The undersigned Administrative Law Judge, having reviewed the document Notice to Appear in Person at Hearing as filed on behalf of Respondent September 22, 2023, makes the following minute entry:

Respondent’s request is predicated on the grounds that it would be at “[A] severe disadvantage and prejudicial to both the presentation and merits of its defense and affirmative allegations to attempt to coordinate its testimony and the exhibits remotely.”

As such, the undersigned is concerned that Counsel has mistaken the above-captioned matter for a hearing on the substantive complaint in 2022-09056, which was adjudicated April 10, 2023, resulting in a Final Administrative Decision and Order, effective, June 25, 2023. The issue in the case at bar is to address Respondent’s appeal of the Registrar’s related determination regarding Complainants’ Recovery Fund Claim pursuant to Ariz. Rev. Stat. §§ 32-1132 to 32-1133.01.

Regardless, Respondent’s request is nonetheless granted. Respondent and its attorney may appear in-person for these proceedings.
