MINUTE ENTRY - GRANTING CONTINUANCE

On June 20, 2024, Counsel for Respondent submitted a Motion to Continue due to “a multi-day trial scheduled in the Superior Court of Arizona the week of July 8, 2024.”

On June 26, 2024, Counsel for the Arizona Registrar of Contractors submitted their reply, noting no objection.

By that same date, Counsel for Complainant submitted a reply, noting an objection, overall, to the length of time administrative proceedings have taken. Specifically, Complainant argued that he “cannot delay this matter any longer” because it “has been ongoing for nearly two years.” While Complainant’s frustration is understandable, his contention is technically incorrect as the Registrar did not refer the above-captioned matter for adjudication to the Office of Administrative Hearings (“OAH”) until May 08, 2024. The Notice of Hearing on Appealable Agency Action was not issued to the parties until May 30, 2024.

Therefore,

IT IS ORDERED in light of Ariz. Admin. Code R2-19-106(C) and good cause appearing, that Respondent’s motion is granted. This hearing is continued to Tuesday, July 16, 2024 at 9:00 a.m. The parties shall participate remotely via use of the following Google Meet information:
