ORDER MODIFYING DECISION
The Tribunal has reviewed the Motion for Modification of ALJ Decision and the Response thereto. Good cause appearing;
IT IS ORDERED replacing paragraphs 5 and 6 with the following language:
5. The Stipulated Findings of Fact stated above constitute grounds to discipline Respondent’s peace officer certification under A.A.C. R13-4-09(A)(7) and A(12) (“Engaging in conduct or pattern of conduct that tends to disrupt, diminish, or otherwise jeopardize public trust in the law enforcement profession”).
6. However, based upon the testimony provided as well as the letters in Exhibit 7, the tribunal believes that Deputy Montoya has proven himself to be a valuable asset to not only the Greenlee County Sheriff’s Office, but to the Greenlee County community as well. Further, Deputy Montoya has already served a significant suspension, as well as the embarrassment from the community, and has learned and grown from this incident.
