HEARING

The hearing of this matter was scheduled to convene on August 9, 2021, at 1:30 p.m. On the date and time set for hearing, Complainant Dawn Jett appeared on her own behalf. William Baillie appeared on behalf of Respondent City Pro, LLC. Registrar of Contractors Investigator Beau Cruz appeared as a witness. During the course of the hearing, while on recess, the parties entered into a settlement agreement, however needed additional time in which to execute that agreement. Therefore, the Administrative Law Judge adjourned the hearing in order to set the matter for a Status Update pursuant to which Complainant was required to advise the Tribunal of the status of the matter on or before August 16, 2021. Complainant was to do one of the following:

Inform the tribunal that the matter has been satisfactorily resolved by submitting a Motion to Vacate the hearing;

Inform the tribunal that the parties need additional time to resolve the matter by submitting a Motion to Continue and reset for Status by 30-days, 45-days, or 60-days; or

Inform the tribunal that the parties are unable to resolve their dispute and request that the matter be set for further hearing.

Complainant failed to submit the Status Update notwithstanding an email reminder being sent by the Office of Administrative Hearings on August 25, 2021.

Consequently,

IT IS HEREBY ORDERED that the hearing in this matter is vacated from the calendar of the Office of Administrative Hearings.

IT IS FURTHER ORDERED remanding this matter to the Registrar of Contractors for any further action.
