HEARING

The hearing in this matter was scheduled to convene by telephone or video conference at 9:00 a.m. August 9, 2022. Shortly after that time, Complainant appeared and although there was a connection open with “Oscar” who is believed to represent Respondent, no one on that connection responded to the Administrative Law Judge’s prompts. The matter was convened and Complainant’s representative informed the tribunal that Complainant had been paid in full, with $9000 collected from Respondent’s bond and Respondent paying the remaining balance.

Complainant agreed that the matter should be dismissed, but Complainant’s representative expressed her frustration at the length of time it took to obtain payment from Respondent, which payment was unfairly delayed. She provided her opinion that Respondent’s behavior showed a lack of professional ethics that should be brought to ROC’s attention because of the impact that a contractor’s failure to timely pay subcontractors can have on those subcontractors.

IT IS ORDERED vacating this matter and remanding it to the Registrar of Contractors.
