Hula Construction, Inc.

License No. ROC 261460,

RESPONDENT.

No. 2023A-07758-RFA-LS-ROC

ORDER GRANTING CONTINUANCE

AND SETTING STATUS DATE

The hearing of this matter was scheduled to convene on January 22, 2025, at 9:00 a.m. Complainant Bonnie Lynn Spark appeared on her own behalf. Respondent Hula Construction, Inc. did not appear. Assistant Attorney General Charles Hover III represented the Arizona Registrar of Contractors (“Registrar”). Meredith Bell appeared as a witness for the Registrar.

Prior to the commencement of the hearing, the parties in attendance participated in a prehearing discussion outside of the presence of the Administrative Law Judge. Following that discussion, the parties requested that the hearing be continued and set for a written Status Update in approximately thirty (30) days in order to provide the Registrar an opportunity to reconsider the proposed award, issue a possible Quash Order, and potentially issue a new Notice of Administrative Award. The parties’ request was granted.

Therefore, good cause appearing, the hearing in the above-entitled matter is continued and set for a written Status Update on February 24, 2025. On or before this date, counsel for the Registrar is advised to do one of the following:

Inform the Tribunal that the matter has been satisfactorily resolved by submitting a Motion to Vacate the hearing;

Inform the Tribunal that the parties need additional time to resolve the matter by submitting a Motion to Continue and reset for Status by 30-days, 45-days, or 60-days; or

Inform the Tribunal that the parties are unable to resolve their dispute and request that the matter be set for hearing.

Done this day, January 23, 2025.
