FINDINGS OF FACT
On or about February 14, 2022, Complainant filed a Non-Payment Complaint with the Registrar of Contractors.
On June 30, 2022, an Order was issued setting the matter for Status Update for March 20, 2023, to ensure compliance with the parties’ settlement agreement.
On December 16, 2022, Complainant file a Status Update informing the tribunal that the Respondent was not complying with the settlement agreement.
On December 28, 2022, the tribunal set a hearing for February 27, 2023 at 1:00 p.m., and e-mailed an order regarding the same to the parties’ addresses of record.
On February 27, 2023, Complainant failed to appear at the hearing. The tribunal waited 20 minutes beyond the scheduled start time, but no one appeared for Complainant.
CONCLUSIONS OF LAW
By failing to appear at the hearing, Complainant did not meet the burden to present evidence in support of the complaint. See A.A.C. R2-19-119.
RECOMMENDED ORDER
Based on the foregoing, it is recommended that on the effective date of the Registrar of Contractors’ Order, Complainant’s complaint be dismissed.
