HEARING

This matter was previously set for status updates due by February 3, 2023, and March 31, 2023. In the last status update provided on February 3, 2023, counsel for Respondent indicated the parties had executed a settlement agreement and were awaiting confirmation that Complainant had received the settlement check. Counsel for Respondent asserted that, upon such confirmation, the parties would file a joint motion to dismiss, which he anticipated being filed within two weeks. To date, no further updates or motions have been received by the Office of Administrative Hearings. In the order setting the March 31, 2023 status date, the parties were advised as follows:

If a status update is not received by March 31, 2023, the Administrative Law Judge will conclude that the matter has been resolved and the hearing will be vacated.

As the parties have not submitted the required status updates,

IT IS HEREBY ORDERED that the hearing in this matter is vacated from the calendar of the Office of Administrative Hearings.

IT IS FURTHER ORDERED remanding this matter to the Arizona Registrar of Contractors for further action.
