ORDER VACATING

HEARING

This matter was scheduled to convene for hearing on March 29, 2021. Complainant did not appear at the scheduled time, but had filed a request for mediation. Respondent’s representative informed the tribunal that Respondent also wanted to mediate the matter, but had not filed a request to do so. Subsequently, Respondent filed a request to mediate, but it was signed only by Complainant. In an Advisement dated March 30, 2021, the parties were informed that the matter could not be set for mediation unless Respondent submitted a properly signed request.

No request for mediation was received from Respondent and in an Order Setting Filing Deadline dated April 13, 2021, the parties were informed that Complainant was required to file a request for the matter to be reset for hearing on or before April 29, 2021, and that if he failed to do so, the matter would be vacated from the docket of the Office of Administrative Hearings.

As of May 5, 2021, Complainant had not filed a request to reset the matter for hearing. Consequently,

IT IS ORDERED vacating this matter and remanding it to the Registrar of Contractors.
