On July 28, 2021, the Arizona Registrar of Contractors (“Registrar”) issued a Notice of Hearing on Appealable Agency Action (“Notice”) setting the above-captioned matter for hearing on September 10, 2021, at 9:00 a.m., at the Office of Administrative Hearings (“OAH”) in Phoenix, Arizona.

On September 01, 2021, the matter was continued per Respondent’s request, and reset for continued hearing on November 15, 2021, at 9:00 a.m.

On November 15, 2021, the matter was again continued per Respondent’s request, and reset for continued hearing on January 05, 2022, at 9:00 a.m.

On January 05, 2022, the matter was continued pursuant to an emergency request from the Registrar, and reset for continued hearing on March 09, 2022, at 9:00 a.m. The Continuance Order, which was transmitted to the parties on January 13, 2022, noted, in pertinent part as follows:

On March 09, 2022, although Assistant Attorney General John Tellier, Esq. appeared on behalf of the Registrar with Katelyn Rolling and David Fagerburg as witnesses, and Janet Mata appeared on behalf of Complainant, there was no appearance by or on behalf of Respondent. At the end of a 10-minute grace period, the undersigned found Respondent to be in default.

There is no Settlement Order on file for this case at OAH.

Therefore,

IT IS ORDERED, pursuant to Ariz. Admin. Code R2-19-111(4), R2-19-117, and R2-19-119(B)(1), this matter is hereby vacated from OAH’s calendar and is remanded to the referring agency for further action, if any.
