FINDINGS OF FACT
The above-captioned matter was set to convene for hearing on April 7, 2025, at the Office of Administrative Hearings in Phoenix, Arizona.
The matter was continued and a new hearing was set for April 14, 2025 at 1:00 p.m. The Order granting continuance was issued on March 27, 2025, and sent to Respondent’s e-mail address of record.
No representative for Respondent appeared by 1:15 p.m. and consequently, the matter was not convened and no evidence was taken.
CONCLUSIONS OF LAW
The burden of proof at an administrative hearing falls to the party asserting a claim, right or entitlement and the standard of proof on all issues in this matter is by a preponderance of the evidence. See A.A.C. R2-19-119.
Because Respondent failed to appear at the hearing set based upon its request when it challenged the Notice of Administrative Award, its request is unsupported by evidence. Consequently, the Notice of Award shall be issued.
ORDER
IT IS ORDERED that the Registrar affirm the Notice of Award to Complainant.
In the event of certification of the Administrative Law Judge Decision by the Director of the Office of Administrative Hearings, the effective date of the Order will be forty (40) days from the date of that certification.
