ORDER VACATING

HEARING

On April 27, 2023, the Arizona Registrar of Contractors (“Registrar”) issued a Notice of Hearing on Contested Case (“Notice of Hearing”) which set the above-captioned matter for hearing on June 05, 2023, at 1:00 p.m., to determine whether grounds existed for the Registrar to take disciplinary action against ROC License No. 099114 for an alleged violation of Arizona Revised Statute 32-1154(A)(10); per a Citation issued March 28, 2023.

On May 15, 2023, Respondent submitted a Motion to Continue. The motion was granted by the same date and set for a Status Update on May 30, 2023. Correspondence was not returned as undeliverable from either party.

On June 01, 2023, the parties were advised to submit a Status Update no later than 5:00 p.m. on June 02, 2023, and that failure to timely comply would result in the matter being vacated and remanded to the referring agency pursuant to Arizona Administrative Code R2-19-1111(4). Correspondence was not returned as undeliverable from either party. As of this date, no such update has been provided by the parties. Thusly,

IT IS ORDERED pursuant to Ariz. Admin. Code R2-19-111(4) this matter is hereby vacated from the calendar of the Office of Administrative Hearings and remanded to the Registrar for further action, if any.

IT IS FURTHER ORDERED that the Registrar’s March 28, 2023, Citation be affirmed. As such, the Registrar’s Director may impose discipline against ROC License No. 099114.
