On April 9, 2019, order issued vacating hearing in this matter for failure of Complainant to prosecute its claim. The order issued after both parties failed to appear at the previously set hearing and for Claimant’s failure to file with the Respondent a Joint Written Status Report as ordered. Respondent filed a statement on April 15, 2019 indicating that Complaint has failed or refused to respond to Respondent’s efforts to prepare a joint status report. The ALJ, at the time of issuing the order to vacate, was unaware that on April 10, 2019 the Complainant filed a separate Done this day, May 3, 2019.
