HEARING

The hearing of this matter was scheduled to convene on December 9, 2022, at 1:00 p.m. On the date and time set for hearing, Clay Mullenaux appeared on behalf of Complainant Redline Custom Cabinet. Scott Holt appeared on behalf of Respondent Arizona Pure Custom, LLC. Prior to the commencement of the hearing, the parties advised the Tribunal that they had reached an agreement, however, needed additional time in which to execute the terms of the settlement agreement.

The Administrative Law Judge granted the parties’ request for continuance and set the matter for a Status Update on February 6, 2023.

Neither party filed the required Status Update.

On February 13, 2023, the Tribunal issued a Minute Entry to the parties advising that if the parties fail to file the required Status Update by February 15, 2023, at 12:00 p.m., the matter will be vacated from the calendar of the Office of Administrative Hearings.

Neither party filed a Status Update by noon on February 15, 2023.

Based on the above,

IT IS HEREBY ORDERED that the hearing in this matter is vacated from the calendar of the Office of Administrative Hearings.

IT IS FURTHER ORDERED remanding this matter to the Arizona Registrar of Contractors for any further action.
