You must attend this hearing. This is an adversarial hearing before an administrative law judge, and is conducted in a similar manner as judicial proceedings. Thus, you must be prepared to present evidence, including witness testimony and documents, in support of your case.

STATEMENT OF LEGAL AUTHORITY AND JURISDICTION The State of Arizona has determined that the licensing and regulation of construction contractors is a proper state function, and has vested authority in the Registrar of Contractors

to administer Title 32, Chapter 10 of the Arizona Revised Statutes. A.R.S. §§ 32-1101 et seq.

All hearings for alleged violations of Title 32, Chapter 10 are conducted under Title 41,

Chapter 6, Article 10. A.R.S. § 32-1156.

PARTICULAR ARIZONA STATUTES AND RULES INVOLVED The statutes and rules the Respondent is alleged to have violated are cited in the complaint and citation, which were served on the Respondent on October 11, 2023.

SHORT AND PLAIN STATEMENT OF THE MATTERS ASSERTED The complaint and citation allege that the Respondent committed the following act(s):

THE PARTIES TO THE ADMINISTRATIVE HEARING

Because Respondent is a licensee and is charged with an act(s) or omission(s) that is cause for the suspension or revocation of a license, Respondent is a party to this case and will be a party to the hearing. Because Complainant alleged Respondent committed an act(s) or omission(s) that is cause for the suspension or revocation of a license, Complainant is a party to this case and will be a party to the hearing.

Respondent and Complainant, as the parties to the hearing, will present evidence and

argument to the administrative law judge.

The Registrar’s assigned investigator will appear as a witness at the hearing.

RIGHT TO BE REPRESENTED The parties to the administrative hearing may choose to be represented by an attorney. A.R.S. § 41-1092.07(B). If one of the parties is a company, the company may be represented by an officer or employee if that person satisfies the conditions set forth in A.R.S. § 32- 1156(B).

CHANGE OF ADDRESS Each party must inform the Registrar and the Office of Administrative Hearings of any change of address within five (5) days of the change. A.R.S. § 41-1092.04.

HEARING PROCEDURES AND RULES The administrative hearing will be conducted in accordance with A.R.S. §§ 41-1092 to -1092.12, and A.A.C. R2-19-101 to -122. REGISTRAR’S APPEARANCE BY VIDEO CONFERENCE OR TELEPHONE The Registrar’s investigators, employees, and attorneys will appear at the hearing via video conference or telephone unless requested by a party to appear in-person. Requests for the Registrar’s investigators, employees, or attorneys to appear in-person must be filed with the Registrar and the Office of Administrative Hearings no later than seven (7) calendar days prior to the hearing date.

HEARING PACKET In the interests of administrative efficiency, the Registrar compiles and discloses

certain documents to the parties and the Office of Administrative Hearings. These documents

are attached to this Notice of Hearing as the “Hearing Packet.” If any party wishes to submit

additional evidence, they must do so during the hearing after completing a disclosure statement. See “Disclosure Statement” section below. SUBPOENAS FOR TESTIMONY FROM A WITNESS OR DOCUMENTS The parties to the hearing must be prepared to present evidence in support of their

case. If a party wants to obtain testimony from a witness or documents not in the party’s

possession, the party must prepare and file a written subpoena for the Administrative Law

Judge to review and sign, if approved. A.R.S. § 41-1092.07(C). Forms for requesting a

subpoena can be found on the Office of Administrative Hearings’ website at www.azoah.com. The party seeking a subpoena must serve notice on all the parties to the hearing, and on the Registrar. A.R.S. § 41-1092.04.

DISCLOSURE STATEMENT At least seven calendar days before the hearing, each party must prepare and serve a

disclosure statement on all other parties, and file it with the Office of Administrative Hearings.

A.A.C. R4-9-118; A.A.C. R2-19-108. The disclosure statement must include any exhibit the

party will use at the hearing. A party’s failure to timely disclose any witness or exhibit, without good cause, may result in the administrative law judge excluding those witnesses or exhibits from being used at the hearing. CHANGING THE HEARING DATE

The date of the hearing may only be advanced or delayed on the agreement of the parties or on a showing of good cause. A.R.S. § 41-1092.05(C). The date of the hearing may be changed by filing a written agreement of the parties to change the date of the hearing. The written agreement must be filed with the Office of Administrative Hearings, directed to the assigned Administrative Law Judge, and transmitted to the Registrar and all other parties. The assigned Administrative Law Judge may be found on the Office of Administrative Hearings’ web portal at www.azoah.com If a party would like to move the date of the hearing without agreement of all parties, the party must file a written motion with the Office of Administrative Hearings, directed to the

assigned Administrative Law Judge, and transmit a copy to the Registrar and all other parties.

The motion must state in detail good cause for why the date of the hearing should be advanced

or delayed, and the position of all other parties regarding the advancement or delay.

A party may also file a motion asserting a right to an expedited hearing upon a showing of extraordinary circumstances or the possibility of irreparable harm. A.R.S. § 41-1092.05(E).

RESOLUTION SHORT OF ADJUDICATION

In any case which is resolved or settled by the parties, or which is withdrawn by the

Complainant without objection from Respondent after the Notice of Hearing is issued, the parties must notify the Office of Administrative Hearings of the resolution or settlement. Jobsite Inspection Notice Re: Complaint Number 2023-06894

Dear Complainant and Respondent:

A formal complaint has been filed with the Arizona Registrar of Contractors.

A jobsite inspection is scheduled for July 11, 2023 at 1:30 PM. The Complainant is required to be present. The Respondent’s attendance is requested and encouraged. The Registrar encourages both parties to make a good faith effort to resolve this complaint prior to the jobsite inspection.

COMPLAINANT: 1. Under A.R.S. § 32-1155(D)(1), the Respondent must be allowed, upon request, the opportunity to inspect the work complained of within fifteen (15) days of receiving this notice. If Respondent is not provided an opportunity to inspect the work within the fifteen (15) day time period, the Registrar may be prohibited from taking further action on this complaint. 2. The Registrar may also be precluded from taking further action on this complaint, if the work that is the subject of the complaint is subject to neglect, modification, or abnormal use. A.R.S. § 32-1155(D)(2) 3. You must provide safe access to any area to be inspected. If access to a roof or other elevated area is required, you must provide a means to safely access the area (ladder or manlift as appropriate). Additionally, please secure any animals.

RESPONDENT: 1. Enclosed is a copy of the complaint. Under A.R.S. § 32-1155(D) you must be allowed, upon request, the opportunity to inspect the work complained of within fifteen days of the date of receipt of this notice. 2. Purpose of the Jobsite Inspection When the Registrar receives a complaint against a contractor’s license alleging poor workmanship, the Registrar generally schedules a Jobsite Inspection. The Jobsite Inspection serves two purposes: 1. To give the contractor an opportunity to inspect the complaint items; and 2. To give the Registrar an opportunity to determine if the contractor’s work violates Arizona law.

Jobsite Inspection Rights and Responsibilities Access to inspect: The property owner has complete control over who they allow on the property. However, if the Registrar’s investigator or the contractor cannot inspect the work, the Registrar will not move forward with a citation.

Cooperation: Arizona law enables injured parties to seek relief for damages through several paths. When dealing with a licensed contractor, the Registrar of Contractors’ administrative complaint process may serve as one of those possible paths. However, in order to use that path, the Registrar relies on the cooperation of all parties to a complaint.

Minimum workmanship: The Registrar investigates workmanship complaints for compliance with minimum workmanship and professional industry standards. The Registrar does not issue citations for work that meets these standards.

Scope: The scope of the Jobsite Inspection is limited to items listed in the complaint filed with the Registrar’s office. It is the complainant’s responsibility to point out the complaint item(s) and the Investigators role to review the item(s). If the complainant identifies additional workmanship items not listed in the original complaint, they must file an addendum to the complaint. The Registrar’s Investigator may identify additional administrative violations by the contractor (e.g. work performed out of scope of the license and failure to provide a contract that meets requirements set by Arizona law) at the time of the inspection.

The Role of the Investigator At the Jobsite Inspection, the Registrar’s investigator will: ● Only investigate the items listed on the complaint form filed with the Registrar. ● Will gather evidence to make an informed decision about the complaint items.

What to expect after a Jobsite Inspection After doing a Jobsite Inspection, the Registrar’s Investigator will leave the jobsite and review the evidence provided during the inspection. Generally, the investigator does not make any determination at the time of the jobsite inspection regarding whether the allegations listed in the complaint are supported. ● If the allegations are confirmed, the Registrar’s Investigator may issue a Written Directive telling the contractor to correct the poor or incomplete work. ● If the allegations are not confirmed, the Registrar’s Investigator will close the complaint.

Written Directives Access: In order to use the administrative process offered by the Registrar, a property owner must provide reasonable access to allow the contractor to fix their work as directed by the Registrar in a Written Directive. Complainants may not put any additional, unnecessary restrictions on the Respondent above and beyond the initial contract requirements agreed upon at the beginning of the project. Respondents are required to make repairs on items identified on any Written Directive, not otherwise restricted by local code or HOA limitations. Complainants must make access available to the Respondent to make the required repairs and failure to provide reasonable access may result in the Registrar dismissing the complaint.

Contractor obligations: The Written Directive will set a deadline for compliance. This is the period of time determined by the Investigator as necessary to complete the items listed in the Directive. ● The deadline for compliance assumes the contractor will promptly begin working on the items listed in the Directive. ● Do not wait. Both parties should communicate quickly to schedule the work.

Extensions: If good cause exists to extend this deadline, either party may submit a written request to the Investigator. The Registrar will review requests for extension and determine if the Directive should be extended.

Manner and method of performance: The Registrar does not provide specific instructions for how to correct poor work. A licensed contractor is expected to have the skill and professionalism to complete the work. Moreover, the complainant may not dictate the manner of repair. If the contractor fails to appropriately correct the work according to the contract, the Registrar will issue a citation.

Compliance Inspection: After the Written Directive expires, the Registrar’s Investigator will contact the complainant to determine if the contractor performed any corrective work. ● If the contractor did corrective work, the Investigator may schedule a Compliance Inspection to determine if the poor work is corrected. ● If the contractor did not perform any corrective work, the Registrar’s Investigator will not do a Compliance Inspection and will determine whether to issue a citation based on the administrative record.

Work performed after the directive ends: After the Directive period ends, a property owner may choose to allow the contractor to continue its work. The Registrar encourages parties to work cooperatively, but cannot 1700 W. Denying access after the Directive ends is not grounds to close or dismiss a complaint.

Jobsite General Notes: Both parties were present at this jobsite investigation JSI photos taken with my Pixel 6 Pro Cell Phone JSI audio recorded with my Olympus Digital Voice Recorder model DM-620. Photos #1 and #2 are of the complainant’s residence and address.

Compliant Item 1: (ROC, this is copied from the form notice sent to AZ Pavers) This letter shall serve as written notice of breach (the “Notice”) by AZ Pavers in the performance under the Subcontract. Specifically, as of the date of this Notice, the quality of the work performed by AZ Pavers does not meet the standards as set forth by the Subcontract or the manufacturer’s installation specifications. Included in the scope of work contained in the Subcontract, AZ Pavers was to install backyard and front entry pavers specified as 24” x 24” Belgard Quartziti porcelain pavers. The scope of work specifically states the work was to include “leveling sand, disc spacer, and high performance 50 polymeric sand to joints.” Additionally, Belgard’s manufacturer’s installation specifications state the porcelain pavers should never be installed with porcelain to porcelain contact and specifically calls for 4mm spacing in between pavers using 4mm plastic disc spacers. In fact, the installation instructions repeatedly specify the use of 4mm plastic disc spacers on numerous pages and locations. AZ Pavers failed to follow the scope of work contained in the Subcontract and Belgard’s installation specifications by installing the porcelain pavers without the proper spacing and without the use of the plastic disc spacers. Instead, the pavers were installed in a manner that resulted in the pavers contacting each other. This, in addition to AZ Pavers using inadequate sub grade material and compaction as required perBelgard’s installation specifications, has resulted in movement of the pavers, as evidenced by both noise when walked across and chipping of the pavers. Over the past six months, AFT has attempted to help resolve the improper installation by providing AZ Pavers multiple attempts to correct the work based upon promises from AZ Pavers to do whatever is 1700 W. necessary to correct the issues. Attempts have been made to remove certain pavers and reinstall, along with attempting to add polymeric sand between pavers, which have little to no space. While these corrective measures have helped in limited areas, there are many areas that are still problematic. Investigator’s Observation: Verified. At this jobsite investigation I observed 24” x 24” Porcelain pavers installed at the backyard, front entry and Casita walkways. The gaps between the pavers are not uniform, some with gaps that measure ¼” and other pavers that are touching with no gaps at all. I also observed some Porcelain pavers with chips at the edges and gaps with Polymeric sand missing. See P (3) thru P (23). During this jobsite investigation the respondent acknowledged that the manufacturer’s installation specifications require 4mm spacers (0.157”) which is just under 3/16” and leveling sand and these materials were not used. The respondent acknowledged that instead of leveling sand ¼” minus base is the material used under the pavers. I am unable to verify whether or not the base material has been adequately compacted as the entire area is covered with pavers with mortared edges. I am able to verify that some of the pavers observed have movement and when walking on them rock back and forth. Prior to this jobsite investigation the respondent provided a written response stating that the complainant wanted tight fitting pavers with minimal gap spacing and not to use the 4mm spacers. During this jobsite investigation the complainant and homeowner disagreed that this was ever discussed. I am able to verify that the Porcelain pavers are not installed to the manufacturer’s installation specifications and the gaps between the pavers are not uniform. The respondent shall correct the porcelain pavers that are not installed per the manufacturer’s installation specifications and gaps that are not uniform by appropriate means. Dear Respondent:

After investigation, the Registrar determined that you failed to meet the requirements of A.R.S. § 32-1154(A), and now issues this Directive requiring you to take appropriate corrective action. Failure to comply with this Directive constitutes a violation of A.R.S. § 32-1154(A)(22) and may result in the issuance of a citation, discipline of your license, and a civil penalty pursuant to A.R.S. § 32-1154(E) of up to $500.00. You must notify the Registrar’s assigned Investigator of your compliance with this Directive prior to 5:00 p.m. on Tuesday August 15, 2023.

RESTRICTIONS • You may not perform or hire other contractors to perform work that is outside the scope of your license. • If your license is currently suspended for administrative reasons 1, or is inactive, expired, or cancelled, you may not perform any corrective work nor contract in any manner, which includes hiring other contractors to perform work, until the suspension of your license(s) has been lifted or your license(s) has been reactivated.

DIRECTIVE REQUIREMENTS You are directed to remedy the following violations by the appropriate means:

Compliant Item 1: (ROC, this is copied from the form notice sent to AZ Pavers) This letter shall serve as written notice of breach (the “Notice”) by AZ Pavers in the performance under the Subcontract. Specifically, as of the date of this Notice, the quality of the work performed by AZ Pavers does not meet the standards as set forth by the Subcontract or the manufacturer’s installation specifications. Included in the scope of work contained in the Subcontract, AZ Pavers was to install backyard and front entry pavers specified as 24” x 24” Belgard Quartziti porcelain pavers. The scope of work specifically states the work was to include “leveling sand, disc spacer, and high performance 50 polymeric sand to joints.” Additionally, Belgard’s manufacturer’s installation specifications state the porcelain pavers should never be installed with porcelain to porcelain contact and specifically calls for 4mm spacing in between pavers This means the license is suspended for lack of qualifying party, lack of bond, nonrenewal, Recovery Fund payout, or for any reason listed in A.R.S. § 32-1124(F). 1700 W. In fact, the installation instructions repeatedly specify the use of 4mm plastic disc spacers on numerous pages and locations. AZ Pavers failed to follow the scope of work contained in the Subcontract and Belgard’s installation specifications by installing the porcelain pavers without the proper spacing and without the use of the plastic disc spacers. Instead, the pavers were installed in a manner that resulted in the pavers contacting each other. This, in addition to AZ Pavers using inadequate sub grade material and compaction as required perBelgard’s installation specifications, has resulted in movement of the pavers, as evidenced by both noise when walked across and chipping of the pavers. Over the past six months, AFT has attempted to help resolve the improper installation by providing AZ Pavers multiple attempts to correct the work based upon promises from AZ Pavers to do whatever is necessary to correct the issues. Attempts have been made to remove certain pavers and reinstall, along with attempting to add polymeric sand between pavers, which have little to no space. While these corrective measures have helped in limited areas, there are many areas that are still problematic. Investigator’s Observation: Verified. The respondent shall correct the porcelain pavers that are not installed per the manufacturer’s installation specifications and gaps that are not uniform by appropriate means. A Finer Touch Construction, LLC (“AFT”) and AZ Pavers L.L.C (“AZ Pavers”) are parties to that certain subcontract agreement dated July 21, 2021 (the “Subcontract”) for work to be performed by AZ Pavers on AFT’s LaLiberte residence project located at Lot 65, 11450 E. Blue Wash Road, Cave Creek, Arizona 85331 (the “Project”).

This letter shall serve as written notice of breach (the “Notice”) by AZ Pavers in the performance under the Subcontract. Specifically, as of the date of this Notice, the quality of the work performed by AZ Pavers does not meet the standards as set forth by the Subcontract or the manufacturer’s installation specifications.

It is now apparent these previous attempts have failed to resolve the overall issue, which is the initial improper installation by AZ Pavers by its failure to comply with the Subcontract scope of work and Belgard’s installation specifications. AFT has exhausted a lot of time and effort to get this corrective work completed. AZ Pavers has caused and continues to cause delays to AFT in completing the Project in violation of Section of the Subcontract. Furthermore, AZ Pavers has failed adequately warranty its work in accordance with AZ Pavers May 30, 2023 Page 2

Section 10 of the Subcontract by not executing its work “free from faults” and make any of the promised corrections. Both the Project owner and AFT are not satisfied and reject the current paver installation.

With this Notice, AFT is directing AZ Pavers, at its sole cost and expense, to completely remove ALL of the porcelain pavers and reinstall in accordance with both the Subcontract scope of work and the Belgard’s installation specifications. Whatever quantity of pavers that cannot be adequately salvaged, shall be purchased by AZ Pavers at its sole cost and expense. If AZ Pavers fails to commence this corrective action and rectify its contractual deficiencies within forty-eight hours from receipt of this Notice, AFT shall have the right to take whatever steps we deem necessary, including correcting said deficiencies and improper installation and charge the cost thereof to AZ Pavers and filing a complaint with the Arizona Registrar of Contractors.

SHORT-FORM SUBCONTRACT AGREEMENT

THIS SUBCONTRACT AGREEMENT (“Subcontract”) is made this 21st day of July, 2021 (“Effective Date”), by and between A Finer Touch Construction, LLC, an Arizona limited liability company (“Contractor”) and AZ Pavers L.L.C., an Arizona limited liability company (“Subcontractor”).

The work identified in Section 1 below (the “Subcontract Work”) shall be performed by Subcontractor in accordance with the Prime Contract dated December 7, 2020 (including all plans, specifications, and other contractual documents attached or incorporated thereto) between Contractor and Mark LaLiberte (“Owner”).

Project: LaLiberte Residence - Lot 65, of Tonto Hills, 11450 E. Blue Wash Road, Cave Creek, Arizona 85331

SECTION 1. SCOPE OF WORK. With respect to the Subcontractor’s Scope of Work specifically set out in Exhibit A, Subcontractor agrees to furnish all necessary management, supervision, labor, equipment, supplies, materials, permits (if any), machinery, tools, transportation, and any other act or thing required to diligently and fully perform all work hereinafter described for the Project in accordance with the Contract Documents for this Project. The term “Contract Documents” shall include (a) this Subcontract; (b) the Prime Contract; (c) plans, drawings, specifications (including but not limited to the Plans and Specifications described on attached Exhibit B), and all written modifications thereto made in accordance with this Subcontract; (d) any work, purchase, or change orders issued during the course of the work; (e) the Jobsite Code of Conduct, if any, attached hereto as Exhibit C; (f) all addenda, amendments, modifications, and all other documents forming or by reference made part of the Prime Contract or this Subcontract; and (g) any written modifications or supplements to this Subcontract by the parties subsequent to the date of execution of this Subcontract.

Subcontractor represents and warrants that prior to entering into this Subcontract, it has thoroughly investigated and acquainted itself with the Subcontract Work; Project Site; Contract Documents; all applicable laws, ordinances, and regulations; and the availability of personnel, workmen, materials, and supplies. Subcontractor shall ensure all Subcontract Work is performed in accordance with the final plans and specifications approved by the governmental authority having jurisdiction over the Project. If Subcontractor discovers any discrepancies between its site observations and the Contract Documents, including any errors contained in the approved final plans and specifications, such discrepancies shall be promptly reported to the Contractor in writing

Contractor may, from time to time, request that Subcontractor perform additional work on the Project beyond that work specified in Exhibit A. Any such additional work will be handled by written change order in accordance with Section 5 hereof. However, this Subcontract does not in any way guarantee that Contractor will request Subcontractor to provide any additional work or any specific quantity or dollar amount of Subcontract Work beyond the scope of work specified in Exhibit A hereto. Subcontractor acknowledges that Contractor may not request any, or only limited, additional Subcontract Work during the term of this Subcontract.

SECTION 2. PRICE AND PAYMENT. Contractor agrees to pay Subcontractor for the performance of this Subcontract the sum of Sixty Thousand One Hundred Thirty and 00/100 Dollars ($60,130.00), subject to additions and deductions for changes agreed upon or determined in accordance with Section 5. Subcontractor warrants that the Subcontract Price includes all costs to complete all the Subcontract Work as defined in Section 1, including payment of all taxes that may be assessed against Subcontractor in performing the Subcontract Work.

Prior to the first payment being made and within fifteen (15) days of Effective Date, Subcontractor shall prepare and submit to Contractor a Schedule of Values for Contractor’s approval, with such approval being a condition of payment. The Schedule of Values shall allocate the Subcontract Price to the various portions of the Subcontract Work. If required by Contractor, the Schedule of Values shall be accompanied by a separate document identifying the names and contract values of Subcontractor’s lower-tier subcontractors. Once Contractor has approved the Schedule of Values, it shall become the basis for Subcontractor’s progress payments.

Contractor will make monthly progress payments from funds received from Owner as the Subcontract Work proceeds. It is the intent of the parties and understood that receipt by the Contractor from the Owner of funds for work performed by Subcontractor shall be a condition precedent to each payment due to Subcontractor becoming due and payable pursuant to the provisions of this section. Subcontractor shall submit a proper application for payment to Contractor

on or before the twenty-third (23rd) day of each month, with timely submission being a condition of payment. Applications for payment shall constitute Subcontractor’s representation that the Subcontract Work has been performed consistent with the Contract Documents, has progressed to the point indicated in the application for payment, and shall include: (i) itemization of the amounts requested as they pertain to the aspects of work required by the Subcontract covered by the requested payment; (ii) any backup documentation specified by Contractor or required by the Contract Documents; (iii) the total amount of the Subcontract Price, percentage completed to date, and total amounts previously paid under the Subcontract; and (iv) appropriate lien releases from Subcontractor and any and all of Subcontractor’s lower-tier subcontractors and suppliers of materials or equipment (including rental equipment). Such lien releases will include conditional lien releases from Subcontractor and each of its sub-subcontractors and materials suppliers who are due payment from the current application for payment, and unconditional lien releases not previously provided for any amounts previously paid.

Contractor may decline to approve all or any part of an application for payment and may withhold payment for any of the reasons set forth in Ariz. Rev. Stat. § 32-1183 of the Arizona Prompt Payment Act (Ariz. Rev. Stat. §§ 32-1181 through 32-1188).

Except as otherwise provided in this Subcontract and the Arizona Prompt Payment Act, final payment, including retained funds, but net of offsets, deductions, credits, or retention taken by Owner or Contractor pursuant to this Subcontract or applicable law, shall be made to Subcontractor seven (7) days after all of the following have occurred: (1) the entire work required by this Subcontract has been fully completed in conformity with the Contract Documents, (2) said work has been delivered to and accepted by Owner and Contractor, (3) Contractor has received from Subcontractor all items and documents required for payment pursuant this Section 2, and (4) Contractor has received final payment from Owner. If the Owner has declined to certify or approve an Application for Payment for final payment or a portion of an Application for Payment for final payment pursuant to the Arizona Prompt Payment Act or the Prime Contract, when any reason as stated in the Owner’s written statement pertaining to the Subcontractor has been removed or satisfied by the Subcontractor, the Contractor may submit an Application for Payment for all or a portion of the withheld amounts of final payment pursuant to the Arizona Prompt Payment Act. Final payment shall be accompanied by unconditional waivers and releases from Subcontractor, lower-tier subcontractors, material suppliers, and equipment suppliers.

SECTION 3. TIME. Time is of the essence of this Subcontract. Subcontractor shall perform the Subcontract Work in a prompt and diligent manner, so as to promote the general progress of the entire construction. Subcontractor shall keep informed of the overall progress of the Project and shall not delay or otherwise interfere with or hinder the work of the Contractor or any other subcontractor.

SECTION 4. DELAYS. Should Subcontractor delay Contractor, any other subcontractor, or anyone else on the Project, and the delay is not corrected within two (2) working days after written request by the Contractor to the Subcontractor, the Contractor, by subcontract or otherwise, may without prejudice to any other right or remedy, take over and complete the performance of this Subcontract at the expense of the Subcontractor, or without taking over the Subcontract Work, may furnish the necessary materials and/or employ the workmen necessary to remedy the situation at the expense of the Subcontractor. If the Contractor takes over the Subcontract Work pursuant to this paragraph, it is specifically agreed that the Contractor may take possession of the premises and of all materials, tools, and equipment of the Subcontractor at the site for the purpose of completing the Subcontract Work covered by this Subcontract.

A liquidated damages clause may be present in the Prime Contract stating the Contractor may be liable for liquidated damages or other damages for delay in completing the Project. If Subcontractor defaults in the performance of the Subcontract Work, which default causes delay to any part of or the entire Project and results in the assessment of liquidated damages against Contractor, then Contractor may assess a share of these damages against Subcontractor in proportion to Subcontractor’s responsibility for these damages.

SECTION 5. CHANGES TO SUBCONTRACT WORK. Subcontractor shall not make any changes in the work described herein or in any way cause to allow that work deviate from the Contract Documents without written direction from Contractor. Subcontractor shall not be compensated for any change which is made without such written direction from Contractor.

SECTION 6. INSURANCE. Prior to commencing the Subcontract Work or conducting any activities at the site of the Project, and as a condition precedent to any payment, the Subcontractor shall purchase and maintain insurance policies in conformance with the provisions outlined below, insuring both the Subcontractor and Contractor. This insurance will provide a defense and indemnify the Contractor, but only with respect to liability for bodily injury, property damage, and personal and advertising injury caused in whole or in part by the Subcontractor’s acts or omissions or the acts or omissions of those acting on Subcontractor’s behalf.

Proof of this insurance shall be provided to the Contractor before the Subcontract Work commences, as set forth below. To the extent that the Subcontractor subcontracts with any other entity or individual to perform all or part of the Subcontract Work, the Subcontractor shall require the other Sub-Subcontractors to furnish evidence of equivalent insurance coverage, in all respects, terms and conditions as set forth herein, prior to the commencement of work by the Sub-Subcontractor. In no event shall the failure to provide this proof, prior to the commencement of the Subcontract Work, be deemed a waiver by the Contractor of Subcontractor’s or the Sub-Subcontractor’s insurance obligations set forth herein.

In the event that the insurance company(ies) issuing the policy(ies) required by this Section 6 deny coverage to the Contractor, the Subcontractor or the Sub-Subcontractor will, upon demand by the Contractor, defend and indemnify the Contractor at the Subcontractor’s or Sub-Subcontractor’s expense.

The coverage must be purchased from insurance companies possessing an A. M. Best rating of A- or better. The insurer must also be an insurance company authorized to do business in and regulated by the State of Arizona.

6.5. Hazardous Materials and Pollution Liability. If Subcontractors or their lower-tier subcontractors or suppliers are either required to perform remediation of hazardous materials as those terms are defined in federal, state or local law, or if their operations create an exposure to hazardous materials, they must, in addition to the above requirements, carry a "Contractor's Pollution Liability" policy with limits not less than $1,000,000 per occurrence and not less than $2,000,000 aggregate for Bodily Injury, Personal Injury and Property Damage, naming Contractor and Owner as additional Insured. If Subcontractor or their lower-tier subcontractors or suppliers haul hazardous material (including, without limitation, waste), the policy must extend pollution coverage to the transportation of hazardous materials or pollutants by waste hauling vehicles. Such coverage requirement may be met through Subcontractor’s or its lower-tier subcontractors or suppliers Automobile Liability Policy pursuant to Section 6.2.

6.6. Riggers Liability. Should Subcontractor’s work involve the moving, lifting, lowering, rigging, or hoisting of property or equipment, Subcontractor shall carry Rigger’s Liability Insurance to insure against physical loss or damage to the property or equipment.

6.7. Additional Insured Endorsement and Certificate of Insurance. The Contractor and Owner, along with their respective officers, agents, and employees, shall be named as additional insureds for Ongoing Operations and Products/Completed Operations on the Subcontractor's and any Sub-Subcontractor's Commercial General Liability Policy, which must be primary and noncontributory with respect to the additional insureds. This insurance shall remain in effect as set forth below, in the "Continuation of Coverage" provision.

The Contractor and Owner, along with their respective officers, agents, and employees shall be named as additional insureds on the Business or Commercial Automobile Liability Policy, which must be primary and noncontributory with respect to these additional insureds. It is expressly understood by the parties to this Subcontract that it is the intent of the Parties that any insurance obtained by the Contractor is deemed excess, non-contributory, and not co-primary in relation to the coverage(s) procured by the Subcontractor, the Sub- Subcontractor, or any of their respective consultants, officers, agents, subcontractors, employees, or anyone directly or indirectly employed by any of them, or by anyone for whose acts any of the aforementioned may be liable by operation of statute, government regulation, or applicable case law. All policies shall be endorsed to provide a 30-day notice of cancellation in favor of the Contractor.

To the fullest extent permitted by applicable state law, a Waiver of Subrogation Clause shall be added to the General Liability, Automobile, Excess or Umbrella, and Workers Compensation policies in favor of Contractor and Owner, and this clause shall apply to the Contractor's and Owner's officers, agents, and employees, with respect to all Projects during the policy term.

Prior to commencement of Work on any individual Project, Subcontractor shall submit a Certificate of Insurance in favor of Contractor and an Additional Insured Endorsement (in a form acceptable to the Contractor) as required hereunder. The Subcontractor’s Insurance policies shall provide for thirty (30) days' notice to Contractor for cancellation or any change in coverage and be evidenced by the Certificate of Insurance. Copies of insurance policies shall promptly be made available to the Contractor upon request.

6.8. Sub-Subcontractor Requirements. Subcontractor shall require that its sub-subcontractors maintain, and shall require its sub-subcontractors to require their lower tier subcontractors to maintain, insurance in like form and amounts including the additional insured endorsement naming Contractor and Owner.

6.9. Property Insurance. Subcontractor shall maintain in full force and effect at all times, insurance for theft or physical damage to all tools, equipment, and property (owned or rented) obtained by or for Subcontractor, whether intended to become a part of the Subcontractor Work or not. Said insurance shall include tools, equipment, and property while in temporary locations, in transit to the Project, and while stored on the Project site.

6.10. No Limitation on Liability. With regard to any and all claims against any additional insured by any employee of the Subcontractor, anyone directly or indirectly employed by the Subcontractor, or anyone for whose acts the Subcontractor may be liable, the indemnification obligation shall not be limited by any limitation on the amount or type of damages, compensation or benefits payable by or for the Subcontractor under workers' compensation acts, disability benefit acts, or other employee benefit acts.

6.11. Cancellation, Renewal, and Modification. The Subcontractor shall maintain in effect all insurance coverages required under this Subcontract at the Subcontractor's sole expense, underwritten by insurance companies acceptable to the Contractor, until final completion and acceptance of the entirety of the Subcontract Work; or longer if so provided in this Subcontract such as with respect to completed operations coverage. Certificates of insurance showing required coverage to be in force must be delivered to the Contractor prior to commencement of the Subcontract Work for an individual Project. In the event the Subcontractor fails to obtain or maintain any insurance coverage required under this Subcontract, this shall be considered a material breach of the Subcontract, entitling the Contractor, at its sole discretion, to purchase

such equivalent coverage as desired for the Contractor's benefit and charge the expense to the Subcontractor, or, in the alternative, exercise all remedies otherwise provided in this Subcontract or as permitted by law or equity.

6.12. Continuation of Coverage. SECTION 7. INDEMNIFICATION. To the fullest extent permitted by law, Subcontractor shall indemnify, defend, and hold harmless the Owner, Contractor, and their parents, subsidiaries, affiliates, and their officers, directors, employees, and authorized agents of all the foregoing (collectively the “Indemnified Parties”) from and against any and all claims, suits, demands, losses, causes of action, damages, costs, expenses, actual attorneys’ fees, losses or liabilities, in law or equity, of every kind of nature whatsoever (“Claims”) arising out of or in any way relating to this Subcontract or either actual or alleged actions or omissions by Subcontractor or any of its lower-tier subcontractors, suppliers, employees, or persons for whom it is responsible. The obligations of this Section 7 shall apply to Claims occurring after this Subcontract is terminated as well as while it is in force. Subcontractor, however, shall not be obligated under this Subcontract to defend or indemnify any person against Claims arising only from the sole negligence or willful misconduct of the person to be indemnified or for defects in design furnished by the person to be indemnified. The indemnity set forth in this Section 7 shall not be limited by insurance requirements or by any other provision of this Agreement. All work done at the Project site by Subcontractor or in preparing or delivering materials or equipment, or any or all of them, to the site shall be at the risk of Subcontractor exclusively until the completed Subcontract Work is accepted by Contractor. The obligations of indemnity in this Section 7 shall survive the completion and termination of this Subcontract.

SECTION 8. TERMINATION. Should Subcontractor fail to rectify any contractual deficiencies, including failure to pay its creditors, within forty-eight (48) hours from receipt of Contractor’s written notice, Contractor shall have the right to take whatever steps it deems necessary to correct said deficiencies and charge the cost thereof to Subcontractor, who shall be liable for the full cost of Contractor’s corrective action, including overhead, profit, and actual attorneys’ fees.

Contractor may at any time and for any reason terminate Subcontractor’s services hereunder at Contractor’s convenience. In the event of termination for convenience, Subcontractor shall be compensated for Subcontract Work satisfactorily performed prior to termination; plus reasonable and actual demobilization costs directly caused by the termination to the extent that Contractor actually recovers those costs from the Owner. However, in no event shall Subcontractor be entitled to recover lost profits on the value of unperformed Subcontract Work.. Subcontractor shall not be entitled to any claim or lien against Contractor, Owner, or anyone else for any additional compensation or damages in the event of such termination.

SECTION 9. LIENS AND CLAIMS. Subcontractor agrees to maintain the Project, the property on which it is located, the site and any improvements thereon, any work or materials furnished pursuant to this Subcontract, and any payments due to Owner and/or Contractor, free and clear of any liens, claims of lien, suits, encumbrances, and/or stop notices, to the fullest extent allowable by law. The Subcontractor shall, as and when requested, furnish evidence satisfactory to the Contractor and the Owner that claims for labor and materials furnished by the Subcontractor in connection with performance of this Subcontract have been paid, including payroll taxes and employee benefits. Subcontractor shall furnish Contractor releases of bond rights and lien rights by persons who have furnished labor, materials, or other things in the performance of this Subcontract, it being agreed that payment of money otherwise due Subcontractor need not be made by Contractor until such releases are furnished. Subcontractor shall deliver his work free from all claims, encumbrances or liens.

SECTION 10. WARRANTY. Subcontractor warrants to Owner and Contractor that the Subcontract Work shall be executed in accordance with the Contractor Documents and Construction Documents in a workmanlike manner, shall be of good quality, and free from faults. All materials used in the Subcontract Work shall be furnished in sufficient quantities to facilitate the proper and expeditious execution of the Subcontract Work and shall be new except such materials as may be expressly provided in the Contract Documents or Construction Documents to be otherwise. The

Subcontractor warrants that all materials and equipment shall be new unless otherwise specified, of good quality, in conformance with the Contract Documents and Construction Documents, and free from defective workmanship and materials. At the Owner’s or Contractor’s request, the Subcontractor shall furnish satisfactory evidence of the quality and type of materials and equipment furnished. The Subcontractor further warrants that the Subcontract Work shall be free from material defects not intrinsic in the design or materials required in the Contract Documents or Construction Documents. Notwithstanding the foregoing, Subcontractor also makes to Owner and Contractor, as to the Subcontract Work, any other or further warranty that the Contractor makes to the Owner under the Prime Contract. The Subcontractor’s warranties pursuant to this Section 10 shall commence on the date of Substantial Completion and shall expire on the date one (1) year thereafter, or on the date of expiration of the last to expire of the Contractor’s warranties to the Owner contained in the Prime Contract, whichever occurs later. “Substantial Completion” shall have the meaning set forth in the Prime Contract, or, if no definition is stated, then the definition contained in Ariz. Rev. Stat. § 32-1181.

SECTION 11. LAWS AND SAFETY. Subcontractor agrees to fully comply with all federal, state, and local laws, ordinances, and regulations including but not limited to those with respect to the Legal Arizona Workers Act (Ariz. Rev. Stat. § 23-211, et seq.), occupational health and safety, the handling and storage of hazardous materials, accident and illness prevention, safety equipment and practices including the accident and/or illness prevention and safety program of Owner and Contractor, and compliance with all applicable environmental rules and regulations, including those relating to sediment and erosion control, storm water discharge, and air, ground, and water quality. Subcontractor shall conduct inspections and monitoring to determine that compliance with all of the foregoing.

SECTION 12. CLEAN UP. Subcontractor shall always maintain its work site in a neat, clean, and safe condition. Subcontractor is responsible for daily cleanup and cartage of debris relating to its work, at its own expense. Upon completion of work under this Subcontract, Subcontractor shall remove from the Project site all hazardous materials, temporary structures, debris, and waste incidental to its operation, and clean all surfaces, fixtures, equipment, etc., relative to the performance of this Subcontract. Subcontractor will receive a written warning for its first offense of failing to comply with its responsibilities under this Section 12. If Subcontractor fails to commence compliance with cleanup duties within twenty-four (24) hours after written notice by Contractor, the Contractor may (1) clean up Subcontractor’s work site at Subcontractor’s expense, and (2) impose a $75.00 fine for Subcontractor’s second offense and a $200.00 fine for each subsequent offense.

SECTION 13. DISPUTE RESOLUTION. If a dispute arises out of or relates to this Subcontract, its breach, or enforcement of any rights or claims concerning the Subcontract and Project, the parties shall first endeavor to reach a resolution through good faith direct discussions and negotiations. Unless otherwise agreed in writing, such negotiations shall be conducted within seven (7) days of a written request by either party for a negotiation under this Section 13. Each party shall be represented at the negotiation by agents or employees who possess necessary authority to resolve the dispute.

If the dispute remains unsettled after fifteen (15) days from the date of the negotiation session required by this Section 13, the parties shall mediate their dispute under the Construction Industry Mediation Rules of the American Arbitration Association in effect at the date of this Subcontract’s execution. The mediation shall take place in Phoenix, Arizona or another location selected by the parties, and shall be conducted by a mediator selected by mutual agreement of the parties or, if the parties are unable to agree, through appointment by the American Arbitration Association. The mediation shall be conducted no later than forty-five (45) days after the good faith negotiation required by this Section 13.

Any unresolved controversy or claim arising out of or relating to this Subcontract, or the breach thereof, shall be settled by arbitration administered by the American Arbitration Association in accordance with its Construction Industry Arbitration Rules and judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof. Arbitrated claims shall be heard by a single arbitrator. The place of arbitration shall be Phoenix, Arizona. The arbitrator(s) shall award to the prevailing party, if any, as determined by the arbitrator(s), all reasonable pre-award expenses of the arbitration, including the arbitrators' fees, administrative fees, travel expenses, out-of- pocket expenses such as copying and telephone, court costs, witness fees, and attorneys' fees. The arbitration shall commence within sixty (60) business days of the initial written arbitration demand.

Unless otherwise agreed to in writing, Contractor and Subcontractor shall continue to perform the undisputed portion of their respective obligations under this Subcontract pending completion of any dispute resolution proceeding.

In any litigation or arbitration arising out of or relating to the breach, termination, enforcement, or interpretation of this Subcontract, or for the recovery of damages incurred by one of the parties to this Subcontract, the prevailing party shall recover from the non-prevailing party a reasonable sum of attorneys’ fees, costs and experts’ fees incurred in connection with the dispute.

SECTION 14. GOVERNING LAW. This Subcontract shall be governed and enforced by the laws of the State of Arizona.

SECTION 15. JOBSITE CODE OF CONDUCT. Subcontractor and its owners, officers, directors, managers, employees and agents performing work on the Project shall at all times abide by Contractor’s Jobsite Code of Conduct, a copy of which, if any for this Project, is attached hereto as Exhibit C. Contractor may from time to time make reasonable modifications or additions to the Jobsite Code of Conduct. Subcontractor acknowledges that the Jobsite Code of Conduct is expressly made part of this Subcontract as though fully set forth herein, and Subcontractor agrees to its terms, including the imposition of fines for violations thereof as set forth therein.

SECTION 16. NOTICES. Any and all notices given pursuant to this Subcontract shall be in writing and shall be deemed duly given (a) on the date of delivery if delivered personally, (b) upon confirmation of receipt if delivered by facsimile or electronic mail, (c) on the first business day following the date of dispatch if delivered by a recognized next-day courier service, or (d) on the date received if delivered by registered or certified mail, return receipt requested, postage prepaid. All notices hereunder shall be delivered as set forth below, or pursuant to such other instructions as may be designated in writing by the party to receive such notice:

SECTION 17. OTHER PROVISIONS. If any term or provision hereof is illegal or invalid for any reason whatsoever, such illegality or invalidity shall not affect the validity or legality of the remainder of this Subcontract. This Subcontract, together with the Exhibits hereto, contains the complete and integrated agreement between the parties, and supersedes any agreements between them with respect to the subject matter hereof. This Subcontract (including the Exhibits hereto) may be modified only by a written instrument executed by both parties. Failure to require performance of any provision hereof will in no manner affect the right to later enforce the same, and no waiver will be deemed to be or considered as a further or continuing waiver of any provision of this Subcontract. The Subcontractor shall not, in whole or in part, assign or sublet this Subcontract or the proceeds thereof without the written consent of the Contractor. This Subcontract may be executed in separate counterparts, each of which will be deemed to be an original, but which together will constitute one and the same instrument. An executed signature page of this Subcontract delivered by facsimile transmission or .pdf delivered via email shall be effective as an original executed signature page. Any person signing this Subcontract for a party represents and warrants that he has express authority to sign this Subcontract for that party and agrees to hold the opposing party harmless for any costs or consequences of the absence of actual authority to sign.

EXHIBIT C JOBSITE CODE OF CONDUCT

The following Jobsite Code of Conduct is to be strictly adhered to by all subcontractors, suppliers, and their respective officers, directors, managers, employees, sub-subcontractors, and agents while on the jobsite.

1. No smoking permitted on the jobsite, except in designated areas.

2. All trades are responsible for the removal of their own debris daily; more often if needed.

3. At minimum, all trades are to have a working broom on their truck and to sweep their debris and area of work on a daily basis. Shop vacuums are preferred.

4. No food or drink allowed inside except water. Food should be consumed in designated area.

5. All water bottles are to be removed from the jobsite and disposed of.

6. No alcohol or illegal drugs allowed on the jobsite. Under no circumstances will any worker be under the influence of alcohol or drugs while on the jobsite. Any worker caught possessing, using, or distributing illegal drugs or alcohol will be banned from the jobsite permanently.

7. All OSHA regulations must be complied with while on the jobsite. Hardhats, work boots, and safety glasses to be worn at all times.

8. Ladders and scaffolding shall be in good condition and used in accordance with OSHA guidelines.

9. No foul or abusive language, and no offensive clothing.

10. No radios. Headphones are permissible.

11. No children or animals are allowed on the jobsite.

12. Parking shall be in designated areas only.

13. Use designated restrooms only.

14. Injuries shall be reported to the superintendent immediately.

15. Any unsafe condition or potentially hazardous situation should be reported to the superintendent.

16. Trades are responsible for securing their own equipment and materials. AFT Construction is not responsible for theft of any item from the jobsite.

Any violation by Subcontractor of this Jobsite Code of Conduct may result in a warning for the first offense, a $75.00 fine for the second offense, and a $200.00 fine for each subsequent offense. In the event Contractor receives a fine from any association or governing body due to Subcontractor’s violation the association’s rules or this Jobsite Code of Conduct, then Subcontractor will be liable to Contractor for the amount of such fine.

Subcontractor shall provide a copy of this Jobsite Code of Conduct to each of its owners, officers, directors, managers, employees, sub-contractors and agents performing work in connection with the project.

(ROC, this is copied from the form notice sent to AZ Pavers) This letter shall serve as written notice of breach (the “Notice”) by AZ Pavers in the performance under the Subcontract. Specifically, as of the date of this Notice, the quality of the work performed by AZ Pavers does not meet the standards as set forth by the Subcontract or the manufacturer’s installation specifications. Included in the scope of work contained in the Subcontract, AZ Pavers was to install backyard and front entry pavers specified as 24” x 24” Belgard Quartziti porcelain pavers. The scope of work specifically states the work was to include “leveling sand, disc spacer, and high performance 50 polymeric sand to joints.” Additionally, Belgard’s manufacturer’s installation specifications state the porcelain pavers should never be installed with porcelain to porcelain contact and specifically calls for 4mm spacing in between pavers using 4mm plastic disc spacers. In fact, the installation instructions repeatedly specify the use of 4mm plastic disc spacers on numerous pages and locations. AZ Pavers failed to follow the scope of work contained in the Subcontract and Belgard’s installation specifications by installing the porcelain pavers without the proper spacing and without the use of the plastic disc spacers. Instead, the pavers were installed in a manner that resulted in the pavers contacting each other. This, in addition to AZ Pavers using inadequate sub grade material and compaction as required per Belgard’s installation specifications, has resulted in movement of the pavers, as evidenced by both noise when walked across and chipping of the pavers. Over the past six months, AFT has attempted to help resolve the improper installation by providing AZ Pavers multiple attempts to correct the work based upon promises from AZ Pavers to do whatever is necessary to correct the issues. Attempts have been made to remove certain pavers and reinstall, along with attempting to add polymeric sand between pavers, which have little to no space. While these corrective measures have helped in limited areas, there are many areas that are still problematic.

We Az Pavers Ilc contest any and all charges in the above mentioned complaint.

A Finer Touch Construction (AFT) as General Contractor owned by Brad Leavitt and Mark LaLiberte President of Construction Instruction are affiliated with Pro Builder and worked together On the "Desert comfort home idea" (now the personal residence of Mark LaLiberte ).

All parties affiliated with A Finer Touch Construction including Spencer Nield and Andrew Clark and Mark LaLiberte are complicit in directing, observing and approving of the porcelain paver install.

Mark Laliberte insisted on "tight joints" and did not want space or grout joints associated with Installation. He conveyed instructions to Andrew Clark who directed our installer Mario Lopez to Not use spacers ( which were present on site ) during install.

Only several months later did A Finer Touch Construction decide to formulate a plan to shuffle off the blame on to Az Pavers that spacers should have been used. AFT then threatened legal action and filed complaint directing Az Pavers to demolish entire job, buy all new material, and Reinstall Patios, walkways , pool coping etc.

We have since received correspondence from AFT, that we could alternatively " cut a check " for Work to be completed by Phoenix Pavers and Landscaping.

A copy of Bid from Phoenix Paver and Landscaping is attached which shows a figure of $83,759.93. This amount, plus our original invoice to AFT for install ( never paid) of $ 16,535.85 would cause our out of Pocket costs in this matter to equal $100,295.78.

The written directive from the Registrar of Contractors states: Complainants may not put any additional unnecessary restrictions on respondents above and beyond initial contract agreed at beginning of project, Complainants may also not dictate manner of repair. The directive is vague and allows complainant to dictate repair which is egregious and not in good faith.

In closing Az Pavers has been a licensed, bonded and insured member of the ROC for more than 10 years with No prior complaints!

PREHEARING DISCLOSURE REQUIREMENT Under A.A.C. R4-9-118(A), before a hearing, the parties must prepare a disclosure statement. The disclosure statement must contain: • A list of all the witnesses the party will call to testify, including the witnesses’ contact information and a brief description of the subject matter of the witnesses’ expected testimony; and • A list of all the exhibits that the party will use at the hearing.

EXCHANGING DISCLOSURE STATEMENTS AND EXHIBITS Under A.A.C. R4-9-118(B) (effective November 5, 2017), a party to the hearing must serve on every other party and file with the Office of Administrative Hearings a copy of: • The disclosure statement; and, • Any exhibit that the party will use at the hearing. Service: The disclosure statement and exhibits must be served on all parties in accordance with Arizona Administrative Code R2-19-108 Filing Documents. Under A.A.C. R2-19-108, service is completed by: • Personal delivery; • 1st class, certified or express mail; or • Facsimile. Timing: The disclosure statement and the exhibits must be served and filed not less than seven calendar days before the date of the hearing. Under A.A.C. R2-19-108, a document is served on a party: • On the date it is personally served; • Five days after it is mailed by express or 1st class mail; • On the date of the return receipt if it is mailed by certified mail; or • On the date indicated on the facsimile transmission.

CONSEQUENCES FOR FAILING TO DISCLOSE Under A.A.C. R4-9-108(C), if a witness or an exhibit is not timely disclosed as required the rules, and good cause for the failure to disclose is not shown, then the administrative law judge may: • Order that certain witnesses or exhibits not be used at the hearing; • Order that a particular fact is or is not established for the record; or, • Order that a charge, a defense, a claim, or some portion thereof, be dismissed.
