ORDER VACATING

HEARING

The hearing of this matter was scheduled to convene on July 29, 2020, at 9:00 a.m. On the date and at the time set for hearing, Complainant’s representative, Carrie Anderson, appeared telephonically. Respondent did not appear. At that time, Ms. Anderson informed the Tribunal that the parties were making an effort to resolve the matter in dispute and requested a continuance of the hearing. The Administrative Law Judge granted the request and set the matter for a Status Update by August 12, 2020.

On August 12, 2020, Complainant submitted a Status Update stating the following:

Pursuant to the minute entry dated July 29, 2020 providing for a status update in Docket No. 2020A-02172-NPC-ROC, Complainant Quad Cities Drywall hereby requests a motion to continue to allow parties time to fully resolve this matter. Complaint requests to reset this hearing in 60 days.

On August 13, 2020, the Administrative Law Judge issued a Minute Entry to the parties setting another Status Date of October 9, 2020 by which Complainant was to notify the Office of Administrative Hearings in writing of the status of this matter. Complainant did not file a Status Update.

On December 18, 2020, the Office of Administrative Hearing sent an email to the parties requesting that they submit a written status update no later than December 23, 2020. The parties failed to do so.

The Administrative Law Judge deems Complainant’s lack of response as a withdrawal of the filed Complaint.

Consequently,

IT IS HEREBY ORDERED that the hearing in this matter is vacated from the calendar of the Office of Administrative Hearings.

IT IS FURTHER ORDERED remanding this matter to the Arizona Registrar of Contractors for any further action.
