On October 26, 2022, the Office of Administrative Hearings (“OAH”) received a Notice of Noncompliance from Respondent. On October 27, 2022, OAH issued a Minute Entry that required Complainant to file a written response or provide written notice of compliance with Respondent’s underlying request by November 02, 2022. Correspondence was not returned as undeliverable. To date, Complainant has not fulfilled either directive. Thusly, Respondent’s motion to vacate is granted. Therefore,

IT IS ORDERED that this matter is hereby vacated from OAH’s calendar and is remanded to the referring agency for further action, if any.
