MINUTE ENTRY - GRANTING CONTINUANCE

AND SETTING STATUS DATE

The continued hearing of this matter was scheduled to convene on February 13, 2024, at 9:00 a.m. On the date and time set for continued hearing, Complainant Sarah Bartelt appeared on her own behalf. Alex Martinez appeared on behalf of Respondent Tierra Bonita Construction, LLC. Registrar of Contractors Investigator Jim Dimond appeared as a witness.

Prior to the commencement of the hearing, the parties informed the Tribunal that some progress toward resolution has been made in that Respondent has applied for a permit with the County and has hired a draftsman to help in the process. However, the permitting process is not yet complete, and after obtaining the permit, work will need to be performed. The parties requested that this matter be continued again and reset for another Status Update in six (6) weeks.

Good cause appearing, the hearing in the above-entitled matter is continued and set for a Status Update on April 15, 2024. On or before this date, Complainant is advised to do one of the following:

Inform the Tribunal that the matter has been satisfactorily resolved by submitting a Motion to Vacate the hearing;

Inform the Tribunal that the parties need additional time to resolve the matter by submitting a Motion to Continue and reset for Status by 30-days, 45-days, or 60-days; or

Inform the Tribunal that the parties are unable to resolve their dispute and request that the matter be set for hearing.
