IN THE OFFICE OF ADMINISTRATIVE HEARINGS

On October 1, 2019, a hearing was held, on the above matter, at the Office of Administrative Hearings (OAH). Administrative Law Judge Antara Nath Rivera heard the matter. During the hearing, there was testimony that Respondent was to complete the corrective work, per the Directive, on October 2, 2019. On October 17, 2019, OAH received an email from Respondent which contained emails exchanged between Respondent and Complainant. On October 16, 2019, Daniel Trujillo emailed Respondent on behalf of Complainant. Mr. Trujillo stated “all the repairs on the complaint have been taken care of” by Respondent. Additionally, Mr. Trujillo indicated that Complainant was satisfied with the repairs. Based on Complainant’s email, Respondent fulfilled its contractual obligations. Thus, the Administrative Law Judge will not issue a recommendation in this matter and will vacate the hearing with respect to the decision deadlines. IT IS RECOMMENDED that the Registrar of Contractors close Complainant’s complaint in Case No. 2019A-01489 against Respondent’s License No. 312067. Sufficient cause appearing, IT IS HEREBY ORDERED that the hearing in this matter is vacated from the calendar of the Office of Administrative Hearings. IT IS FURTHER ORDERED remanding this matter to the Registrar of Contractors for further action. Done this day, October 17, 2019.
