MINUTE ENTRY - GRANTING CONTINUANCE

AND SETTING STATUS DATE

The hearing of this matter was scheduled to convene on September 15, 2023, at 9:00 a.m. On the date and time set for hearing, Matthew Sohn appeared on behalf of Desert Sky Doors & Closets, LLC (“Complainant”). Kristin Quintin appeared as a witness for Complainant. Sanford Germaine, Esq. represented Golden State Homes, LLC (“Respondent”). Tyler Schacter, Landon Wahlstrom, and Rick Shapiro appeared as witnesses for Respondent.

The parties participated in a prehearing discussion outside of the presence of the Administrative Law Judge and initially did not resolve the matter. However, at the commencement of the hearing, the parties decided to enter into a settlement agreement. The terms of the settlement agreement required additional time to execute. Therefore, good cause appearing, the hearing in the above-entitled matter is continued and set for a Status Update on September 29, 2023. On or before this date, Complainant is advised to do one of the following:

Inform the Tribunal that the matter has been satisfactorily resolved by submitting a Motion to Vacate the hearing;

Inform the Tribunal that the parties need additional time to resolve the matter by submitting a Motion to Continue and reset for Status by 30-days, 45-days, or 60-days; or

Inform the Tribunal that the parties are unable to resolve their dispute and request that the matter be set for hearing.
