On January 24, 2024, Counsel for Respondent called the Office of Administrative Hearings to request a continuance of the scheduled hearing. Staff of the Office of Administrative Hearings emailed Counsel to advise, “If counsel is requesting a continuance of the hearing, it must be in the form of a written motion. A phone call will not suffice.”
In response to the email, instead of filing an appropriate motion, Counsel for Respondent emailed the Office of Administrative Hearings dates of availability. Both modes of communication were ex parte.
If Respondent is requesting a continuance of the hearing, counsel for Respondent shall file an appropriate motion stating a reason for the requested continuance and copy Complainant so that Complainant may file a response thereto.
Respondent’s ex parte communications are rejected and will not be ruled upon.
