The hearing of this matter was scheduled to convene on July 28, 2021, at 9:00 a.m. On the date and time set for hearing, Sherry Rosales appeared on behalf of Earth Water Fire, LLC (“Respondent”). Treeland Nurseries, Inc. (“Complainant”) did not appear for hearing. However, the Tribunal is in receipt of correspondence dated July 27, 2021, from Complainant to the Office of Administrative Hearings in which Complainant’s representative, Isabelle Smith, advised that Complainant wished to vacate the hearing due to the parties having resolved the matter in dispute.

Based on the above and good cause appearing,

IT IS HEREBY ORDERED that the hearing in this matter is vacated from the calendar of the Office of Administrative Hearings.

IT IS FURTHER ORDERED remanding this matter to the Arizona Registrar of Contractors for any further action.
