MINUTE ENTRY - GRANTING CONTINUANCE
AND SETTING STATUS DATE
The hearing of this matter was scheduled to convene on September 25, 2023, at 1:00 p.m. On the date and time set for hearing, Complainants Elise and Rodney Mitchell appeared on their own behalf. Daniel Link and Greg Link appeared on behalf of Respondent Durango Masonry and Tile, LLC. Registrar of Contractors Investigator Todd Anderson was present.
The parties participated in a prehearing discussion outside of the presence of the Administrative Law Judge. As a result of that discussion, Complainants requested a continuance of the hearing in order to afford them time to consider settlement options with Respondent. Respondent did not object to a continuance of the hearing. Finding good cause, the Administrative Law Judge granted the request to continue.
Therefore, the hearing in the above-entitled matter is continued and set for a Status Update on October 10, 2023. On or before this date, Complainants are advised to do one of the following:
Inform the Tribunal that the matter has been satisfactorily resolved by submitting a Motion to Vacate the hearing;
Inform the Tribunal that the parties need additional time to resolve the matter by submitting a Motion to Continue and reset for Status by 30-days, 45-days, or 60-days; or
Inform the Tribunal that the parties are unable to resolve their dispute and request that the matter be set for hearing.
