On April 22, 2022, the Arizona Registrar of Contractors (“Registrar”) issued a Notice of Hearing (“Notice”) setting the above-captioned matter for hearing on June 13, 2022, at 9:00 a.m., at the Office of Administrative Hearings (“OAH”) in Phoenix, Arizona. The Notice provided, in pertinent part, as follows:
You must attend this hearing. This is an adversarial hearing before an administrative law judge, and is conducted in a similar manner as judicial proceedings. Thus, you must be prepared to present evidence, including witness testimony and documents, in support of your case.

Correspondence was not returned as undeliverable from either party.
On May 10, 2022, a Motion to Continue was received by OAH, and subsequently granted via a Minute Entry – Granting Continuance issued on May 31, 2022; setting the matter for continued hearing on July 27, 2022.
On July 27, 2022, at the time scheduled for continued hearing, another Motion to Continue was received by OAH. The motion was granted and the matter was reset for a Status Update on August 17, 2022.
On August 26, 2022, the matter was reset for an extended Status Update on September 26, 2022, and then extended further to January 05, 2023.
On January 11, 2023, a Minute Entry – Granting Continuance was issued setting the above-captioned matter for continued hearing at 1:00 p.m. on February 09, 2023. Correspondence was not returned as undeliverable from either party.
On February 09, 2023, although afforded a fifteen minute grace period, Complainant failed to appear for the hearing. No written request to appear via alternative means or continue the matter was received by or on behalf of Complainant. Complainant is deemed to have defaulted their appearance.
There is no Settlement Order on file for this case at OAH.
Therefore,
IT IS ORDERED that Complaint No. 2022-00498 be dismissed without prejudice.
IT IS FURTHER ORDERED, pursuant to Ariz. Admin. Code R2-19-117 and R2-9-119(B)(1), this matter is hereby vacated from OAH’s calendar and is remanded to the referring agency for further action, if any.
