ORDER VACATING

HEARING

On June 28, 2023, the Arizona Registrar of Contractors (“Registrar”) referred this matter to the Office of Administrative Hearings (“OAH”), an independent state agency, for an evidentiary hearing on August 24, 2023. Per the July 07, 2023, Notice of Hearing the issues to be determined are whether the Registrar has cause to discipline Respondent’s license based on the following alleged statutory violations:

Charge 1: A.R.S. § 32-1154(A)(3) – A.A.C. R4-9-108(a)

Charge 2: A.R.S. § 32-1154(A)(12) – A.R.S. § 32-1158

Charge 3: A.R.S. § 32-1154(A)(22)

On August 24, 2023, at the time set for hearing, Complainant informed the Tribunal that outstanding complaint items from the Registrar’s Compliance Jobsite Inspection of the above-captioned matter had recently been remediated by Respondent, or otherwise resolved between the parties. As such, Complainant requested that Complaint No. 2023-02455 be dismissed. Therefore,

IT IS ORDERED, pursuant to Ariz. Admin. Code R2-19-111(3), as the parties have resolved their dispute, this matter is hereby vacated from the calendar of the Office of Administrative Hearings and is remanded to the referring agency for further action, if any.
